HomeMy WebLinkAbout79-23 - Orchard Ave. South Annexation 1 2 3 4 6 ? 8 9 10 11 12 13 14 16 17 18 19 20 21 22 23 24 2~ 26 27 28 29 30 31 32 RESOLLrFION NO. 7 9- 2 3 RESOLUTION OF THE CITY COUNCIL OF T[E CITY OF UKIAH MAKING APPLICATION TO THE MENDOCINO COUNI'Y LOCAL AGENCY FORMATION COMHISSION FOR THE ORCHARD AVENUE - SOUTH ANNEXATION I~{EREAS, Government Code Section 35140 requires a resolution of application to the Local Agency Formation Commission for proposed annexation to an existing city and, WHERFAS, Government Code Section 35110 specifies the contents of such resolution and, WHE ~REAS, the City of Ukiah has been requested by property owners to annex certain properties to the City, NOW THt:,REF()RE BE IT Pd'iSOLVEI): 1. The City of Ukiah proposes to annex the area known as "Orchard Avenue-South" to the City, and 2. This proposal is made pursuant to Part 2 of Division 2 of Title 4 of the Government Code titled "~'~nicipal Organization Act of 1977", and 3. The proposed "Orchard Avenue-South" annexation encompasses 30 acres bounded on the north by Gobbi Street, on the east by the east right-of-way line of the US 10]. freeway, on the south by Doolin Creek and on the west by existing City boundaries as illustrated by Exhibit A (map) and Exhibit B (legal description), 4. The City of Ukiah proposes to provide the appropriate urban services to the subject area as specified i.n Exhibit C (plan for services) ~ich has been prepared pursuant to Government Code Section 35102, and 5. This proposal is made because, due to the nature of probable development and the resulting demand for municipal services, the area should ~propriately be within the jurisdiction of the City of Ukiah, rather than part of the unincorporated area served by the County of Mendocino and, 6. The City of Ukiab requests that proceedings be initiated by the Mendocino County Local Agency Formation Commission pursuant to Government Code Section 35000 et.seq, for annexation of the subject area and, 7. EXHIBIT C PROVISION OF URBAN SERVICES WI]IIIN T~2 ORCI-[~RD AVI]NUE-SO[rFII TERRITORY Pursuant to Section 35102 of the State of California Government Code, a plan for the provision of urban services to a newly armexed area must accompany an application for annexation. This plan is prepared in conjunction with the annexation application to the ~endocino County Local Agency Formation Commission for the 30 acres encompassed by the Orchard Avenue-South annexation to the City of Ukiah. Existing land uses within the area are; residential, freeway and open vacant land. There are six residential, units in the area and approximately seven acres owned by the State for the 101 freeway. Approximately 11 acres of the vacant land are proposed for duplex and apartment uses with no specific plans for the remaining vacant property. Existing services to the area are p~ovided by the County of b~ndocino in the functions of Administrative, Public Works and Sheriff. Electricity is provided by P.G.&E. Sewerage is provided by the Ukiah Valley Sanitation District. Fire prevention and protection is provided through the UkiM~ Valley Fire Protection District, a special district on contract with the City of Ukiah. Telephone, gas and cable television are currently -supplied and would continue to be provided by Pacific Telephone and Telegraph, P.G.&E..and Teleprompter respectively. Solid waste is on an individual property oxmer basis. Water is provided by individual wells. The proposal is annexation to the City of Ukiah which is a full service municipality. In. addition to general a&ninistrative activities, the City of U~iah provides police and fire services, its ~.m water production and distribution system, its own electric distribution system, a sewage treatment plant and public works services including street maintenance and capital improven~nts. Solid waste disposal is through City franchise with private hauling companies. In general, the proposed services to be provided to the annexation area would be those currently existing in the City of Ukiah which are enumerated in detail below. The level and range of these services Would be the same as currently provided. Increased development would not cause a decrease in the levels of service to either existing City residents or the new area. The services can feasibly be extended to the affected territory immediately, as presently the City abuts the proCerties on the west and north. No specific improvements to structures, roads, sewer or water facilities are proposed without specific development taking place. Current City policies require developers to participate in any improvements for urban uses; conditions imposed by the City would be those of normal development considerations. The services to be provided would be financed through the 'existing