HomeMy WebLinkAbout79-35 1 2 6 8 9 10 11 12 13 15 16 17 18 19 2O 21 22 23 25 26 27 29 $0 $1 ~2 RESOLUTION NO. 79-35 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH AUTHORIZING AGREEMENTS BETWEEN THE POLICE DEPARTMENT OF THE CITY OF UKIAH AND THE STATE OF CALIFORNIA DEPARTMENT OF CALIFORNIA HIGHWAY PATROL WHEREAS, the State of California, Department of California Highway Patrol requires written training agreements from any agency participating in training programs at the Academy; and WHEREAS, the Police Department of the City of Ukiah desires from time to time to participate in certain training programs sponsored and administered by the Department of California Highway Patrol, NOW, THEREFORE, be it resolved by the Ukiah City Council that the Deputy Chief of Police is hereby authorized and directed to sign such training agreements. PASSED AND ADOPTED by the City Council of the City of Ukiah at a meeting this 1st day of November , 1978, by the following roll call vote: AYES: Counci!members Hickey, Myers, Simpson, Snyder, Mayor Brann NOES: None None ABSENT: ATTEST: M~yor City Clerk TRAINING AGREEMENT THIS AGREEMENT, made and entered into this twelfth day of October , 1978, by and between the State of California, acting by and through the Department of California Highway Patrol, hereinafter called CHI), and the City of i Ukiah hereinafter called the City P.D. WITNESSETH, by and in consideration of the covenants and ยท conditions herein contained, the CHI) and The City P.D. do hereby agree as follows: 1. CH]? agrees to allow City P.D. to attend training classes during the period(s) as follows: Agreement for Traffic Accident Investigation Classes 2 - trainees 12/11-15 2 - trainees 12/18-22 2. CH1) agrees to provide living, dining, and classroom facilities as required. 3. As consideration for the use of the Academy facilities, agrees to pay CHI) upon receipt of an invoice in accordance with the-following: Per resident student ...... $ Per non-resident student .... $ Instruction fee ........ $ 25.00 ~er day N/A per day N/A per 8 hour day TOTAL not to exceed ....... $ 500.00 4. The rates indicated in this agreement are for estimate purposes only. In.the event CHI) is granted a rate increase, agrees to pay CHi) at said increased rates. 5. The rates indicated in this agreement are for estimate purposes only. In the event State is granted a rate increase effective July l, 1978, City .P.D. agrees to pay State at said increased rates. 6. City P.D. agrees to indemnify, defend, and save harm- less CHI), its officers, agents, and employees from any and all claims and losses accruing or resulting to any person, firm, or corporation who may be injured or damaged by the City P.D. in the performance of this agreement. 7. City P.D. shall, be responsible for paying any cost in- curred by CHP for facility damage caused by the willful or malicious misconduct of City P.D. trainees. 8. This agreement shall become effective when signed by both parties, and upon CHP's receipt of a resolution covering the agreement. Training shall not be authorized until the resolution is on file with CKP. 9. This agreement may be amended by mutual consent of the parties hereto. 10. Notices and communications hereunder shall be sent to the addresses appearing below the signatures.
