GARZINI The City Council of the C~ty of Ukiah does hereby RESOLVE: An application for variance having been duly presented and fi led, the Planning Commission of the City of Ukiah having duly held a public hearing, taken evidence~ and made and filed its recommendations, and the City Council of the City of Ukiah,, having duly considered the recom- mendations of the Planning Commission; The City Council hereby' finds that the proposed variance is in har- mony with the generai purpose of the Zoning Ordinance of the City of Ukiah and meets the conditions thereof; and Does hereby grant Variance Nc),, .64-15 to: Robert A..Garzini, 181 Fairview Court , Ukiah; Califo. rnia to permit: construction of n_D~ :more than 12 mul_ti. Dl~e family units foE__ rental purposes only qn proper..1;y_]oc~~330_Beacon Lane all l) subject to the follo~,ing conditions~ approved Location and constr,~ction shall conform to app]ication and to/plot plan and sketch submitted wi th application, 2) This variance shall be put i~to effect by completion of construction, if any, within one [I) year from the date of granting hereof, if the use permitted shall cease far six (6) consecutive months then this variance shall automatically terminate. 3) No construction shall be permitted along the Beacon Lane frontage closer than forty feet (40') north of the north line of Beacon Lane. 4) Neither the granting ofthis variance nor the requirement of a set-back shall in any way commit the City to develop and/or widen Beacon Lane. Any such development and/or widening shall be at the expense of the adjacent property owners and other interested parties, wi th no City participation unless otherwise agreed at such time. 5) Applicant shall submit to City a revised plot plan showing construction location of the proposed structures. Such plot plans shall be subject to approval by City. If any condition set forth above is viola[ed, or if any requi red approval is not obtained, then this variance shall be null and void, other- wi se to continue in full fo "~. r~.~. a~d effect indefinitely and to run with the land. This variance is granted o~ly for the specific purposes set forth above, and shall not be c. onst:r~ed as e!imin~ting or modifying any building, use or zone requirements excep~ as to such specific purposes.
