CALIf. / RESOLUTION NO. :"~-:'~ ..... /z/" ~SOLUTION DIRECTING CITY ATTORNEY TO INSTITUTE ACTIO~ TO OBTAIN OP~DER OF COURT TO DETERMINE QUESTION OF INCLUSION OF LIBRARY EMPLOYEE UNDER CIVIL SERVICE PROGRAM WHEREAS, The City Council of the City of Ukiah has determined that the ~ pointed employees of the Ukiah Public Library are included in the Civil Service system, the Ci~ty'c~Veit for all employees of the City of Ukiah, pur- suant to the provisions .of Ordinance No. ~08 of the City of Ukiah, and WHEREAS, The Library Board of the City of Ukiah has de- termined that the employees of the Ukiah Public Library are not included in the Civil Service System, but are employed at the will of the Board, and WEEREAS, Such a difference of opinion requires clarifica- tion by the Courts in order to determine whether a discbmrged employee of the Ukiah Public Library was illegally discharged and whether he is entitled to arrearage pay and whether he is entitled to be re-instated as a Library employee, NOW, THEREFORE, The City Council of the City of Ukiah does RESOLVE: That the City Attorney be and he is hereby directed to institute a proper action in the Superior Court of the State of California, in and for the County of Mendocino, asking for an a djudic~ion of the Court and for a final determin- ation of the question: Is an employee of the City Library of Ukiah subject to Civil Service?
