PASSED AND ADOPTED this 18th day of May , 1977, by the following roll call vote: AYES: Councilmen Brannon, ~ouncilwoman Snyder, Mayor Simpson NOES: Councilmen Wood and Feibusch ABSENT: None ATTEST: City Clerk Effective: 6-1-77 RULE AND REGULATION NO. 1 EXTENSION OF ELECTRIC MAIN LINES OR OTHER PLANT FACILITIES A. APPLICABILITY: The City will extend its electric system along public roads and streets and upon private property across which satis- factory easements or rights of way have been obtained. B. SYSTEM EXTENSION WITHIN THE BOUNDARIES OF A RESIDENTIAL SUBDIVISION OR OTHER RESIDENTIAL DEVELOPMENT TO BE SERVED The applicant shall provide at no cost to the City and in accordance with City standards and specifications all trenching, backfill, resurfacing, equipment pads and land- scaping. Upon acceptance by the City, the applicant will transfer ownership of such facilities to the City. Conduit, junction boxes, vaults and subsurface housings required for power distribution within the development will be supplied by the City. Applicant to reimburse the City cost thereof. Such costs to include an appropriate charge for purchasing and warehousing. 1. Construction by Applicant: Applicant shall install all conduits, vaults, equipment pads and subsurfacing equipment with pull wires or ropes installed in all conduit runs ready for City forces to pull in conductors. Prior to backfilling or placing of concrete for equipment, or subsurface equipment, facilities must be inspected by City electric department representative. 2. Construction by the City: After acceptance of the facilities provided by the applicant, the City will furnish and install all cable transformers, switches and other equipment required for -1- Effective: 6-1-77 the system extension. As used herein, the term "cable may, at the option of the City, include preassembled cable-in-conduit or direct-buried cable. a. Advances by Applicant (1) The developer shall pay to the City, before the start of construction, the estimated cost of the underground extension within the subdivision as follows: (a) For subdivisions, the product of $5.33 per foot times the total footage of property fronting on streets within the subdivision. (b) For developments, the product of $9.72 per foot times the total footage of dis- tribution lines within the development. (2) The entire amount compUted in Section B.2.a. (1) (a) or (b) above shall be a refundable advance. (3) If the total footage determined in Section B.2.a. (1) (a) or (b) above exceeds the limits set forth in (a) or (b) below. Then (a) $2.38 per foot in Subdivisions, or (b) $6.06 per foot in developments for all such excess footage shall be a refundable advance. (a) For subdivisions, the sum of 125 feet times the total number of single-family and/or multi-family lots plus 25 feet times the number of separately metered dwelling units in excess of two in each multi-family building. (b) For developments, the product of 75 feet times th number of dwelling units. b. Refund of Advance The refundable advance determined in accordance with Section B.2.a. (1) (2) or (3) will be subject to refund as follows: (1) To determine the amount to be refunded, the total refundable advance will be divided by the total number of (a) lots within the subdivision, or (b) individual dwelling units within the development covered by the advance, then: -2- Effective: 6-1-77 (2) When (a) a building has been completed on a lot within the subdivision and service is supplied to the first permanent customer on that lot, or (b) service is supplied to a permanent customer in a dwelling unit in a development, that portion of the advance (determined in accordance withb. (1) above) appropriate to_..~_~__~sai~lot or dwelling unit will be refunded upon/a~p~~ion by the developer. (3) When (a) buildings have been completed in 90% of the total number of lots within the subdivision and service is supplied to at least one permanent ~- customer in each of such buildings,, or (b) all buildings have been completed in the development and service supplied to 90% of the dwelling units~__~ remainder of the advance will be refunded upon/~~~ion. (4) Ail refunds will be made promptly and without interest, but not later than 90 days after eli- gibility for refund is established. (5) In the event that any portion of an advance has not qualified for refund at the end of 12 months after completion of the underground extension, , the developer will pay to the City its ownership costs on that portion of the advance for which no refunds have been made or are eligible to be made. The ownership costs shall be equal to 3/4% per month of the difference between the total amount advanced and any refunds made or eligible to be made to the developer. Payment of such ownership costs will normally be made by deduction from the developer's advance, but such deduction will not reduce the amount on which the cost of ownership charged is based. (6) No payment will be made by the City in excess of the refundable amount advanced by the developer nor after a period of three years from the date the City is first ready to render service from the extension, and any unrefunded amount remaining at the end of the three year period will become the property of the City. 3. Connection Charges Charges for connection to the system will be as detailed in Schedule 1615, Utility Connection Charges, with credit allowed for any oversizing or extra facilities re- quired by.tl]e City in order to provide for area beyond the boundaries of the deve].opment. Such credit will be computed.on the basis of the City's costs for the materials involved. Effective: 6-1-77 C. SYSTEM EXTENSIONS OR REINFORCEMENT OUTSIDE THE BOUNDARIES