RESOLUTION NO.
A RESOLUTION DETERMINING SURPLUS AND ORDERING REFUND
SOUTHWEST ADDITION NOo 2
RESOLVED, by the City Council of the City of Ukiah, Cali-
fornia, that
t~HEREAS, this Council did on February 1, 1956 pass and
adopt its Resolution of Intention Noo 56-24 relating to the con-
struction of public improvements in said City under and pursuant
to the provisions of the Municipal Improvement Act of 1913 and
amendments thereto;
WHEREAS, the construction of said public'improvements has
been completed and the cost thereof plus all the incidental ex-
penses attributable to said project were less than the amount
assessed therefor;
NOW, THEREFORE, IT IS ORDERED, as follows:
1o It is hereby found and determined that a surplus in
the amount of $ .... 10~227.06 exists in the Improvement
Fund for said project°
2. Said surplus shall be refunded or credited pro rata
to the parties assessed as follows:
a. Where the assessment has been paid in cash, credit
shall be returned in cash to the owner of the land upon which the
assessment was levied, as such owner appears from the last equaliz
ed assessment roll.
b. Where the assessment is unpaid, the credit shall
be applied upon the earliest unpaid installment of principal and
interest of said assessment.
I hereby certify that the foregoing resolution was pass-
~! ed and adopted by the City Council of the City of Ukiah, Californ
