HomeMy WebLinkAbout8801 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 ORDINANCE NO. 880 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF UKIAH AMENDING SECTIONS 8211, 9208, 9229(a), 9235(a) AND 9260 OF THE UKIAH CITY CODE, PROVIDING FOR FEES AND GENERAL PLAN AMENDMENTS The City Council of the City of Ukiah does hereby ordain as follows: Section One. Section 8211 of the Ukiah City Code ("UMC") is hereby amended to read as follows: Section 8211 - Fees for Engineering Services: Before the final map is approved, the subdivider shall deposit with the City Director of Finance in cash the costs of Engineering Services made by the City, according to a resolution adopted from time to time by the City Council establishing fees for Engineering Services. No refunds shall be made. Section Two. Section 9229, Subsection (a), is hereby amended to read as follows: Section 9229 - Appeal: (a) In case the applicant, or any interested party, is not satisfied with the action of the Planning Commission, relating to the granting or denial of the application for a use permit, he may within ten days appeal in writing to the City Council stating the basis for his dissatisfaction. Said appeal shall be accompanied by a fee established from time to time by resolution of the City Council. Section Three. Section 9235, Subsection (a) is hereby amended to read as follows: (a) In case the applicant, or any interested party is not satisfied with the action of the Planning Commission, relating to the granting or denial of the application for a variance, he may within ten days appeal in writing to the City Council stating the basis for his dissatisfaction. Said appeal shall be accompanied by a fee established from time to time by resolution of the City Council. Section Four. Section 9208, subsection (h) is hereby amended to read as follows: (h) Appeals: 1 3 4 5: 9~ 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 If the applicant for a site development permit and the Commission are unable to reach an agreement as to the conditions of the permit, the applicant shall notify the City Manager, in writing, within fifteen days of the Commission's action as to the matters to which he is in opposition. Such written objection shall be considered an appeal to the Council. Upon payment of a fee established from time to time by resolution of the City Council, the matter shall be set for the next available Council agenda. Section Five. Section 9260 is hereby amended to read as follows: Section 9260 - Amendments to Chapter: This chapter, and corresponding provisions of the City's General Plan, may be amended by changing the boundaries of districts or by changing any other provision thereof, whenever the public necessity and convenience and the general welfare require such amendment, by following the procedure set forth in this article. Section Six. This Ordinance shall be published as required by law and shall be effective 30 days after its adoption.
