HomeMy WebLinkAbout72-29RESOLUTION NO. 72-29 10 11 12 15 14 15 16 17 18 19 2o 25 24 25 26 27 28 29 ~0 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH DESIGNATING THE COUNTY OF MENDOCINO, ACTING THROUGH THE COMPREHENSIVE SOLID WASTE MANAGEMENT COMMITTEE AS THE AGENCY FOR SOLID WASTE PLANNING FOR THE CITY OF UKIAH WHEREAS, grant funds are immediately available for the planning of a comprehensive Solid Waste Management Plan for the City of Ukiah pursuant to the provisions of Section 204, 205, 207, 208, and 210 of the Solid Waste Disposal Act, as amended by the Resources Recovery Act of'1970; and WHEREAS, the United States Environmental Protection Agency (EPA); the agency responsible for the review of grant applications funded under the aforementioned Sections of the Solid Waste Disposal Act, amended; gives highest priority for funding to multijurisdictional planning bodies; and, ~ WHEREAS, in December, 1970, the County of Mendocino Comprehensive Solid Waste Management Committee was formed, the membership of which included official representatives from all the incorporated cities within jurisdictional boundaries of the County of Mendocino including the City of Ukiah; and, WHEREAS, the Committee constitutes a multijurisdictional planning agency acceptable to the United States Environmental Protection Agency and in compliance with the United States Bureau of the Budget (BOB) Circular A-95 conditional on adoption of this resolution; and, WHEREAS, the City Council of the City of Ukiah does expressly desire their representative to continue to meet and cooperate with the other members of said Committee in developing a Comprehensive Solid Waste Management Plan that benefits the City of Ukiah and the people of the remaining political judicial areas of and within the County of Mendocinoo 4 10 11 12 13 14 15 16 17 18 19 21 23 24 NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Ukiah hereby resolves the following: 1o The County of Mendocino acting through the Comprehensive Solid Waste Management Committee is designated the agency for the development of a solid waste management plan for the City of Ukiah as it relates to a county-wide program. 2. The said committee shall make every effort to secure a planning grant available under the Solid Waste Disposal Act, amended. 3o Should it be necessary for the City to provide cash or in-kind contribution as may be required for the grant, the City Council retains the express right to review and approve such a committment prior to the grant application being submitted to EPA; and further shall adopt a resolution accepting the terms and agreements of the grant conditions concerning the cash or in-kind match. The foregoing Resolution was introduced by the City Council, and carried, this 2nd day of February , 1972, by the following vote on roll call: AYES: Councilmen Scotto, Simpson, Pearson, & Mayor Norgard NOES: None ABSENT: Councilman Buxton · WHEREUPON, the Mayor declared the resolution adopted, AND SO ORDERED° 2?
