I~-~REAS, Govermnent Code Section 56198 requires a resolution of
application to the Local Agency Fom~ation Conmdssion for proposed annexation
to an existing city and detachment of area from a district and,
WHEREAS, Government Code Section 56140 specifies the contents of such
resolution, and
~-~REAS, the City of Ukiah has been requested by property owners to
annex certain properties to the City,
NOIV THEREFORE BE IT RESOLVED-
1. The City of Ukiah proposes to annex the area known as "Orr
Creek" and
,
2. This proposal is made pursuant to Part 2 of Division 1 of Title
6 of the Government Code ti_tled "District Reorganization Act of
1965" and
3. The proposed "Orr Creek" annexation encompasses 8.77 ucc'es
bounded on the north by Orr Creek, on the east and south by
existing City boundaries and on the west by the westerly right-
of-way line of Orr Street, including Hendocino County Assessor
Parcel Numbers 2-100-05,05 and 10 and a portion of Orr Street
and illustrated by Exhibit A (map) and Exhibit B (legal
descriptJ on).
4. The City of Ukiah proposes to provide the appropriate urban
services to the subject area as specified Jn Exhibit C (plan for
services) which has been prepared pursuant to Government Code
Section 35102, and
5. This proposal is made because, due to the nature of probable
development and the resulting demand for municipal services, the
area should appropriately be within the jurisdiction of the City
oI-Ukiah, rather than part of the unincorporated area served by
the County of ~.!endocino, and
6. The subject properties have been prezoned frown Mendocino County
A-1 to City of Ukiah PD by order of Ordinance No. 727, and

7. The area is proposed to be detached from the UkiahValley Fire
Protection District as fire service will be provided by the
City of Ukiahupon annexation.
8. The area is uninhabited as there are only two registered
voters within the annexation boundaries, and
9. The City of Ukiah requests that proceedings be initiated by the
Mendocino Count)' Local Agency Formation Commission pursuant to
Government Code Section 50000 et.seq, for annexation of the
subject area, and to the City and detachment .from the District,
10. The City Clerk is hereby directed to fonqard a certified copy
of this Resolution of Application, including Exhibits A,B, and
C, to the Executive Officer of the Local Agency Formation
Co~nission, and the Director of Community Development is hereby
directed to submit to the Executive Officer of the Local Agency
Formation Commission all other documents required by said
Commission.

Beginning at a point in the existing boundary of the City of Ukiah as established
by Ordinance No. 586, adOpted by the City Council of the City of Ukiah on December
2, 1966, said point being the intersection of the Westerly line of Lot 86 of
Yokayo Rancho with the centerline of Orr Creek, being also a point in the Southerly
line of Lot 15 of the Revised Subdivision of the Brunner-Briggs Addition No. 1
as shown on a map, recorded December 16, 1910 in Map Case 1, Drawer 3, Page 56,

Pursuant to Section 35102 of the State of California Government Code, a plan
for the provision of urban services to a newly annexed area must accompany an
application for annexation. This plan is prepared in conjunction with the
annexation application to tl~ Mendocino County I,ocal Agency Formation Commission
for the acreage encompassed in the Orr Creek annexation to the City of Ukiah.
The area to be annexed is bounded on the north by Orr Creek, on the east and south by
existing City boundaries and on the west by Orr Street. 'Existing land uses within
the area are; residential and open vacant. There is one residential unit in the
area. Approximately 7.85 acres of the vacant land are proposed for single family
attached and/or apartment uses at a density of approximately. 10 dwelling units per
acre with no specific plans for. the remaining vacant property.
The specific project related to this annexation is 'a. two phase residential
development of 64 attached townhouses in Phase I and either 44 attached townhouses
or 56 apartment units in Phase II. This project will encompass approximately
five acres of land currently within the City of ~dah in addition to the seven
acres proposed for annexation. Fiscal analysis for the aimexation fncludes both
alternatives of'the t0til projedt. The'project has'not been divided by annexation
boundaries as the total project requires annexation for implementation.
Existing services to the area are provided by the Countyof b~ndocino in the
functions of General government, Administrative, ~blic l~rks and Sheriff.
Electricity is provided by P.G.& E; sewerage is provided by the Ukiah Valley
Sanitation District; fire prevention and protection is provided through the
Ukiah Valley Fire Protection District, a sbecial district on contract with the
City of Ukiah. Telephone, gas and cable television are currently supplied and
would continue to be provided by Pacific Telephone and Telegraph, P.G.&E. and
Teleprompter respectively. Solid waste is on an individual property owner
basis. Water is provided by both individual wells and City of Ukiah.
The proposal is annexation to the City of Ukiah which is a full service municipality.
In addition to general administrative activities, the City of [~iah provides police
and fire services, its mm water production and distribution system, its own
electric distribution system, a sewage treatment plant and public works services
including street maintenance and capital improvements. Solid waste disposal is
through City franchise with private hauling companies.
In general, the proposed services to be provided to the annexation area would be
those currently existing in the City of Ukiah which are enumerated in detail
below. The level and range of these services would be the same as currently
provided. Increased development would not cause a decrease in the levels of
service to either existing City residents or the new area. The services can. feasibly
be extended to the affected territory immediately, as presently the City abuts the
properties on the east, south and west.
No specific improvements to structures, roads, sewer or water facilities are
proposed without specific development taking place. Current City policies
require developers to participate in any in~rovements for urban uses; conditions

