HomeMy WebLinkAbout62-12 RESOLUTION NO. 62-]2 RESOLUTION GIVING NOTICE OF PROPOSED ANNEXATION TO CITY OF UKIAH OF UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED "ANNEXATION NO. 62-I," AND Gl VING NOTICE OF TIME AND PLACE FOR HEARING OF PROTESTS THERETO. § BE IT RESOLVED BY THE COUNCIL OF THE CITY OF UKIAH: 6 ]. That, pursuant to the provisions of the Annexation of 7 Uninhabited Territory Act of 1939, a petition signed by owners 8 of not less than one-fourth of the ]and in the hereinafter 9 described territory, by area and by asseSsed value as shown on ZO the last equalized assessment roll of the County of Mendocino, 11 was filed with the Council of the City of Ukiah on August 8, 196], Z:g requesting annexation of the hereinafter described territory to 15 said City. lA 2. That the territory which the petitioners request be 15 annexed to the City of Ukiah and which said City and its Council 16 propose to annex, is situate in the County of Mendocino, State 17 of California, hereby designated "Annexation No. 62-1," and 18 described as follows: Commencing at a point on the Westerly line of the North- western Pacific Railroad right.of_way which bears West 70.98 feet from the Northwest corner of the "Burger Annexation', to the City of Ukiah, County of Mendocino, State of California, as fi]ed in the County of Mendocino Recorder's Office in Map Case l, Drawer 9, Page 203~ said Westerly i ine being also the Easterly City limits of the City of Ukiah; thence from said point of commencing South ~c :~32' East, and following said Easterly City limits 996.90 feet to the true point of beginning for this description; thence leaving said Easterly City limits North 80o28, East 70.0 feet to a point on the Easterly right-of-way line of the above mentioned ~',lorthwestern Pacific Railroad; thence North 82Oo6, East 16,3.15 -Feet to a point on the !,'.festerly line of Waugh Lane; thence North 10°15' West, and following said Westerly line of !,:laugh Lane 396.39 feet- thence North f32o30, East 505.95 feet. thence South 69o!~.6, East 518.50 feet; thence South z~°20' East 673 20 'Feet- thence South 83o53, ',.'.h.:~st 862 .:~ .6,_ -Feet to concrete monument as indicated on that certain map as filed in the Mendocino County Recorder's Office in Hap Case i Drawer 9 Page 203. t;'~ence continuing South ~:~;°53' West ]9;+.70 f-eet to a point on the heretofore mentioned Easterly right-of-way line of the Northwestern Pacific Railroad- thence South ~ o . oO 28' West 70,0 feet to a point on the Westerly line of said right-of-way, and the abovementioned Easterly City Limits: thence North 9032' West, and fo]lowing said City ]imits ~.91.3z~ 'fee to the true point of beginning, containing 20 70 acres, more or !ess. -' · lO :El 18 20 28 3O 3. That the County Boundary Commission of Mendocino County, California, did in session duly assembled on Tuesday, August 1, 1961, consider the proposed annexation boundaries of said "Annexation No. 62-1,': as above described and as submitted to said Commission by the proponents of said annexation. ~'~. ThatWednesday , Sept. 27 , 1961, at the hour of ~g: 15 o'clock P.M., in the Council Chambers in the City Ha!l in the City of Ukiah, County of Mendocino, California, is hereby fixed as the time and place when and where any person owning real property within the uninhabited territory above described and proposed to be annexed to the City of Ukiah, and having any objections to the proposed annexation, may appear before the Council of the City of Ukiah and show cause why such uninhabited territory should.not be so annexed to the City of Ukiah. The protest must be in writing, may be filed at any time before the hour set for hearing objections to the proposed annexation, and shall state the name or names of the owner or owners of property affected and the description and area of such property, in general terms. 5. The City Clerk of the City of Ukiah is hereby author- ized and directed to cause a copy of this resolution to be published at least twice,but not oftener than once a week, in the Ukiah Daily Journal, a newspaper of general circulation published in said City of Ukiah, the city to which it is proposed to annex the aforesaid territory, and also in the !.Vi ll its News, a newspaper of general circulation published outside the. City of Ukiah, but in the County of Mendocino, California, the county in which is located the territory proposed to be annexed to the City of Ukiah, said publication to be complete at least twenty (20) days prior to the date set 'For hearing. 6. The said City Clerk is further authorized and directed to cause written notice of such proposed annexation to be e 10 11 12 13 iA 16 16 17 18 19 20 26 28 29 3O mailed to each person to whom land within the territory proposed to be annexed was assessed in the last equalized county assessment roll available on the date the above said proceedings were initiated, at the addresses shown on said assessment roll or known to said Clerk, and to any person who has filed his name and address and the designation of the lands in which he has an interest, either legal or equitable, with said Clerk, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. 7. In the event any land wi thin the territory proposed to be annexed is owned by a county, the City Clerk is directed to cause written notice of such proposed annexation to be mailed to the Board of Supervisors of such county, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. 8. In the event there is, upon the land proposed to be annexed to said City, a structural improvement owned, being acquir ed or leased by a county 'Fire protection district, the City Clerk is directed to cause written notice of such proposed annexation to be mailed to the governing body of such district, such notice to be sent not less than ten (10) days before the first public hearing upon such proposed annexation. 9. The City Clerk is directed to cause written notice to be given to such other persons as may be legally entitled thereto, in the manner required by law.
