DATE: April 7, 2004 __ AGENDA SUMMARY REPORT SUBJECT: ESTABLISHMENT OF A FAIR SHARE ALLOCATION OF THE REMAINING CAPACITY AT THE WASTE WATER TREATMENT PLANT CREATED BY THE CEPT PROGRAM As previously reported to the City Council, additional capacity has been realized on an interim basis at the City's Waste Water Treatment Plant (WWTP) with the implementation of the Chemical Enhancement to the Primary Treatment (CEPT) Program. The CEPT program involves the addition of ferric chloride and polymers to the waste stream at the preaeration grit chamber preceding the primary clarifiers. These chemicals enhance coagulation and flocculation of the suspended organic matter thereby increasing the amount of solids and associated matter removed by the primary clarifier process. Because of the lower organic loading to the trickling filters, additional treatment capacity is realized. Based on field-testing performed at the VWVTP by Brown and Caldwell in August 2003, it has been estimated that the additional capacity realized with the implementation of CEPT is 920 equivalent sewer service units (ESSU). An ESSU is defined as a unit of sewage having characteristics of flow and organic loading equivalent to that generated by a family of 2.5 people. The CEPT program is interim because of the corrosive characteristics of ferric chloride and it has been recommended that the CEPT Program be discontinued upon completion of the capacity and rehabilitation improvements. The additional 920 ESSUs from the CEPT program will be included within the new capacity of 2,400 ESSUs provided by the Project. Prior to the implementation of CEPT, process capacity at the VWVTP had been reached. This means that until the Capacity and Rehabilitation WVVTP Project is completed, the City must limit new connections to 920 ESSUs in order to remain in compliance with the Waste Discharge Permit requirements. As of March 24, 2004, 484 ESSUs of the 920 additional ESSUs had been committed to since August 2003, either through the permit process or by Will Serve Letters issued for proposed subdivisions or large developments. Of the committed 484 ESSUs, 385 ESSUs have originated within the Ukiah Valley Sanitation District (UVSD) and 99 have originated within the City. The percentages of the current ESSU allocations are 80% for the District and 20% for the City. As previously reported to the City Council, projected annual growth rates utilized for the 20 year planning period were 0.60% for the City and 1.65% for the UVSD. Based on these growth rates, approximately 37% of the new connections would be in the City and 64% within the UVSD equating to 888 ESSUs for the City and 1,536 ESSUs for the UVSD. The Interim Public Utility Director, as the Executive Director to UVSD, had informed the UVSD Board that he had estimated 1,850 of the new connections made available by the Project would originate within the District. This estimate was based on the distribution of the new connections as of February 2, 2004 when 77% of the new connections were in the District. To facilitate an equitable distribution of the remaining ESSUs created by the CEPT program, the Interim Public Utility Director is recommending that a maximum number of ESSUs be established for the City and District. It is proposed that the City receive not more than 212 ESSUs and the District receive no more than 708 ESSUs. The proposed maximum values would give the City and District 23% and 77% of the available ESSUs respectively. As of March 24, 2004, the balance of ESSUs for the City would be 113 and 224 for the District out of the remaining 436 ESSUs. The 1995 "Participation Agreement Between the City of Ukiah and the Ukiah Valley Sanitation District" (Agreement) and the "Amendment No. 1" to the Agreement executed on March 24, 1999 do not specifically authorize the City or District to limit the number of connections to each others collection system. Should the City Council want to implement a limitation of available ESSUs for each entity, an amendment to the Agreement will be required. Staff believes this is an equitable distribution of ESSUs created by the CEPT and recommends the numbers be approved and the agreement amended to formalize the fair share split. ORDINANCE NO. 23 AN ORDINANCE OF THE UKIAH VALLEY SANITATION DISTRICT AMENDING SECTION 1 OF ORDINANCE NO. 19 PERTAINING TO SEWER CONNECTION FEES The Board of Directors of the Ukiah Valley Sanitation District ordains as follows: 1. Section 1 of Ordinance No. 19 dated January 1, 1994 is hereby amended to read: "(1) Residential Structure: (a) Sewer connection fees for residential structures shall be based on the number of bedrooms contained in the structure. The sewer connection fee for residential structures shall incease with incremental increases in the total number of equivalent sewer service units (ESSU) that are allowed to connect to the District's sewer collection system as of the effective date of this Ordinance. A one bedroom residential structure is equivalent to 0.60 ESSU. A two bedroom residential structure is equivalent to 0.80 ESSU. A three bedroom residential structure is equivalent to 1.00 ESSU. Each bedroom in excess of three bedrooms shall be considered as 0.40 0.20 ESSU and an I additional fee equaling the difference in the fee for a one and two bedroom shall be paid for each bedroom in excess of three bedrooms. O0 $16, 76i; (2) Commercial and Industrial Schedule: (a) The sewer connection fee for commercial and industrial structures shall be based on the number of fixture units contained in the structure as determined from table 7-3 of the 2001 Califomia Plumbing Code for typical plumbing fixtures plus any additional fees for process