HomeMy WebLinkAbout70-21ORIGINAL RESOLUTION NOo 70-21 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH URGING THE ENACTMENT OF LEGISLATION WHICH WOULD PERMIT GENERAL LAW CITIES TO ISSUE REVENUE BONDS FOR EXTENSIONS AND IMPROVEMENTS TO MUNICIPAL ELECTRIC DISTRIBUTION AND GENERATION FACILITIES WHEREAS, the present general laws of the State of California pertaining to the power of general law cities to issue revenue bonds do not provide the power to issue such bonds for the purposes of extending or improving either electrical distribution facilities or electrical generation facilities, and WHEREAS, Article 11, Section 19 of the Constitution of the State of California grants to any municipal corporation the right to establish and operate a municipally owned electric utility, and WHEREAS, the City of Ukiah and several other general law cities of the State of California serve their citizens with electric power by means of municipally owned electrical distribution systems, and WHEREAS, these cities have ever increasing electric power needs both as a result of demand and population growth within their present boundaries, and by reason of annexation, and WHEREAS, the present inability to finance extensions and improvements to exist- ing electrical distribution facilities, and the inability to finance the development of supplemental electric power generation facilities by means of revenue bonds, works a severe hardship upon the municipal finances of such citfes and could well be the cause of depriving some or all of their citizens in the future from receiving electric power at as low a cost as they might otherwise be able to use and enjoy such power, NOW, THEREFORE, the City Council of the City of Ukiah does hereby RESOLVE: That the Legislature of the State of California be urged to enact enabling legislation which would permit general law cities to finance extensions and improve- ments of municipally owned electric distribution facilities and construction of electric power generation facilities by means of the issuance of revenue bonds in the same manner that such cities are now permitted to finance extensions and improve- ments to municipal water systems by such means.
