GERBER The City Council of the City of Ukiah does hereby RESOLVE: An application for variance having been duly presented and the Planning Commission of the City of Ukiah having duly held a hearing, taken evidence,~ and made and fi led its recommendations, the City Council of the City of Ukiah~, having duly considered the mendations of' the Planning Commission; The City Council hereby mony wi th the general purpose Ukiah and meets the conditions fi led, public and recom- finds that the proposed variance is in har- of the Zoning Ordinance of the City of thereof; and Does hereby grant Variance No,, 6~-12 to: ROBERT F. GERBER to permit: construction of a shopping center in a CH zone south of and as a continuation of the Purl ty Shopp.!.n~ Center at 737 So. State Street. all subject to the following conditions; 1 &) This variance shall be put into effect by completion of construction, if any, within one (I) year from the date of 9ranting hereof, if the use permitted shall cease for six (6) consecutive months then this variance shall automatically terminate. 2) The shopping center shall be limited to retail stores. 3) Drainage from the area proposed to be improved must be adequately con- ducted to a sui table storm drain or drainage channel. Plans for and construction of drainage facilities must meet the approval of the City Engi neet. L,,.) Extension of and relocation of existing utilities to service the develop- ment and adjacent areas must conform to the requirements of the City Engineer. 5) That parking area be provided in the ratio oi: three (3) square feet of parking area for each one (1) square foot of building area in the shopping center. If any condition set forth above is violated, or if any requi red approval is not obtained, then this variance shall be null and void, other- wise to continue in full force a~d effect indefinitely and to run with the land. This variance is granted only for the specific purposes set forth above, and sha]l not be const~jed as eliminating or modifying any building, use or zone requirements except as to such specific purposes.
