HomeMy WebLinkAbout65-23RESOLUTION NO. 65- 23 RESOLUTION DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY THE COUNCIL OF THE CITY OF UKIAH TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED "ANNEXATION NO. 65-1," AND GIVING NOTICE OF THE PROPOSED ANNEXATION BE IT RESOLVED BY THE COUNCIL OF THE CITY OF UKIAH: 1. That, pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, proceedings have been initiated by the Council of the City of Ukiah, on its own motion, to annex to the City of Ukiah all that uninhabited territory situate in the County of Mendocino, State of California, hereby designated as "Annexation No. 65-1" and described as follows: Beginning at a point on the present City Limits line, said point being on the South line of East Gobbi Street (aka River Road) 15.0 feet more or less West of the southerly projection of the East line of Orchard Avenue, said point also being the Northwest corner of that certain parcel conveyed by F. A. Salisbury et ux to City of Ukiah, a Municipal Corpora- tion, by deed dated April 16, 1956, and filed in the office of the County Recorder, County of Mendocino in Book 429 at Page 392 of Official Records; thence from said point of beginning, and leaving said City Limits South 09° 15' East 140.0 feet; thence North 82° 25' East 144.01 feet to a P.O.C. on the Westerly line of the Ukiah Freeway Bypass; thence from a tangent bearing South 06° 41' 15" East along a curve to. the left having ,a radius of 213.0 feet through an an~le o,f 50° 44' 42"a distance of 188.64 feet; thence South 59 42 46" East 193.,32 feet; thence on a curve to the right having a radius of 150.0 feet through an angle of 38° 35' 35" a distance of 107.04 feet; thence South O1° 03' 56" East 83.0 feet; thence North 87° 13' 15" East 193.0 feet to a point on the Easterly line of the heretofore mentioned Freeway Bypass; thence North 0° 56' 10" East 200.36 feet; thence North 03° 37' 56" East 369.12 feet; thence North 77° 44' 12" East 321.52 feet to a point on the heretofore mentioned South line of East Gobbi Street; thence following said South line North 83° 34' 42" East 160.0 feet; thence North 06° 41' 15" West 60.0 feet more or less to a point on the North line of East Gobbi Street, said North line also being the City Limits; thence following said City Limits Westerly to the point of begi nni ng. 2. That the Council of the City of Ukiah desires to annex said uninhabited territory to the City of. Ukiah for the following reasons: The territory is contiguous to the City of Ukiah, and its proposed annexation will contribute to and facilitate the orderly growth and development of both the City and the territory proposed to be annexed; will facilitate and contribute to the proper and or- derly layout, design and construction of streets, gutters, sidewalks, sanitary and storm water sewers and drainage facilities, both within -1- the City and wi thin the territory proposed to be annexed; and will provide and facllitate proper overall planning and zoning of lands, and subdivision of lands In said City and sald uninhabited terri- tory, in a manner most conducive to the welfare of sald City and sa ld uninhablted terrltory. 3. That the County Boundary Commlsslon of Mendoclno County, Callfornla, did in session duly assembled on October 13, 1964, approve the proposed annexation boundaries of said "Annexation No. 65-1" as above described, and as submitted to said Commlssi:~',~ by the Councll of the C~ty of Ukiah, and that on November 2, 1964 the Local Agency Formation Commission did in session duly assembled approve sa~d proposed annexation as submitted by said City Council. 4. That Wednesday, January 6, 1965, at the hour of 8:00 o'clock P.M. or as soon thereafter as the same may be heard, in the Cc. urlc)l Chambers In the City Hall in the City of Ukiah, County is hereby fixed as 'the time and place oF Mendc~clno, Californla, when ~d where any person owning real property wi thin the uninhablted territory above described and proposed to be annexed to the City of L)kiah, and having any objections to the proposed annexation, may appear before the Council of the City of Ukiah.and show cause why such uninhabited territory should not be so annexed to said City of Ukiah, Such protest must be in writlng, may be fi led at any time before the hour set for hearing objections to the proposed annexation, and shall state the name or names of the owner or owners of property affected, and the description and area of such property, in get~eral terms. 5~. The City Clerk of the City of Ukiah is hereby authorized and directed to cause a copy of this resolution to be published at leas'c twice, but not oftener than once a week, in the Ukiah Daily Jour~s), a newspaper of general circulation published in said City of Uklah, the city to which it is proposed to annex the aforesaid territory, and a)so in the Wi)lits News, a newspaper of general circulation p, ublished outside the City of Uk)ah, but i~ the County o~ Mendocino, Ca;iifor~ia, th~: count!/ ir~ which is 'iocated the territory proposed to be annexed to th~ City of Ukiah, said -2- said publication to be complete at least twenty (20) days prior , to the date set for hearing. 6. The City Clerk is further authorized and directed to cause written notice of such proposed annexation to be mai led to each person to whom land within the territory proposed to be annexed is assessed in the last equalized county assessment roll available on the date the above said proceedings were initiated, at the addresses shown on said assessment roll or known to t.he Clerk~ and to any person who has fi led his name and address and the desi~ nation of the lands in which he has an interest, either legal or equitable, with the Clerk, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexati on~ 7. In the event any land within the territory proposed to be annexed is owned by a county, the City 'Clerk is directed to cause written notice of such proposed annexation to be mailed to the Board of Supervisors of the county~ such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexatiOno 8. The City Clerk is di'.rected to cause written notice to be given to such other persons as may be legally entitled thereto, in the manner required by law~ ADOPTED THIS 2nd DAY OF following vote: AYES: NOES: None.
