HomeMy WebLinkAbout65-42RESOLUTION NO. 65-42 RESOLUTION FIXING DATE ON WHICH BIDS FOR THE SALE OF THE MUNICIPAL PROPANE GAS SYSTEM WILL BE RECEIVED; THE MANNER OF FILING BI DS, AND PROVIDING FOR NOTICE OF SUCH SALE. _(Sec. 10057 Public Utilities Code) The City Council of the City of Ukiah does hereby RESOLVE: That a Special Municipal Election was duly held on Tuesday, February 2, 1965, in the City of Ukiah, at which election the proposition of selling the public utility described in Ordinance No. 565, to-wit the municipal propane gas system, was duly approved and the sale authorized by in excess of two- thirds of all voters voting in said election; That pursuant to Section 10057 of the Public Utilities c._~..~ of California the City Council hereby fixes Wednesday, February 24, 1965 at 8:00 o'clock P.M., or as soon thereafter as the same may be heard, in the Council Chambers, City Hall, 203 South School Street, Ukiah, California as th'e time and place at which bids for the sale of the municipal propane gas system will be opened. Bi ds shall be in writing and shall specify the amount offered for such system and any terms and conditions proposed, or in lieu thereof may refer to any formal offer previously pre- sented to the Council. Bidders shall be prepared to furnish at the time bids are opened cash, cashier's check or certified check in 100% of the amount bid and failure or inability to so furnish such amount when requested by the Council shall disqualify a bidder. Bi ds shall be sealed in an envelope plainly marked "GAS II SYSTEM BID, and may be fi led wi th the City Clerk at any time prior to the time fixed for opening bids. The Council reserves the right to determine the adequacy of all bi ds, and may reject a!l. bids or' rr~y sel! the municipal propane gas system to the highest ar'~d b~t bidd~r therefor as the Council may determine the same to be. In addition to complying with the terms of his offer, the bidder to whom award, if any, is made shall be required to promise to continue to operate the public utility and shall obtain from the City of Ukiah a franchise to operate such public utility. If a bid is accepted, the City Council proposes to authorize by resolution its Mayor and Clerk to execute, a~know- ledge and deliver to the successful bidder on behalf of the City of Ukiah, a deed conveying to the successful bidder all of the City's right, title and interest in said municipal propane gas system upon receiving from him in cash the full amount of the bid and his promise to continue to operate said public utility. The Clerk is hereby directed to cause to be published o~ce a week for two successive weeks in the Ukiah Daily Journal, a newspaper of general circulation published less than six days a week in the City of Ukiah, a notice of sale in substantially the following form: "NOTICE OF SALE OF MUNICIPAL PROPANE GAS SYSTEM. NOTICE IS HEREBY GIVEN that the City Council of Uk|ah will receive bids for the sale of its municipal propane gas system, bids to be opened Wednesday, February 24, 1965 in the Council Chambers, City Hall, Ukiah at 8:00 P.M. Reference is made to Resolution No. 65-42 of said City for further particulars. Dated: February 9, 1965.
