ANNEXATION WORKSHOP
WEDNESDAY, MARCH 10, 2004
The Ukiah City Council met at an Adjourned Meeting for an Annexation Workshop on
March 10, 2004, the notice for which had been legally noticed and posted, at 5:01 p.m.
Roll was taken and the following Councilmembers were present: Rodin (arrived at
5:06 p.m.), Andersen, Smith, Baldwin, and Mayor Larson. Staff present: Community
Services Director DeKnoblough, Risk Manager/Budget Officer Harris, City Manager
Horsley, City Attorney Rapport, Planning Director Stump, and Deputy City Clerk Ulvila.
Audience present: Mendocino County Supervisors Delbar, Shoemaker, and
Wagonette, LAFCO Executive Officer Mc Michael, and Ukiah Valley Fire Chief Grebil.
2. AUDIENCE COMMENTS ON NON-AGENDA ITEMS
No one came forward to address Council.
3. ANNEXATION WORKSHOP
City Manager Horsley introduced Mr. Bob Braitman to the City Council. She advised
that invitations to attend the workshop as requested by Council, were sent to the
Mendocino County Board of Supervisors, LAFCO, Mendocino County Planning
Commission, and City of Ukiah Planning Commission.
Bob Braitman from Citygate Associates, LLC, management consultants, discussed the
Draft Report on "Strategy for Annexation Revenue Sharing and a Successful Tax
Exchange Agreement for the City of Ukiah", Interim Report as of February 18, 2004. He
further discussed his experience working with various LAFCO organizations in other
cities and that he has 18 years of experience assisting cities.
He provided a Power Point presentation, with a printout distributed to Council, staff, and
the public. He provided an overview of annexation procedures and the requirements
necessary to be eligible for annexation of property. Preparation of a master property tax
agreement would be beneficial. He went on to discuss certain City planning decisions
that must be made as well as the City's application to LAFCO which would require a
Resolution of application by the City Council. LAFCO's review and approval process
were discussed. The transfer of service responsibilities concerning the City and the
County were discussed at length as well as the reallocation of revenues. He discussed
the neutral effects of annexation on an individual's property taxes and the effects of
annexation on other governmental agencies and voters. He made reference to the
Revenue and Taxation Code Section 99.
Discussion followed with regard to annexing residential areas as it relates to a tax
exchange with the County. Besides property tax, sales tax revenue sharing was also
discussed.
Councilmember Andersen requested additional information regarding sales tax
agreements as well as anticipated developments and sharing of taxes from those future
developments.

Mr. Braitman stated that the current sales tax should be considered, however, he did
not think the loss of potential revenue to the County should be considered. He went on
to discuss services that the City may need or want to provide to annexed property.

Frank McMichael, LAFCO Executive Office, commented regarding City annexations
and service providers. He further discussed LAFCO's policy, negotiations between the
City of Ukiah and the Board of Supervisors with regard to tax sharing, infrastructure
issues, and the importance of the City protecting its Sphere of Influence when
development occurs.
Dan Grebil, Ukiah Valley Fire District Chief, discussed previous negotiations to form a
JPA between the City of Ukiah and the Ukiah Valley Fire District for fire protection in the
Ukiah valley that failed to develop. He further discussed the Ukiah Valley Fire District's
commitment to continue to respond to calls for assistance both inside and outside the
City limits.
4. ADJOURNMENT
There being no further business, the City Council adjourned the meeting at 6:10 p.m. to
March 17, 2004 at 5:00 p.m. in Conference Room //4 at the Ukiah Civic Center for
consideration of budget priorities and that their regularly scheduled Meeting of March
17th would commence at 6:30 p.m.
