RESOLUTION GRANTING VARIANCE TO
DONALD L. TRACY
The City Council of the City of Ukiah does hereby
RESOLVE:
An application for variance having been duly presented and filed, the Planning
Commission of the City of Ukiah having duly held a public hearing, taken evidence,
and made and filed its recommendations, and the City Council of the City of Ukiah,
having duly considered the recommendations of the Planning Commission;
The City Council hereby finds that the proposed variance is in harmony with the
general purpose of the Zoning Ordinance of the City of Ukiah and meets the conditions
thereof; and
Does hereby grant Variance No. 72-3 to:
DONALD L. TRACY
to permit: construction of 20 unit apartment complex on a parcel bounded by Barnes~
Hope, Perkins and Church Streets, Zoned R-1
all subject to the following conditions:
1. Standard Conditions Nos. 1 thru 9 contained in the Rules of Practice
and Procedure of the Planning Commission on file with the Clerk shall
apply in addition to any special conditions set forth below.
2. The special conditions listed below shall apply:
a) The Design Standards for this 20 unit complex be as
described on the Site Plan & Dwelling Unit Study as
presented by Mr. Robert Axt.
b) Landscaping must be provided along all front set backs.
If any condition set forth above is violated, or if any required approval is not
obtained, then this variance shall be null and void, otherwise to continue in full
force and effect indefinitely'and to run with the land. This variance is granted only
for the specific purposes set forth above, and shall not be construed as eliminating
or modifying any building, use or zone requirements except as to such specific purposes.

3. Any construction she1] comply with the ~Standard Sl~Ciflcatiens"t

by the Engineering I)epartment of the City ef Uklah; except where higher stan-
dards ere impased by law~ rule or regular§eh or by action of the Piann§ng Cern-
miss§on such standards shal~ be met.

6. Any variance or use permit shall be put into effect by completion
of construction0 ~f any, within one (1) year from the date of final approval
of such variance er use permit.
7. ~f any use permitted shall cease for six (&) consecutive months

inate and such variance or use Permit shall be revocable by the granting body.
