RESOLUTION GRA~TING VARIANCE TO EASTSIDE NURSERY An application for variance having been duly presented and filed, the Planning Commission of the City of Ukiah having duly held a public hearing, taken evidence, and made and filed its recommendations, and the City Council of the City of Ukiah, having duly held a public hearing, considered the recommendations of the Planning Commission, and taken and considered evidence; NOW, THEREFORE, the City Council of the City of Ukiah does hereby RESOLVE: The City Council hereby finds that the proposed variance is in harmony with the general purpose of Ordinance No. 429 of the City of Ukiah and meets the conditions of Sec° 4.41 thereof; and The City Council of the City of Ukiah does hereby grant Variance 8-59/60 to Dorothy Learn and Annadell Caton, doing business as Eastside Nursery, to construct a building suitable for nursery and florist business on property located at 765 South Dora Street, Ukiah, California, and to conduct a nursery and florist business on said premises, all subject to the following conditions: 1. The present building on the property described shall be removed. 2. Prior to any construction applicant shall submit to the City Council plot plan and building plan and specificat- ions for any building to be constructed on the property described, which plans and specifications shall be subject to the approval of the City Council. 3. Any portion of any building constructed on the property described which comes within five (5) feet of any property line of said property shall be of such°~ire resistant type construction as to comply with Fire Zone I requirements. The buildings contemplated by this variance shall be completed within one year from the date hereof, unless extended by resolution of the City Council. 5. As an express condition of this variance, applicant shall construct, at his sole cost and expense, curbs, gutters, and sidewalks of the type and standard as directed by the Director of Public Works along the front of the property described in this variance. If any condition set forth above is violated, or if any 10 11 required approval is not obtained, then this variance shall be null and void, otherwise to continue in full force and effect indefinitely and to run with the land.
