RESOLUTION GRANTING VARIANCE TO
DR. ROY lq. SWAIN
An application for variance having been duly presented and filed,
the Planning Commission of the City of Ukiah having duly held a public
hearing, taken evidence, and made and filed its recommendations, and
the City Council of the City of Ukiah, having duly held a public hearing,
considered the recommendations of the Planning Commission, and taken
and considered evidence;
NOW, THEREFORE, the City Council of the City of Ukiah does hereby
RESOLVE~
The City Council hereby finds that the proposed variance is in harmony
wi th 'the general purpose of Ordinance Noo 429 of the City of Ukiah and
meets the conditions of Seco 4.41 (a) thereof; and
lhe City Council of the City of Ukiah does hereby grant Variance
No o 64-7 to Dr. Roy M. Swain
to permit use of the existing residence building located at 716 S. Dora
~n~lx~x~l~x St. for professional office in the practice of Optometry
on said premises, all subject to the following conditions:
1) Construction and location shall conform to application and
plot plan submitted by applicant.
2) The use hereby permitted shall be commenced within one year
from the date of granting of this variance and the construction
shown on the application and plot plan shall be completed
within one year from the date of granting this variance. If
the use permitted herein shall cease for any period of six
(6) consecutive months this variance shall automatically ter-
minate.
~f any condition set forth above is violated, or if any required
approval is not obtained, then this variance shall be null and void,
otherwise to continue in full force and effect indefinitely and to run
with the lando This variance is granted only for the specific purposes
set forth above, and shall not be construed as eliminating or modifying
any building, use or zone requirements except as to such specific
purposes°
