HomeMy WebLinkAbout79-45N~SOLUTION NO .7_9_.__ _ 45 1 2 4 6 '7 8 9 10 11 12 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 RESOLLrFION OF THE CITY COUNCIL OF T}Z CITY OF IJKIAH INITIATING ANNEXATION PROCEEDINGS FOR rlltE VINEYARD VIEW/LAS CASAS ANNEXATION I~{ERFAS, Government Code Section 35201 requires that a conducting authority adopt a resolution initiating annexation proceedings after formal action by the Local Agency Forn~tion Commission on any proposed annexation, and !~tEREAS, Government Code Section 35220 stipulates the contents of such resolution, and ~ZREAS, the }4endocino County Local Agency Formation Commission on November 20, 1978 adopted Resolution No. 78-4. approvingAnnexation No. 78-5 Vineyard View/Las Casas and the Ci'ty of Ukiah has received a certified copy of said resolution mailed by the Executive Director designating the City as the conducting authority, NOW THEREFORE BE IT RESOLVED: a) The City of Ukiah on October 4, 1978 commenced preliminaryproceedings for subject annexation by adopting Resolution No. 79-24, a resolution of KDplication to the Local Agency Formation Commission including a plan for providing services; and b) The short term designation of this annexation is Vineyard View/ Las Casas annexation to the City of Ukiah, bounded on the east by existing commercial development, Empire Gardens and Frank Zeek Elementary School, on the south by Low Gap Road, on the west by Despina Drive and Vineyard View, Unit I and on the north by Alexander Estates; and c) The territory proposed to be annexed is uninhabited as detemined by the Local Agency Formation Commission in its Resolution No. 78-4, making determinations; and d) The reason for the proposed annexation is to include appropriate territory within the City of Ukiah for provi, sion of ~rba.n services to any pending development; and e) Resolution No. 78-4 of the b~ndocino County Local Agency Formation Commission stipulates that the annexation include: 1. That the affected territory not be detached from Hillview County !~ater District, and 2. Tlmt affected territory be simultaneously detached from the Ukiah Valley Fire Protection District, and 1 2 4 6 ? 8 9 10 11 12 14 16 17 18 19 20 21 22 23 24 25 26 27 28 29 ~0 31 32 f) February 7, 1979, 8:45 P.M., is the date and time set for a public hearing by the City Council to consider the annexation and receive any protests against it; and g) The City Clerk is directed to notice said hearing pursuant to Government Code Section 35222, inlcuding published notice in the newspaper, posted notice on the property and mailed notice to all property owners within the subject territory and within 300 feet of the annexation boundaries, no later than 10 days prior to the hearing date; and h) Since the territory to be annexed is declared uninhabited, any owner of land within the territory may file a written protest against the annexation with the City Clerk prior to the conclusion of the City Council hearing regarding Annexation No. 78-5, Vineyard View/Las Casas. PASSED AND ADOPTED this 3rd day of January, 1979 by the following roll call vote: AYES: Councilmembers Hickey, Myers, Simpson, Snyder, Mayor Brannon NOES: None ABSENT: None ATTEST' City -Clerk'~