City revenue structure which includes property taxation, reimbursement from the State and Federal goverm~ents under various in-lieu and per capita fees and revenue sharing progr~uns. Also user fees for electric, water, sewer, and solid waste will be charged and thus provide revenues for these services. Services-Orchard Avem Page 2 - South Annexation Presented here is documentation related to the specific services which would be provided to the annexed area. SERVICES PUBLIC SAFETY FIRE A. Service to be extended: Fire protection and prevention. B. Level and range of service: The area is currently served by the Ukikh Valley Fire Protection District whose services are provided under contract by the City of Ukiah. The department is staffed by 16 full time firefighters with 22 volunteers. ~h. nimum manning is four firefighters operating out of two stations located at Clay and School Streets in downtown Ukiah and Lover's Lane and North State Street, immediately north of the Freeway/State Street interchange. The level and range of service would remain as currently exists. C. When available: Immediately D. Improvements required: None E. Conditions to be imposed by City: Fire hydrartts will be required as development occurs to the specifications of the Fire ~rshall and placed by the developer. Compliance with applicable fire codes x~l~ be required through building'permit review as currently exists in both City and County. F. How financed: City General Fund revenues. POLICE A. Service to be extended: Police protection and assistance. B.' Level and range of service: The area is currently served by the Mendocino County Sheriff with the City of Ukiah Police Department providing back-up assistance as required. The Department has 23 sworn personnel and 25 reserves. Minimum staffing is three sworn personnel operating out of the police station at b~son and Standley. No additional personnel is necessary. C. When available: Immediately D. ~Improv,ements required: None E. Conditions to be in~osed by City: Any development that would occur would require review by the Police Department to insure appropriate street signage for traffic control. Street layout for emergency access and public area design to ensure appropriate security and patrolling opportunities will be reviewed. Services-Orchard Avem,~e - South Annexati.on Page 3 F. tlow Financed: City General Fund revenues. UTILITIES ELECTRIC A. Se~ice to be extended: Electricity B. Level and range'of service: Currently the area is provided with electrical energy through the facilities of P.G.&E. The City of Ukiah has its own electric distribution system. Electric facilities would be initially constructed by the developer with a payback system on a developed lot basis. Currently the City has the capacity to accommodate additional loads in this area and revenues anticipated through user fees would pay for the Capital Improvements and any required maintenance and operation of this system on an annual, basis. The City provides the same levels and range of service as provided by P.G.&E., meeting demands ranging from minimum voltage and mnperage in residential units to large loads in high density residential and extreme commercial uses. C. When available: Immediately D. Improvements required: As noted, as development occurs, particular improvements would be required to be completed by the developer. In light of the fact that there is no large scale existing facilities, specific improvements would not be necessary immediately other than City purchase of the P.G.&E. facilities within the area. E. Conditions to be imposed by the City: Specific conditions would be imposed by the City at time of development and include undergrounding and construction/placement of capital improvements at that time. F. flow financed: Initial Capital In~rovements would 1)e financed through ffe~oper fees and deposits with ongoing operation and maintenance covered by user fees. Electric service fees also generate income to the City General Fund over and above expenses for that enterprise. SEWERAGE A. Service to be extended: Sewage collection and disposal. B. Level and range of service: The area is currently within the Ukiah Valley Sanitation District and property taxes have been paid to that district for utilization of the existing treatment ¢lant. There would be no change in the status of the responsible agency upon annexation as the district would retain their jurisdic- tion with current tax and user fee charges. Extension of service would occur with residential development. C. lqhen available: Immediately D. Improvements required: Itookups to trunk sewer lines would be required upon d~velopment at the expense of the developer. Conditions to be imposed by the City: Upon development, hook~ps to the trunk sewer line re lated