OF A RESIDENTIAL SUBDIVISION OR OTHER RESIDENTIAL DEVELOPMENT TO BE SERVED: 1. Construction by City: The City or its contractor will construct the necessary underground facilities to deliver electric power to the development site. -4- Effective: 6-1-77 2. Construction by Applicant: Where mutually agreed upon'by the City and tine applicant, all or part of' the requir{}d system extension may be con- structed by the applicant in accordance with the standards and specifications of the City of Ukiah. E. SYSTEM EXTENSIONS OR REINFORCEMENT OUTSIDE T[tE BOUNDARIES OF A NON-RESIDENTIAL SUBDIVISION OR OTHER NON-RESIDENTIAL DEVELOPMENT-TO-BE SERVED: 1. Co~struct.i_on by City: The City or its contractor will construct the necessary under- ground facilities to deliver electric power to the deve].opment site, and connection to these facilities will be subject to charges in accordance with Schedule 1615, UtilJt_y Connection Charges. Applicant will reimburse City all material costs attributed to his development as determined by the City Engineer. 2. Construction by Applicant: Where mutually agreed upon by the City and the applicant, all or part of the required system extension may be con- structed by the applicant in accordance with the standards and specifications of the City of Ukiah. F. Temporary Overhead Construction: Based on a finding by the City Engineer under Section 3854E, Underground Utilities, of the Ukiah Municipal Code, that under- ground facilities are not feasible, temporary pole lines may be constructed by the City to provide electric power to a subdivi- sion or other development remote from existing power lines until permanent underground facilities are established. Included among reasons for such determination may be: · Remoteness of new development. · Uncertainty as to possible road widening or realignment. · Uncertainty as to probable development patterns. · Insufficient area development to warrant the expense of an underground system. The overhead lines will be replaced by an undergrou~d system at such time as determined to be practicable by the City Engineer. All applicants served from lines will be subject to charges in accordance with Schedule 1615 Utility Connection Charges. -5- Effective: 6-1-77 UTILITY CONNECTION CHARGES SCHEDULE 1615 ELECTRIC SERVICE CONNECTIONS APPLICABILITY: This schedule applies to all connections to the City's electric distribution system except those which serve street lighting or traffic signals. TERRITORY: Within the incorporated limits of the City and land owned or .leased by the City. GENERAL DESCRIPTION OF CHARGES: A. Underground Systems: The connection charge for underground residential, conm~ercial, or industrial service will consist, of one or more of the , following of fees, where applicable: 1. Service Connection Fee: Where the City installs the service conductors, a service connection fee shall'be charged. B. Overhead Services: No overhead service for new construction shall be permitted except with the approval of the City Engineer and on].y after a finding in accordance with Section 3854, Exemptions of Article 6, "Undergrounding of Utilities" of the Ukiah Muni- cipal Code, that an underground service is not feasible. Where such a serivce is allowed, an overl]ead service fee shall 'be charged. C. Temporary Service: A fee shall be charged to connect a temporary service. an underground service, the customer shall furnish and install all material up to the designated point of connection. For an overhead service, the City will supply the service- drop conductors from existing facilities. Ail additional faci- lities, when required, shall be supplied and removed at the customer's expense. '-6-- Effective: 6-1-77 UTILITY CONNECTION CHARGES SCHEDULE 1615 ELECTRIC SERVICE CONNECTIONS D. Replacement Service: Where, in the opinion of the City Engineer, replacement of service conductors is necessary, such replacement will be made without charge except under the following circumstances: 1. Customer wishes to change the existing service to a 125- ampere, 3-wire service but the existing conduit is in- adequate. 2. Customer wishes t© change %he existing service to a size larger than a 125-ampere', 3-wire service. 3. Customer or his agents have damaged the service. 4' The original installation was not installed in accordance with City standards and the City has not accepted respon- · sibility for maintenance. When the City replaces a service without charge to the Customer, the customer is obligated to accept a shutdown of service during regular working hours to achieve [he replacement. The time of the shutdown shall be agreed upon as mutually acceptable. When the City replaces a service for the convenience of the customer during other than regular working hours, it shall be done at the customer's expense. CHARGES: 1. .Underground Systems: A. Residential: These charges apply to developments in which electric metering will be on a single-family basis. 1. The connection fee for a service requiring greater length or capacity than described herein is the actual charges of the installation cost. B. Commercial and Industrial: These charges also apply to commercial--residential developments in which electric metering will be on a multiple-family basis. 1. Service Connection Fee: a. 200-ampere maximum, 600-volt maximum, 3- or 4-wire, 100-foot maximum servic~ length ......... $200.00 b. The service connection fee for a service ~'equiring greater length o]3 capacity or at a greater voltage than described under 1.a. above shall be the actual charges of the in- stallation costs. II. Additional facilities, if required, shall be provided and removed at the customer's expense. B. Underground Service: 1.
