HomeMy WebLinkAbout79-44 ! 2 3 4 6 ? 8 10 11 12 14 16 17 18 19 20 21 22 23 24 25 26 2'/ 28 29 30 31 32 RESOLIfFION NO. 79-44 RESOLUI'ION OF THE CITY COUNCIL OF THE CITY OF UKIAIt INITIATING A~.~xFEXATION PROCEEDINGS FOR THE ORC~IAPd) AVENI~ - SOUTtt ANNEXATION -- WHERFAS, Government Code Section 35201 requires that a conducting authority adopt a resolution initiating annexation proceedings after formal action by the Local Agency Formation Commission on any proposed annexation,and ¢~tEREAS, Government Code Section 35220 stipulates the contents of such resolution, and I.~[EREAS, the Mendocino County Local Agency Formation Commission on December 4, 1978 adopted Resolution No.78-5 approving Annexation No. 78-6, for Orchard Avenue - South and the City of [fk]ah has received a certified copy of said resolution mailed by the Executive Director des i. gnating the City as the conducting authority, NOW TtiEREFORE BE IT RESOLVED' a) The City of Ukiah on October 4, 1978 commenced preliminary proceedings for subject annexation by adopting Resolution No. 79-23, a resolution of application to the Local Agency Formation Commission including a plan for providing services; and b) The short term desigmation of this annexation is Orchard Avenue South, annexation to the City of Ukiah bounded on the east by State Highway 101, on the south by Doolin Creek, on the west by existing City boundaries and on the north by Gobbi Street; and c) The territory proposed to be annexed is uninhabited as detemined by the Local Agency Formation Commission in its Resolution No. 78-5, making determinations; and d) The reason for the proposed annexation is to include appropriate land within the City of Ukiah for provision of ~rban services to any pending development; and e) Resolution No. 78-5 of the Mendocino County Local Agency Formation Con~dssion stipulates that the annexation include: 1. The City of bq<iah must adopt an ordinance prezoning the affected territory, and 2. That affected territory be simultaneously detached from the Ukiah Valley Fire Protection District; and 1 3 4 ? 8 9 10 11 13 14 16 17 19 20 f) February 7, 1979, 8:00 P.M., is the date and time set for a public hearing by the City Council to consider the annexation and receive any protests against it; and g) The City Clerk is directed to notice said hearing pursuant to Government Code Section 35222, including published notice in the newspaper, posted notice on the property and mailed notice to all property owners within the subject territory and within 300 feet of the annexation boundaries, no later than 10 days prior to the hearing date; and h) Since the territory to be annexed is declared uninhabited, any owner of land within the territory may file a written protest against the annexation with the City Clerk prior to the conclusion of the City Council hearing regarding Annexation No. 78-6.