'imposed by the City would be those of normal development considerations. The
services to be provided would be financed through the existing City revenue
structure which includes property taxation, reimbursement from the State and
Federal governments under various in-lieu and per capita fees and revenue
sharing programs. Also user fees for electric, water, sewer, and solid waste
will be charged and .thus provide revenues for these services.

SERVICES
PUBLIC SAFETY
FIRE
A. Service to be extended: Fire protection and prevention.
B. Level and range of service: The area is currently served by the Ukiah
Valley Fire Protection District whose services are provided under
contract by the City of Ukiah. The department is staffed by 16 full
tim~ firefighters with 22 volunteers, blinimummanning is four fire-
f{gktersoperating out of two stations located at Clay and School Streets
in downtown Ukiah and Lovers Lane and. North State Street, inm~ediately
north of the Freeway/State Street interchange. The level and range of
service would remain as currently exists. The Fire Chief states that
based upon a standard of one firefighter per 1000 population, development
would require 1/3 of a person. Ilowever, analysis of the specific
proposal indicates that this project would not necessitate additional
personnel or equipment. For fiscal analysis purposes though, 1/3 of a
firefighter is included.
C. When available' Immediately
D. I_mprovements required: None
E. Conditions to be imposed by City: Fire hydrants will be required as
development occurs to the specifications of the Fire Marshal and placed
by the developer. Compliance with applicable fire codes will be required
through building permit review as currently exists in both City and County.
F. How financed: City General Fund revenues.
POLICE
A. Service to be extended: Police protection and assistance.
B. Level and range of service: The area is currently served by the Mendocino
CoUnty Sheriff wiO~ .the City of [~iah Police Department providing back-up
assistance as required. The Department has 23 sworn personnel and 25
reserves.. Minimum staffing is three sworn personnel operating out of the
police station at blason and Standley. The Police Chiefstates projected
increased population necessitates an additional officer. In light of the .'

fact though that the area does not comprise an additional beat,
additional personnel are not necessa~'v. For fiscal analysis
purposes though 1/3 of a police officer is included.

E. Conditions to be inposed by City: Any development that would occur
would require review bY the Police Department' to insure appropriate
street signage for traffic control, street layout for emergency access
and public area design to ensure appropriate security and patrolling
opportunities. .
F. How financed: City General Fund revenues
UTILITIES
ELECTRIC
A. Service to be extended' Electricity

B. Level and range of service' Currently the area is provided with
electrical energy through the facilities of P.G.&E. The City of Ukiah
has its own electric distribution system. Electric facilities woUld be
initially constructed by the developer with a payback system on a
developed lot basis. Currently the City has the capacity to accommodate
additional loads in this area and revenues anticipated through user fees
would pay for the Capital Improvements and any required maintenance and
operation of this system on an annual basis. The City provides the s~ne
levels and range of service as provided by P.G.&E., meeting demands
ranging from minimum voltage and amperage in residential units to large
loads in high density residential and heavy commercial uses.
Regarding the capacity of the distribution system, the Electric Department
has indicated that load created by this development would be approximately
240 ~V (120 x 2~V = 240~). The present peak demand is approximately
22,500 ~Vwith P.G.&E's capacity of supply to us of. 25,90.0 ~V. The City
is presently working with P.G.E. to provide additional capacity which
within six months will allow up to 40,000 ~V capacity in the City.
C. l~nen available: Immediately
D. Improvements required· As noted, as development occurs, particular
· mprovements would be required to be completed by the developer. In
light of the fact that there is no large scale existing facilities, specific
improvements would not be nbcessary immediately other than City purchase
of the P.G.&E. facilities within the area.
E. Conditions to be imposed by the City: Specific conditions would be
~"~osed by the City at time of development and include undergrounding
and construction/placement of capital improvements at that time.

