HomeMy WebLinkAbout99-09 conflict of interest 1 2 3 4 5 6 7 8 9 lO 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 99-9 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH AMENDING APPENDIX TO CONFLICT OF INTEREST CODE WHEREAS, 1. The Political Reform Act ("the Act," Gov. Code § 81000, et seq.) requires state and local government agencies to adopt and promulgate conflict of interest codes; and 2. The Fair Political Practices Commission (FPPC) has adopted a regulation (2 C.C.R. § 18730) which contains the terms of a standard conflict of interest code. It can be incorporated by reference and may be amended by the FPPC after public notice and hearings to conform to amendments in the Act; and 3. On March 6, 1991, in Resolution No. 91-46, the City Council adopted the standard conflict of interest code by reference; and 4. Resolution No. 91-46 contained an Appendix which set forth the disclosure categories for the various positions in the City of Ukiah government who make decisions that could affect an economic interest; and 5. Various job titles and duties have changed since the Appendix was originally adopted and the Appendix requires amendment to reflect the currently effective job titles and duties within the City of Ukiah; and 6. Under Government Code Section 87306.5 every other year beginning in 1992, the City Council must either amend its City Code or determine that no amendments are necessary. NOW, THEREFORE, BE IT RESOLVED, that this Resolution supersedes all other resolutions establishing Appendix to Conflict of Interest Code in the City of Ukiah and the attached Appendix to Conflict of Interest Code is hereby adopted, effective August 19, 1998, and shall remain in effect until further amended by resolution of the City Council. Note: If the City hires "consultants" as defined in 2 C.C.R. §12700, the City Manager shall describe in writing the consultant's duties and, based upon that description, shall determine the scope, if any of his or her report'mg obligations.
