HomeMy WebLinkAbout71-39 1 3 4 § 6 ? 8 9 10 11 12 13 14 16 17 18 19 20 21 2-2 24 ~5 26 ~? 28 30 RESOLUTION NO. 71-39 RESOLUTION DECLARING WEEDS AND RUBBLE UPON PRIVATE PROPERTY TO BE PUBLIC NUISANCE AND ORDERING ABATEMENT OF SAME WHEREAS, the continued growth and accumulation of weeds upon private property within this city constitutes a continual public nuisance and fire menace during the dry season; and, WHEREAS, continued accumulations of rubbish, refuse and dirt upon certain private property within this city constitutes an unsightly public nuisance as well as a hazard to efficient fire control methods; and, WHEREAS, the Government Code of the State of California prescribes procedure for the abatement of such weeds, rubbish, refuse and dirt, which procedure requires that the property owner remove such material and if he fails that the city shall do so and assess the costs to the property owner; NOW, THEREFORE, the City Council of the City of Ukiah does hereby RESOLVE: That all weeks, as defined in Section 39560 of the Government Code of California, which are growing upon the private property, or the streets or sidewalks fronting on such private property, hereinafter described, and all rubbish, refuse and dirt accumulated on such property, are, pursuant to the authority of Article 3, Chapter 13, Part 2, Division 3, Title 4 of the Government Code of California, hereby declared to be public nuisances and are hereby ordered to be abated as such. The City Council does hereby find that the properties upon which or in front of which the nuisances exist are as set forth in the attacmed list, which list is incorporated by reference herein and made a part of this Resolution as if set forth in full herein. The owner or owners of each such property are hereby directed to remove such weeds, rubbish, refuse and dirt as indicated from, upon, or in front of such property, and that upon the failure to so remove such weeds, rubbish, re- fuse and dirt, the nuisance will be abated and the weeds, rubbish, refuse, and dirt removed by the city and the cost of removal will be assessed upon the 4 6 7 8 9 10 13 14 15 16 17 18 :1.9 ~7 30 31 land from or in front of which the materials are removed and will constitute a lien upon such land until paid. BE IT FURTHER RESOLVED, that Wednesday, June 2, 1971, at 8:00 p.m. or as soon thereafter as the same may be heard, in the Council Chambers, City Hall, Ukiah, California, is hereby fixed as the time and place for hearing any property owners having any objection to the proposed removal of weeds, rubbish, refuse and dirt. The City Clerk is hereby directed to prepare and mail a written notice as required by law to each person owning such described property as shown on the records of the Assessor of Mendocino County. The Director of Public Works of the City of Ukiah is hereby directed to post such notice or notices upon such of the properties described as he may deem necessary to give addi- tional notice to property owners. The posted notices shall be for the con- venience and information of the public and are not intended to supplant the official legal notices given by the City Clerk.
