HomeMy WebLinkAbout78-102 1 4 10 11 12 RESOLUTION NO. 78-102 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH APPROVING AGREEMENTS FOR UTILITY IMPROVEMENTS (HOSPITAL DRIVE, ORCHARD AVENUE) WHEREAS, the City and Developers have reached agreement regarding the improvements for the Hospital Drive and Orchard Avenue. NOW, THEREFORE, IT IS HEREBY RESOLVED that the Mayor and Clerk are authorized to sign the agreements attached hereto and made a part hereof with Developers for the improvements. PASSED AND ADOPTED this 17th day of May 1978 by the 1411 following roll call vote: 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 80 81 82 AYES: Councilmembers Hickey, Myers, Simpson, Snyder, Mayor Branno NOES: None ABSENT: None ATTEST: City Clerk Mayor 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 AGREEMENT FOR INSTALLATION OF UTILITIES-ORCHARD AVENUE THIS AGREEMENT made and entered into this 17th day of May, 1978 between the undersigned parties, collectively described as "DEVELOPERS", and the CITY OF UKIAH, a municipal corporation, hereafter referred to as "CITY", RECITALS: This agreement sets forth the basis and considerations upon which DEVELOPERS and CITY shall extend utilities (water, sewer and electric) in Orchard Avenue north of Hospital Drive. The utilities extension is required to provide services for lands on which DEVELOPERS wish to construct various structures upon. DEVELOPERS and CITY recognize that the utilities extension pro- posed is a necessary precedent to development of the area of concern. THE PARTIES THEREFORE AGREE AS FOLLOWS: 1. CITY shall extend utilities from their present termini in Orchard Avenue to a point in Orchard Avenue which is on a line representing an extension of the northern boundary of the propert~ of Hunt Construction Company. Said property is presently slated for development of low and moderate income housing. 2. DEVELOPERS shall install, at their sole expense, the ex- tension of Orchard Avenue from its present terminus to the identi- cal point of extension of the utilities. This extension shall in- clude curb, gutter and sidewalk except for that portion which traverses the lands now owned by the Barber family; sidewalk may be excluded from that area. 3. Costs for extension of water line and sewer line shall be --~-- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 paid back to CI'i?Y by MORENO, except for ti:,;, amount of $5,400.00, which represents cost of oversizing lines, at time of development of MORENO property or within 10 years from the date of this agree- ment, whichever shall first occur. Payback shall be made at the time MORENO property is developed and building permits are issued. Payback from MORENO parcels shall be based upon the front footage of said parcels developed pro rata over the extension cost. 4. The obligations and benefits of this agreement shall inure to the benefit of the heirs, successors or assigns of the parties.
