HomeMy WebLinkAbout96-54 1 2 3 4 5 6 7 8 9 10 11 19. 13 14 15 16 17 18 19 20 21 23 25 26 27 28 RESOLUTION NO, 96-54 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH ADOPTING THE NON-DISPOSAL FACILITY ELEMENT (NDFE) AND ESTABLISHING IT AS A PART OF THE CITY OF UKIAH'S SOLID WASTE MANAGEMENT PLAN WHEREAS, the California Integrated Waste Management Act of 1989 (AB 939, SHER) requires each city and county in California to prepare a Non-disposal Facility Element (NDFE); and WHEREAS, the cities of Ft, Bragg, Willits, and Ukiah and the County of Mendocino joined together through the Mendocino Solid Waste Management Authority (MSWMA) to have a single document prepared which incorporates transfer stations, recycling processing facilities, and composting facilities as facilities necessary to implement the jurisdictions' waste diversion goals; and WHEREAS, the document has been approved by the AB 939 Local Task Force and the Mendocino Solid Waste Management Authority; and WHEREAS, the required Public Hearing has been held on April 17, 1996 and public comment received; and WHEREAS, appropriate modifications have been incorporated into the Non- disposal Facility Element to reflect the hearing process; and WHEREAS, the City Council or the City of Ukiah has determined that the document meets the requirements set forth in the California Integrated Waste Management Act of 1989 (AB 939, SHER); and appropriately identifies the needs and implementation measures for the City of Ukiah. NOW THEREFORE, BE IT RESOLVED, that the Non-disposal Facility Element 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 attached as Exhibit A is adopted and established as a part of the City of Ukiah's Solid Waste Management Plan. PASSED AND ADOPTED this 17th day of April, 1996, by the following roll call vote: AYES: Councilmembers Mastin, Malone, Wattenburger, Shoemaker, and Mayor Schneiter. NOES: None. ABSENT: None.
