HomeMy WebLinkAbout77-074 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 29 30 31 32 RESOLUTION NO. 77-7 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH AMENDING THE PERSONNEL RULES WHEREAS, the Employee-Employer Relations Officer has met and conferred in good faith with representatives of Operating Engineers Local Ne. 3, and WHEREAS, a Memorandum of Understanding has been arrived at, and WHEREAS, said Memorandum has been presented to the City Coun- cil for its consideration NOW, THEREFORE BE IT RESOLVED that the Personnel Rules are hereby revised in accordance with the provisions of the Memorandum of Understanding, items No. 9 and 15. Brown Act of 1968, as amended, the parties hereto, the Employee Relations Officer of the City of Ukiah (City) and Operating Engineers Local Union No. 3 of the International Union of Operating Engineers, AFL-CIO (Union) have met and conferred in good faith and pursuant to Section 3505.1 of the California Government Code hereby jointly prep~r~~ ~ ~ this written Memorandum of Understanding for presentation to the governing body of the City of Ukiah for consideration. It is hereby understood as follows: 1. This memorandum shall be effective from July 1, 1_976 until June 30, 1978. 2. Effective with the pay period beginning en the date closest to July 1, 1976, the City pay plan shall be amended to move all full time permanent classes up one-ha].f range, which is equal to a 2 1/2% general increase. 3. Effective with the pay period beginning er: the date closest te January .1, 1977, the City pay plan shall be amended to move all full time permanent classes up an additional one- half range, which is equal to a 2 1/2% general increase. 4. Effective with the pay period beginning en the date closest to July 1, 197~' the City pay plan shall be amended to increase all full time permanent salaries by an amount equal to the percentage change in the San Francisco Bay Area Consumer Price Index between March 1976 and Harch 1977; except that the increase shall in any event be at least 5% and in no event greater than 7%. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 3O 31 32 5. The previous agreement to seek to amend the I~ERS contract to allow buy back military time is hereby rescinded and is of no effect. 6. %'he City shall pay up to $90/mo/emp].oyee-toward health and welfare plan costs effective 8-1-76. The Oper. ating Engineers health plan will be quoted on a flat rate premium basis after 8-].-76. On 7-1-77 this amount shall he increased to $100/mo/employee. 7. In consideration of Union's request for special adjust- ments for the classes of Sweeper Operator, Park Maintenance Attendant, and Meter Reader, the City hereby agrees to budget for and conduct a pay and classification study for ail non- safety non-clerical personnel. 8. The clerical classification and pay study carried out bt, Andersen and Associates shall be implemented effective July 1, 1976, as recommended by Andersen and Associates. 9. Chapter XIII Employee Evaluation Procedure shall be rescinded in its entirety. A new rule shall be adopted to read as follows: Section I. Periodic evaluation a.=~=ach employee shall be evaluated twice annua].ly. b. Additional evaluation may be made as required as a result of changes in performance. Section 2. The purpose of the evaluation is to insure that supervisors communicate their opinions of employee performance to employees on a regular basis and to q'J. ve employees an opportunity to discuss their performance with their supervisor. The departmental personnel involved in employee evaluation shall in each case be the in~nediate super- visor, if any, ~f tile employee involved and the De- partment Head, together with the personnel office, administrative assistant, or other employees assigned by the Appointing Officer. In some c~ses the Depart- merit Head is the immediate supervisor. b. Ail ratings shall, be made on a form 1)rovided by the Personnel Officer. c. After evaluation, the results shall be reviewed '- with the employee and he may accept the rating or request and be granted a review with the City Manager. If the review with the City Manager is scheduled all ?ersons involved~ in the rating may be prescnt. If the rating is determined to be accurate it shall be in effect or if determined to be subject to adjustment shall be adjusted. d. If an employee is dissatisfied with a rating after review by the appointing officer he may be entitled to appeal 'to the Civil Service Board under prescribed procedure. e. All Department Heads shall be rated by the City Manager and shall have the same rights as other em?loyee in appealing to the Civil Service Board if dissatisfied. f. Instructions shall be given to ali_ employees in- volved in rating other employees to establish a uniform procedure which will result in fair and impartial rating 10. The City will provide rain and protective g~ar for all employees required to work outside in inclement weather, to include hat, coat, pants and boots. .12. The City and Union will cooperate in developing a safety program. Union will make available staff members to assist in program development. !3. The shift schedule in the Fire Department shall be ].900 i~ours to 1900 hours, effective 8-1-76. The previous agreement signed by the Fire Chief, City Massager, and Ope~'ating Engineers relating to hours and dated October 14, 1975 shall be null and void, effective immediately. 14. Effective July 15, 1976, the Fire Chief shall issue an appropriate order allowing shift trades for periods of time less than four hours between the hours of 5:00 p.m. and 8:00 a.m. subject to the approval of the duty captain. 15. Effective 7-1-76 the City shall adopt the following uniform policy to be added to the Personnel Rules. a. Fire Department - In consideration or- the payment of $135 annually, each safety member shall provide and maintain his uniform in accordance with the policy adopted by the departmen-~. b. Police Department - In consideration of the payment of $255 annually, each sworn officer shall provide and maintain his uniform in accordance with the Police Depart- ment's uniform manual. c. The City shall seek to amend its agreement with Blue [-~hield to upgrade the hospital room and board benefit from three bed ward to full semi-private coverage on the base and majo~ medical plan, to be ef.fective 7-1-76.
