Burris The City Council of the City of Ukiah does hereby RESOLVE: An application for variance having been duly presented and filed, the Planning Commission of the City of Ukiah having duly held a public hearing, taken evidence, and made and filed its recommendations, and the City Council of the City of Ukiah, having duly considered the recommendations of the Planning Commission; The City Council hereby finds that the proposed variance is in harmony with the general purpose of the Zoning Ordinance o.f the City of Ukiah and meets the conditions thereof; and Does hereby grant Variance No. 79-42 to: F.A. Burris to permit: a variance from the rear yard setback rea~rement in an R-1 zone · L on a parcel located at 415 Oak Park in order to construct pool facilities enclosure and restroom/changing room. all subject to the following conSitions: Standard Conditions 1-9 1. City of Ukiah to be assured permanent access for maintenance of utility poles and an agreement be reached between the Applicant and the City Attorney assuring the City not to be held liable for any damages incurred relative to structures located within the easement area. If any condition set forth above is violated, or if any required approval is not obtained, then this variance shall be null and void, otherwise to continue in full force and effect indefinitely and to run with the land. This variance is granted only for the specific purposes set forth above, and shall not be construed as eliminating or modifying any building, use or zone requirements except as to such specific purposes. All use, construction or occupancy shall conform to the application and to any supporting docu]nents submitted therewith. 2. Any construction, and the location thereof, shall conform to any maps, sketches or plot plans accompanying the application or submitted by app]~icant in' support thereof. 3.' Any construction shall comply with the "Standard Specifications" for such type of construction now existing or which may hereafter be promulgated by the Engineering Department of the City of Ukiah; except where higher standard~ are imposed by law, rule or regulation or ]Dy action of the Planning Commission such standards shall be met. 4. In addition to any particular condition which might be imposed, any construction shall comply with all building, fire, electric, plumbing, occupancy and structural laws, rules, regulations and ordinances. 5. Applicant shall be required to obtain any approval which is required by law, regulation or ordinance. 6. Ali_ required building permits shall be issued within months after the effective date of the Use Perm.it, VarianCe or Architectural Rc-~view or same shall be null and void. 7. If any use permitted shall cease for six (6) consecutive months then the.right to any variance or.use permit permitting such use shall terminate and such variance or use permit shall be revocable by the granting body. 8. If any condition, special or standard, is violated, or if any required approval is not obtained, then the variance or use permit granted shall be null and void; otherwise to continue in full force and effect indefinitely until otherwise terminated and shall run with the land. 9. Except as otherwise specifically noted, any variance or use permit shall be granted only for the specific purposes stated in the action approving, and shall not be construed as eliminating or modifying any building, use or zone requirements except as to such specific purposes.
