RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH
ADOPTING MEMORANDUM OF UNDERSTANDING BETWEEN THE
CITY OF UKIAH AND THE UKIAH FIRE UNIT
WHEREAS, the Employee/Employer Relations Officer has met and conferred in
good faith with representatives of the Ukiah Fire Unit; and
WHEREAS, a Memorandum of Understanding has been arrived at; and
WHEREAS, said Memorandum of Understanding has been presented to the City
Council for its consideration.
NOW, THEREFORE, BE IT RESOLVED that this Memorandum of
Understanding is hereby adopted and the Employee/Employer Relations Officer is
authorized to enter into this Agreement for the fiscal year 1999-2000.
NOW, BE IT FURTHER RESOLVED that Randy Nickolaus, of Nickolaus and
Haeg, is hereby authorized to sign this Memorandum of Understanding, having
negotiated on behalf of the City as its representative for this agreement.

MEMORANDUM OF UNDERSTANDING
1999-2000.
This Memorandum of Understanding is entered into pursuant to the Meyers-Millias-Brown
Act (California Government Code Section 3500, et. seq.) and applicable ordinances and
resolutions of the City of Ukiah, between the City of Ukiah (hereinafter City) and the Fire
Unit (hereinafter Unit). As a result of meet and confer sessions, the City and Unit have
agreed to the following understandings.
Term
The term of this Agreement shall be one year, effective October 1, 1999, through
September 30, 2000. All items in this Memorandum of Agreement shall be effective upon
the signing of the Agreement unless otherwise specifically stated.
1. Salary_
Upon adoption by the City Council, the base salary of represented
employees in the Fire Unit shall be increased by 5%. The effective date of
the salary increase shall be 30 days prior to the actual date of adoption by
the City Council.
2. Retirement
The City agrees to obtain an actuarial valuation from PERS for the Employee Paid
Member Contribution (EPMC) and 3% @ 50 amendments with no obligation to
amend the PERS contract. The City will share the actuary with the Fire Unit upon
receipt.
3. Fire/Rescue Educational Incentive Program
Effective upon the adoption of the MOU by the City Council, and continuing for a
period not to exceed 90 calendar days, the parties agree to refer the City's
proposed changes to the Fire Educational Incentive Program to a working sub-
committee. The sub-committee shall be comprised of not more than three (3)
members appointed by the Ukiah Paid Firefighter's Association (UPFA) and not
more than three (3) members appointed by the Fire Chief. In the event that the sub-
committee is unable to develop a mutually acceptable Fire Education Incentive
Program after 90 calendar days, the parties agree to formally meet and confer to
resolve the remaining differences of the parties. (Note: "Fire Educational Incentive
Program" is the name of the program intended to revise the current
Intermediate/Advanced Certificate program~)
4. Fire ~;ervices Alternative
During the period from October 1, 1999 and through September 30, 2000, either the
City or UPFA may request to meet and confer over alternatives to the current
method of providing fire services.
Continuation
The City and the Unit agree that all conditions of employment established by City
policy, including all conditions affecting wages, hours, and working conditions that
are not specifically addressed in this Memorandum of Understanding shall continue
in effect and shall not be affected by the terms of this Memorandum of
Understanding.
The value or availability of the benefits provided in the Memorandum of
Understanding as originally worded or as amended from time to time may depend
on their tax treatment by the state or federal government or the decisions of other
government agencies or departments, such as, but not limited to, the Public
Employees Retirement System. The City will endeavor to obtain the most favorable
treatment legally possible from these other governmental entities. However, the
City makes no representation concerning the value of such benefits to unit
members or how they will be taxed or otherwise treated by other agencies or
departments. The Cit~/s obligations under this Memorandum of Understanding are
limited to the direct cost of providing the salary and benefits as described in the
Memorandum of Understanding. The City shall have no additional financial
obligation, even if the tax or other treatment of such salary or benefits by other
agencies or departments reduces or eliminates their value to the employee. The
City will meet and confer with the Fire Unit regarding the impact upon salary and
benefits.
This Memorandum is ratified and adopted pursuant to the recommendations of the
following representatives this 16 day of February_ . 2000.
