HomeMy WebLinkAbout65-20RESOLUTION NO. 6~;-20 RESOLUTION DECLARING THE ~NTENT~ON OF THE COUNCIL OF THE C~TY OF UK~AH TO DNDT~ATE ON ITS OWN MOTION PROCEEDINGS TO ANNEX CERTAIN UNDNHAB~TED TERRDTORY BE D T RESOLVED BY THE COUNCDL OF THE C~TY OF UKDAH: lo That the Council of 'the City of Ukiah~ for the reasons hereinafter mentioned, proposes to initiate on its own motion, as soon as it can legally do so, proceedings to annex to the City of Ukiah al I of the terri tory herei halter descri bed, as uninhabited territory, under provisions o'f the Annexation of Uninhabited Territory Act of 1939 as set forth in Sections 35300 to 35325, inclusive, of the Government Code of the State of Ca 1 i fornia. 2. That the Council's reasons For proposing to initiate said annexation proceedings are as follows: The annexation of the hereinafter descri bed terri tory wi 11 contri bute to the orderly growth of the city, provide the proper control of street layout, drainage, sanitary sewer design, and insure the proper use of land in conformity wi th the overall zoning plan of the ci 3. That the terri tory which the Council proposes to annex is hereby identified as "Annexation 65-1 and consists of all that real property situate in the County of Mendocino, State of California, described as roi.lows: Beginning at a point onthe present City Limits line, said point being on the South line of East Gobbi Street (aka River Road) 15.0 feet more or less West of the southerly projection of the East line of Orchard Avenue, said point also being the North- west corner of that certain parcel conveyed by F. A. Salisbury et ux to City of Ukiah, a Municipal Corporation, by deed dated April 16, 1956, and filed in the office of the County Recorder, County of Mendocino in Book 429 at Page 392 of Official Records; thence from said point of beginning, and leaving said City Limits South 09° 15' East 140.0 feet; thence North 82o 25' East 144.01 feet to a P.O.C. on the Westerly line of the Ukiah Freeway Bypass; thence from a tangent bearing South 06° 41' 15" East along a curve to the left having a radius of 213.0 feet through an angle of 50° 44' 42" a distance of 188.64 feet; thence South 59° 42' 46" East 193.32 feet; thence on a curve to the right having a radius of 150.0 feet through an angle of 38° 35' 35" a distance of 107.04 feet; thence South O1o 03' 56" East 83.0 feet; thence North 87° 13' 15" East 193.0 feet to a point on the Easterly line of the heretofore mentioned Freeway oBypass; thence NOrtlh OO 56' 10" East 200.36 feet; thence North 03 37' 56" East 369. 2 feet; thence North 77° 44' 12" East 321 .52 feet to a point on the heretofore mentioned South line of East Gobbi Street; thence following said South line North 83° 34' 42" East 160.0 feet; thence North 06° 41' 15" West 60.0 feet more or less to a point on the North line of East Gobbi Street, said North line also being the City Limits; thence following said City Limits Westerly to the point of beginning. -1- 4. That the City Clerk of the City of Ukiah is hereby directed to file with the Local Agency Formation Commission of the County of Mendocino, State of California, a certified copy of this resolution, together with the statement entitled in "Justification of Proposal for review by Local Agency Formation Commission"~ a copy of Which is attached hereto and incorporated herein by reference, and to request a report by the Local Agency Formation Commission as provided for in Section 54761 of the Government Code° 5. The Clerk is further directed to cause to be fi led wi th the Boundary Commission of the County of Mendocino, State of California, this proposal to initiate proceedings to annex the hereinbefore described uninhabited territory to the City of Ukiah, and to request a report by the said Commission as provided for in Section 35002 of the Government Code. City Clerk' Signed and approved this 3Oth day of September , 1964_~I. -2- Justification of Proposal for review by Local Agency Formation Commission Chapters 5.5 and 6.6 of Fart 1, Division 2, Title 5 of the C-overnment Code charge the Local Agency Formation Commission wit~ responsibility' for the review and evaluation of proposals for the formation of, or anne>'ation to, local agencies. As provided ir, the sectior, s of the code referred to above, the factors to be cor~- sidered by the Commission in reviewing such proposals shall include but not be l i~.ited to: (1) Population; population density; land area and land uses; per capita assessed valuation; topography, natural boundaries, and drainage basins; proximity to other populated areas; the likelihood of significant growth in the area, and in adjacent incorporated and unincorporated areas, during the next 10 years. (2) Need for organized community services' and present cost and adequacy of governmental services and controls in the area: probable effect of the proposed formation and of alternative courses of action on the cost and adequacy of services and controls in the area and adjacent areas. The effect of the proposal, and of alternative actions, on adjacent areas, on mutual social and economic interests and on t[,e local governmental structure of the county. In order to facilitate the Commission's review of your proposal it will be necessary for you to complete the following questionaire and file the same together with the appropriate notice of in~ention re!ating to your proposal. All questions must be answered: if the question is not applicable to the type of action you propose you may so state. Pursuant to the rules of the Commission, no notice of intention ~ill be accepted for filin9 unless accompanied by this completed questionaire. Proposal Questionnaire (Answer each question completely.