to any type of urban development would be required at a developer's expense. Extension of sewer trunk would be placed by developer. F. How Financed: Property tax levies and user fee charges on a monthly basis ~uld sustain operation at current levels. WATER A. Service to be extend4d' Water for domestic and fire prevention uses. B. Level and range of service: At the present time there are no water capital improvements within the annexation boundaries; indivi&ml wells provide water. The City provides water on two sides of the proposed annexation. Existing wells could be reta[ned tmtil new development of the individual properties took place. However, upgrading of the water service through the City of Ukiah system is appropriate because of the greater capacity of the City of UkiM~ to service this area. The major portiom of the City's fire rating is based on the capacity of the water system. Therefore, fire insurance rates could be. expected to be lower if the area were serviced by the City. C. When available: Immediately D. Improvements Required: All facilities associated with development ~ould be' required of a developer. No improvements are necessary at the present. E. Conditions to be imposed by the Cit~.: As development occurs, water facilities for both domestic and fire flows would be required of a developer. This would include extension of mains to existing mains within the City boundaries and payment of Capital Improvement fees. F. How financed: Initial construction of capita], improvements would be required at the cost of the developer. On-going maintenance and operation of the system would be paid from the monthly user fees and service charges. These fees also generate revenue to the City of t~iah General ~nd. SOLID WA.S'I'Ii A. Service to be extended: Solid waste collection and disposal. B. Level and range of service: Current service in County is based upon individual property owner discretion. Within the City, solid waste service is provided through contract with private a~encies. This franchise agreement would be extended to provide same level as existing, i.e. one weekly pickup of 30 gallon can, plus. ~terial is deposited at City of Ukiah Sanitary Disposal Site ~]ich has satisfactory capacity for entire valley population through the year 2000. Conditions to be imposed by the City: Collection by franchised company is required within City limits. F. How financed: User fees/service charges. No cost to City because of franchise with private agency. GENERAL GOVt:,RNMI~h',,rl' A. Service to be extended: General administrative and miscellaneous services. B. Level and range of service: The area is currently served by the County of Mendocino in the areas of administration and public works. The City is a full service municipality, which in addition to providing the specific services discussed above, encompasses the functions of City Manager, City Attorney, City Clerk, City Council, Treasurer, Personnel, Finance including Purcha$~ngand Warehousing, Community Development including Planning C~m,~ssion, Planning and Building, Parks and Recreation, and Public Works ~perat]ng street maintenance and engineering, weed abatement, municipal garage and corporation yard. The annexation and proposed development could be serviced at existing service levels. Minimal increased costs would result in the areas of weed abatement, elections and street maintenance. C. When available: Immediately D. Improvements required: None E. Conditions to be imposed by the City: Applicable building codes as adopted by the City Council and the Board o£ Supervisors would be imposed and standard requirements pursuant to existing City policies for streets and related development would be stipulated. F. How financed: City General Revenue Funds. FINANCING As noted previously, other than user fees for water, electricity, sewerage and solid waste disposal, urban services would be financed through the City of Ukiah General Fund. Annual revenues include property tax, per capita subventions from the State and Federal revenue sharing. One time revenues are not projected because of the undetermined nature of any proposed development. Noted here are approximate costs and revenues based upon the annum plan designation of residential at a maximum density of 6 units per acre. (The comprehensive ~eneral vlan amendment may result in a higher density classification although it has not been reviewed much less adopted) A net area of 17.25 acres would be available for development. Thus a total of 104 units, population of 312 and street length of approximately one mile could be anticipated. Projected unit values are $50,000. Level of service would be as now exists, financing would be through user fees and service charges and general governmental revenues as currently exist.
