HomeMy WebLinkAbout2001-38RESOLUTION NO. 2001-38 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH WAIVING THE 60-DAY NOTIFICATION REQUIREMENT FOR ESTABLISHING A COUNTY FACILITY WITHIN THE CITY LIMITS, AS REQUIRED BY GOVERNMENT CODE §25351 WHEREAS, 1. Government Code §25351 requires that a County notify a City in advance of its intent to locate a County facility in the incorporated area; and 2. Government Code §25351 further requires that said advance notification occur at least 60 days prior to use and occupancy of the County facility, unless the City Council waives the notification requirement by Resolution; and 3. The Mendocino County Department of Mental Health Services has requested a waiver of the 60-day notification requirement to lease the property located at 400 Talmage Road for the purpose of providing space for offices and counseling services; and 4. The granting of the waiver will enable the Mendocino County Department of Mental Health to facilitate the timely use of the office building; and 5. The property located at 400 Talmage Road is zoned for commercial and professional office uses; and the intended use would be compatible with the existing land uses in the vicinity; and 6. The use of the properties by the Mendocino County Department of Mental Health Services for office space would not be inconsistent with any City code, or the goals and policies of the Ukiah General Plan. 7. NOW, THEREFORE, BE IT RESOLVED that the City of Ukiah grants the County of Mendocino Public Health Department a waiver of the 60-day notification requirement to lease and occupy the property at 400 Talmage Road in a timely manner in order to provide much needed office space and counseling services.
