RESOLUTION GRANTING VARIANCE TO
CHARLES MAGOWAN
The City Council of the City of Ukiah does hereby
RESOLVE:
An application for variance having been duly presented and filed, the Planning
Commission of the City of Ukiah having duly held a public hearing, taken evidence,
and made and filed its recommendations, and the City Council of the City of Ukiah,
having duly considered the recommendations of the Planning Commission;
The City Council hereby finds that the proposed variance is in harmony with the
general purpose of the Zoning Ordinance of the City of Ukiah and meets the conditions
thereof; and
Does hereby grant Variance No. 71-25 to:
Charles MaGowan
to permit: a reduction in setback requirement from 20 feet to 17 feet in connection
with Washington Square Subdivision
all subject to the following conditions:
1. Standard Conditions Nos. 1 through 9 contained in the Rules of
Practice and Procedure of the Planning Commission on file with
the Clerk shall apply in addition to any special conditions set
forth below.
2. The special conditions listed below shall apply:
a. That no driveways are permitted on to Washington Street from
Lots 1 and 8 of the subdivision.
b. No building projections, such as roof overhangs, porches,
awnings, etc., shall be nearer than 14 feet of the property
line.
If any condition set forth above is violated, or if any required approval is not
obtained, then this variance shall be null and void, otherwise to continue in full
force and effect indefinitely and to run with the land. This variance is granted only
for the specific purposes set forth above, and shall not be construed as eliminating
or modifying any building, use or zone requirements except as to such specific purposes.