F. tlow financed: Initial Capital Improvements would be financed through
aeveloper fees and deposits with ongoing operation and maintenance
covered by user fees. Electric service fees also generate income to
the City General Fund over and above expenses for that enterprise.
SEWERAGE
A. Service to be extended' Sewage collection and disposal.
B. Level and range of service: The area is currently within the Ukiah
Valley Saniiation District and property taxes have been paid to that
district for utilization of the existing treatment plant. There would
be no change in the status of the responsible agency upon annexation
as the district would retain their jurisdiction with current tax and
user fee charges. Extension of service would occur with residential
development.
C. l~hen available' Immediately
D. Improvements required' Itookmps to trunk sewer lines would be required
upon development at the expense of the developer. No immediate
improvements are necessary.
E. Conditions to be imposed by the City' Upon development, hookups to
the trunk- sewer line related to any type of urban development would
be required at a developer's expense. -Extension of sewer trunk would
be placed by developer.
F. How financed' Property tax levies and user fee charges on a monthly
basis would sustain operation at current levels.
A. Service to be extended' Water for domestic and fire prevention uses.
B. Level and range of sepzice' At the present time there are some water
capital inprovements within the annexation boundaries; with individual
wells also providing water. Trunk service extends through Orr Street
north of the annexation area. ~Existing wells could be retained until
new development of the i~dividual properties took place. All new develop-
ment will hook to City of Uki~ water.
C. When available' Immediately
D. Improvements Required: All facilities associated with development
would be required 0t' a develoPer. No improvements are necessary at
the present.
£. Conditions to be imposed by the City: As development occurs, water
facilities,for both. domestic and fire flows would be required of a
developer. This would include extension of mains to existing mains
within the area and payment of C~)ital Improvement fees.
F. How financed: Initial construction of capital improvements would be
required at the cost of the developer. On-going nmintenance and

operation of the system would be pai~;3 from the monthly user fees and
service charges. These fees also generate revenue to the City of
Ukiah General Fund.
SOLID WASTE
A. Service to be extended: Solid waste collection and disposal.
B. Level and range of service: Current service in the county is based upon
individual property owner discretion. Within the City, solid waste
service is provided through contract with priw~te companies. '['his
franchise agreement would be extended to provide s~ne level as existing,
i.e. one weekly pick~ of 30 gallo~ can, plus. ~laterial is deposited
at City of Ukiah Sanitary Disposal bite which has satisfactory capacity
for entire valley population through the year 2000.
C. When available: Immediately
D. Improvements required' None
E. Conditions to be imposed by the City: Collection by franchised company
i's"requ'ired within' City limits.
F. llow financed: User fees/service charges. No cost to City because of
'franchise with private agency.
GENERAL GO~q~I(X2.1ENT
A. Service to be extended: General administrative and miscellaneous
services.
B. Level and range of service: The area is currently served by the
County of blendocino in the functions of administration and public
works. The City is a full service municipality, which in addition
to providing the specific services discussed above, encompasses the
functions of City Manager, City Attorney, City Clerk, City Council,
Treasurer, Personnel, Finance (including Purchasing and l~arehousing),
Community Development (including Planning Conmission, Planning and
Building), Parks and Recreation, and Public ~Vorks operating street
maintenance and engineering, weed abatement, municipal garage and
corporation yard. The a~mexation and proposed development could be
serviced at existing service levels with existing staff. ~iinimal
increased costs would result in the areas of weed abatement, elections
and street maintenance.
C. When available: Immediately
D. Improvements required,: None
E- Conditions to be imposed by the City: Applicable building codes as
adopted by the City Council a'hd the Board of Supervisors would be
imposed and staS~dard requirements pursuant to existing City policies
for streets and related development would be stipulated.

FINANCING
As noted previously, other than user fees for water, electricity, sewerage
and solid waste disposal.~urban services would be financed through the City
of Ukiah General Fund. Major annual revenues include property tax, per capita
subventions from the State and Federal revenue sharing. One time revenues
include building permits, subdivision fees and parks and recreation in-lieu
fees.
Noted here are approximate costs and revenues for the two alternatives.
Alternative one, townhouse/apartments is based u~on a total of 120 units,
(64 tOwnhouse/56 apartments) average'per unit value of $40,000 (townhouses)
and $20,000 (apartments), projected population of 360 f3 per unit) and one-
third of a mile of streets. Alternative No. 2, all towrd~ouses, is based
upon a total of 108 units, average per unit value of $42,000, projected
population of 324 and one-third of a mile of streets.
Park and Recreation costs and fees are not tabulated because of the uncertainty
as to whether park land with/without maintenance or in-lieu fees would be
associated with development.
It must be reiterated that these calculations reflect development of 90% of the
area in residential uses at a density of approximately 10 dwelling units per
net acre as prescribed in the "?D" prezone being processed by the City of Ukiah.

The tabulations here indicate a net annual revenue to the City. Thus services for
this development are paid by the development itself. One time revenue from
building permits and subdivision fees exceeds $26,000 for Alternate No 1 or

Planned Development to reflect anticipated development.

should pay for required services. Greater contrOl by City.

-Existing service within City service levels should remain the same as current.
3. Mutual, social and economic interests- Will decrease County fiscal responsibilities,
increase City's and reversed revenues. SOcial interests are unaffected as social
issues don't react to City boundaries.

Would increase City of Ukiah by eight acres+, no major impact on County function.

If so, what are the results? Yes. The only residents in the area have indicated
support of the annexation.

Development will occur under private developer. '