equipment that generates liquid waste that the District Engineer reasonably deems necessary to pay for additional costs due to biochemical oxygen demand removal requirements, other treatment requirements, and gallonage of flow, and any other sewage characteristics. Twenty six (26) fixture units shall be equal to 1.00 ESSU. The sewer connection fee for each ESSU and fractional one hundredth thereof shall increase with incremental increases in the total number of ESSUs that are allowed to connect to the District's sewer collection system as of the effective date of this Ordinance. The fee charged for each ESSU and fractional one hundredth thereof shall be equal to the fee charged for a residential structure having an ESSU of 1.00. (3) The District Executive Director shall maintain a list of all the connections with a tabulated total of the ESSUs that have been allowed to connect to the District's sewer collection system for the purpose of determining the applicable ESSU increment." (4) The term "equivalent sewer service unit (ESSU)" shall have the same meaning as the term" Sewer Service Unit" as that term is defined in Section 1.12 of Ordinance No. 12." 2. This Ordinance shall become effective ,2004. PASSED AND ADOPTED by the Board of Directors of the Ukiah Valley Sanitation District, County of Mendocino, State of California, on this day of 2004, by the following roll call vote: ~ ~ ORDINANCE NO. 1052 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF UKIAH AMENDING PORTIONS OF SECTION 3731A, ARTICLE 12, CHAPTER 2, DIVISION 4 OF THE UKIAH MUNICIPAL CODE PERTAINING TO SEWER CONNECTION CHARGES The City Council of the City of Ukiah does hereby ordain as follows: SECTION ONE Section 3731A of the Ukiah City Code is hereby amended to read as follows: §3731 A: SEWER CONNECTION CHARGES: The following charges are hereby established for the connection of the plumbing of any building or structure which discharges to the sanitary sewer system of the City and said charges are separate from any other charges presently levied or which may be levied in the future: A. Residential Schedule: Eight Thousand Seven Hundred Fifty-Nine Dollars ($8759.00) for equivalent sewer service unit (ESSU) per dwelling unit connected based on the number of bedrooms according to the following schedule: Single/Multi-Family/Modular Homes/Mobile Homes Connection Fee ESSUs 1. 1 bedroom $7,759 0.9 2. 2 bedroom $8,759 1.0 3. 3 bedroom $9,759 1.1 4. For each additional bedroom $2,500 beyond 3 bedrooms B. Commercial and Industrial Schedule: 1. Eight Thousand Seven Hundred Fifty-Nine Dollars ($8759.00) per ESSU for commercial and industrial connections, except hotels and motels, together with the charge to be determined by the City Manager based upon biochemical oxygen demand removal requirements, other treatment requirements, and gallonage of flow, and any other sewage characteristics as the City Manager deems appropriate. For hotels and motels, the charge per ESSU shall be Four Thousand Three Hundred Seventy-Nine Dollars and Fifty Cents ($4,380.00) for recognition of 50% occupancy, together with the charge to be determined by the City Manager based upon biochemical oxygen demand removal requirements, other treatment requirements, and gallonage of flow, and any other sewage characteristics as the City Manager deems appropriate. 2. [Remains the same] Ordinance No. Page 1 of 3 SECTION TVVO Section 3735 is hereby added to Article 12, Chapter 2, Division 4 of the Ukiah City Code {}3735: ADDITION OF BEDROOM TO EXISTING STRUCTURE. A sewer connection fee in the amount of $2,500.00, which is equivalent to 40% of the sewer connection fee charged for one equivalent sewer service unit, shall be charged for each bedroom added to an existing residential structure as permitted under the provisions of Division 3 of the Ukiah City Code. Said connection fee for each added bedroom shall be paid at the time the building permit is issued. The term "bedroom" as used herein shall include any room which can be used as a bedroom, no matter how designated on the building plans; provided, however, that a residential dwelling unit may have one living room, dining room, garage, kitchen, and family room which shall not be considered a bedroom. Bathrooms shall not be considered as bedrooms. SECTION THREE This ordinance shall become effective 30 days after its adoption, and will be published as required by law in a newspaper of general circulation in the City of Ukiah. Except as specifically provided herein, any application for a sewer connection received by the City after November 5, 2003, shall be subject to the fee imposed by this Ordinance, to be collected on or after the effective date of this Ordinance. The fee imposed by this ordinance shall not apply to an application for a sewer connection and connection fee received by the City prior to the effective date of this Ordinance for a project consisting of five or fewer sewer connections which does not require extension of an existing sewer main, if, prior to November 6, 2003, the project has received all planning approvals required for issuance of building permits. "Planning approval" means approvals required by the Ukiah City Code or other law for the development or use of real property from the Ukiah Planning Commission or City Council, such as, but not limited to, parcel maps or final subdivision maps, site development permits, use permits, and variances. Nothing contained herein shall require the City to furnish a sewer connection, if the City lacks treatment capacity to accommodate the additional connection, as determined by the City Manager or City Council based on engineering analysis and recommendations.
