MOORE and MJ~RTHA R. MOORE, Parties of the First Part and the CITY 0F b~ IAH, a Municipal CorporatiOn, Party of the Second Part, WITNESSETH: The Parties of the First Part do hereby promise and ag~' ~ to convey to the Party of the Second Part so much as th.e~ own of the following described land, for street right- of-way to wit: A strip of lend .50 feet in width lying 25 feet on either side of the following described center line. COMMENCING at the 0ity Monument at the intersection of the center lines of Helen Avenue and ,~as.hington Avenue as delineated on that certain map recorded in Map Case l, Drawer 8,~ Page 26 in the office c~ Mendocino County Hecorder; thence south 5e08'30'' east, along the said center line of Helen Avenue, 788.95 feet to the true point of beginning; thence south 5e08'30'' east, along the projection of the center line of Helen Avenue~, 53.3.0 feet to a 3/4" iron pipe monument, marked R.E. 9659", from which point the center line of Doolan Creek bears south 5~03'30" east, 20 feet more or less. FOR AR~ IN COI~SIDEH~'fI'ION of 'the granting of the street ri!~ht-of-way the CITY OF Ut~IAH does hereby promise and agree · ~o dedicate the right-of-way so conveyed to public use for street purposes and to assume the obligation of ~nai~tenance there on o The Parties of the First Part further agree that the CITZ OF UKIAH may construct, reconstruct and maintain such street improvements within said right-of-way as it deems necessary and grant to the City the right to encroach upon their property fronting on such right-of-way to the extent necessary to construct proper cut and fill slopes.
