HomeMy WebLinkAbout79-57RESOLUTION 7 9 - 5 7 1 4 6 8 9 10 11 12 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH ORDERING 7~NNEXATION OF TERRITORY KNOWN AS ORCHARD AVEI'~JE SOUTH I.~HEREAS, Government Code Section 35229 stipulates that a conducting authority order territory armexed if written protests by owners of less than 50% of the total assessed value of land and improvements within the territory are received, and Iq}flEREAS, pursuant to Government Code Section 35225 and City Council Resolution No. 79-4.4, a public hearing was held on February 7, 1979 by the City Council as the conducting authority, and WHEREAS, at that public hearing two verbal protests, one verifying a written protest were filed, and I~REAS, according to the last equalized assessment roll of the Mendocino County Assessor, the protest filled by Mr. Otis Hurt is not valid in that the 14 15 16 17 18 19 20 property owner of Parcel No. 180-030-11 is indicated to be the State of California, and WHEREAS, the protest of the F.A. Salisbury property, Assessor Parcel No. 180-030-10, $4,870 assessed valuation, which constitutes less than 8% of the total assessed valuation, and i~EREAS, the territory proposed to be annexed was declared uninhabited by the Mendocino County Local Agency Formation Commission, and ~REAS, the subject territory encompasses approximately 29 acres bounded 21 on the east by the U.S. 101 Freeway, on the south by Doolin Creek, on the west ~ by existing City boundaries and the north by Gobbi Street, and 23 24 25 26 27 28 29 $0 31 82 I'~RFAS, that subject annexation was approved on December 6, 1978 by order of the Mendocino County Local Agency Formation Con,mission with the conditions that the City of Ukiah adopt an ordinance prezoning the affected territory and that the affected territory be simultaneously detached from the Ukiah Valley Fire Protection District, and MflEREAS, on January 6, 1979, Ordinance No. 722 prezoning subject territory to PD, Planned Development became effective having been adopted by the City Council on December 6, 1978, and M4ERFAS, the application to the I,ocal Agency Formation Commission for detacIm~ent of the territory from the Ukiah Valley Fire Protection District was ORCHARD AVE. NOW THEREFORE BE IT RESOLVED; a) the City Council finds the protests by property owners within the affected territory represent less than 50% of the total assessed valuation of the territory involved, and b) the City Council orders the territory known as Orchard Avenue South and depicted on Exhibit A attached, to be annexed to the City of Ukiah c) the City Clerk be directed to forward a certified copy of this resolution to the Executive Officer of the Local Agency Formation Commission for certification, d) the effective date of this annexation shall be that date upon which the Local Agency Formation Commission Executive Officer's Certificate of Completion is recorded by the County Recorder.
