HomeMy WebLinkAbout78-96RESOLUTION NO. 78-96 RESOLUTION GRANTING VARIANCE TO ADAM JESS The City Council of the City of Ukiah does hereby RESOLVE: An application for variance having been duly presented and filed, the Planning Commission of the City of Ukiah having duly held a public hearing, taken evidence, and made and filed its recommendations, and the City Council of the City of Ukiah, having duly considered the recommendations of the Planning Commission; The City Council hereby finds that the proposed variance is in harmony with the general purpose of the Zoning Ordinance of the City of Ukiah and meets the conditions thereof; and Does hereby grant Variance No. 78-67 to: Adam Jess to permit: Reduction of required lot frongage from 70' to 63' for two parcels and lot size from 7,000 sq. ft. to 6,000 sq. ft. for one lot all subject to the following conditions: 1. An aerial easement be recorded for electrical service if the existing service crosses over Parcel No. 2. 2. Only single-family residential use be allowed on Parcel No. 1. 3. A parcel map reflecting these concerns be recorded. 4. Standard conditions 1 thru 9. If any condition set forth above is violated, or if any required approval is not obtained, then this v~riance shall be null and void, otherwise to continue in full force and effect indefinitely and to run with the land. This variance is granted only for the specific purposes set forth above, and shall not be construed as eliminating or modifying any building, use or zone requirements except as to such specific purposes. Dated this 1st day of May , 1978 Mayor ACCEPTANCE I, the undersigned applicant, do hereby certify that I have read the foregoing and that I accept such variance subject to all terms and conditions contained therein. STANDARD CONDITIO] Where the action of the Commission So indicates, any or all of the following Standard Conditions may be incorporated by reference into the Commission's determination on any matter before it: 1. Ail use, construction Or occupancy shall conform to the application and to any supporting documents submitted therewith. · 2. Any construction, and the location thereof, shall conform to any maps, sketches or plot plans accompanying the application or submitted by applicant in support thereof. 3.. Any construction shall comply with the "Standard Specifications: for such type of construction now existing or which may hereafter be promulgated by the Engineering Department of the City of Ukiah; except where higher standards are imposed by law, rule or-regulation or by action of the Planning Commission such standards shall be met. 4. In addition to any particular condition which might be imposed, any construction 'shall comply with all building, fire, electric, plu~nbing, occupancy and structural laws, rules, regulations and ordinances. 5. Applicant shall be required to obtain any' approval which is required by law, regulation or ordinance. 6. All required building permits shall be issued within three months after the effective date of the Use Permit, Variance or Architectural Review or same shall be null and void. 7. If any use permitted shall cease for six (6) consecutive months then the ~ight to any variance or use permit permitting such use shall terminate and such variance or use permit shall be revocable by the granting body. 8. If any condition, special or standard, is violated, or if any required approval is not obtained, then the variance or use permit granted shall be null and void; otherwise to continue in full force and effect indefinitely until otherwise terminated and shall run with the land. 9. Except as otherwise specifically noted, any variance or use permit shall be granted only for the specific purposes stated in the action approving, and shall not be construed as eliminating or modifying any building, use or zone requirements except as to such specific purposes.
