JANUARY 4~ 1961
The City Council convened in regular session in the Council
Chambers at 8:00 P.M. with Mayor Buxton, Councilmen Smalley,
Runkel, Banker and Wagner present.
APPROVAL OF WARRANTS:
On a motion by Councilman Banker, seconded by Councilman Smalley,
"it waJs 'unanimously carried Payroll Warrants in the amount of
$26,338.67 be approved.
APPROVAL OF MINUTES:
On a motion by Councilman Runkel, seconded by Councilman Wagner,
i"t wa's unanimously carried the minutes of December 28, 1960 be
approved as corrected.
APPROVAL OF C. P. S.
WARRANT:
On a motion by Councilman Smalley, seconded by Councilman Runkel,
it was unanimously, carried C. P. S. Warrant No. 618 be approved
in the amount of943'1.3~
REPORT ON ANTI-LITTER
ORDINANCE:
The City Attorney reported having prepared an anti-litter ordinance
which was submitted to the League of California Cities for an
opinion. In reply, it was the opinion of the League that it is
doubtful that an ordinance could be drafted which would not
conflict with the State Law. Under State Law if the activity
is punishable as a misdemeanor the local authorities could issue
a citation for such violation. The Council was advised by ~he
City Attorney not to attempt an anti-litter ordinance that
would compete with State Law.
HEARING BEFORE DISTRICT COURT OF
APPEALS - CITY OF UKIAH v. BOARD
OF TRUSTEES OF THE MUNICIPAL LIBRARY;
FONES:
The City Attorney reported receiving a notice from the District
Court of Kppeals that arguments will be presented in the case
of the City of Ukiah v. Board of Trustees of the Ukiah Municipal
Library; Fones, in Sacramento on Thursday, February 16, 1961.
RESOLUTION 61-34 ACCEPTING GRANT
AND DEDICATION OF STORM DRAINAGE
EASEMENT - JOHN & OPAL 5LAYFIELD:
On a motion by Councilman Smalley, seconded by Councilman Wagner,
it was unanimously carried Resolution 61-34 be adopted and the
Mayor and Clerk be authorized to sign same "Resolution Accepting
Grant and Dedication of Storm Drainage Easement - John and 0pal
Mayfield".
SUMMARY OF 1960 CALENDAR
YEAR GENERAL WORK PROGRAM:

A summary prepared by the City Manager was reviewed outlining
accomplishments during the 1960 calendar year.
DATE OF EXAMINATION
FOR POLICE CHIEF:
Mr. Cash reported that he has been advised by the State Personnel
Board that the examination for Police Chief will be given on
February 3rd. It is planned to schedule the examination in the
southern part of the State as well as in Ukiah.

RESOLUTION No. 61-35
A~ENDING GAS ~ TEE CHARGE:
On a_ motion by Councilman Smalley, seconded by Councilman Banker,
it was unanimously carried Resolution No. 61-35 be adopted
"Amedding Gas Meter Charge'' eliminating charge for commercial gas
meter installations.
FAIRGROUNDS DRAINAGE PROBLEM:
A letter from James Tocher, Secretary-Manager of the 12th Dist-
rict Agricultural Ass'n was read requesting a meeting with
members of the Council concerning drainage problems at the
Fairgrounds to be held January 10, 1961.
Although there is a definite problem on the fairgrounds amount-
ing to a major amount of work, it was the City Manager's opinion
the 12th District Agricultural Association should propose a
suggested solution. The Council was in general agreement and
authorized the City Manager to attend the meeting and express
the Council's feelings in the matter.
INSPhCTION OF CITY WATER
SYSTEM- STATE DEPT. OF PUBLIC
HEALTH:
The City Council was advised of a report from the Bureau of
Sanitary Engineering, State Department of Public Health to the
effect that a recent inspection of the City's water system
revealed it to be in excellent sani~ary condition and compli-
menting the water department personnel on its adequate records
of operation and general housekeeping.
COUNCILMAN RU~KEL:
1 Mr. Bunkel requested that the Council bc,~r~0~g ,t~ up to on
activities of City forces doing sewer£work aIong the State
Highway North of the City Limits. It was reported that the
work is being done under the contract agreement entered into
at the time the Sanitation District System began operations.
The work is required because of soon to be constructed freeway
facilities. The City will be paid the total construction cost
by the District and the State Division of Highways will in tttrn
reimburse the District.

Mr. Hunkel asked what progress had been made in investigating
the dirty water complaint of E. G. Gschwend, N. Bush St., which
was previously reported to the Engineering Department. Mr.
Kruth reported that on checking it was discovered that this
party is o~-a water rights and is receiving free water from the
City through an old dilapidated line and it is felt that the
problem is the responsibility of the property owner rather than
the City's.

Mr. Hunkel reported that residents on Cherry Avenue and Cherry
Street think there should be a street light at the corner of
Cherry and State Streets.
COUNCILMAN SMALLEY:

Mr. Smalley reported the street light burned out at Ford and
Myron Streets.
Councilman Smalley inquired of the progress of the C. H. P.
pistol range at the old Sewage Treatment Plant and Mr. Cash
reported he had heard no~hing further in this regard.

Mr. Smalley also questioned if the City Manager had received a
reply to his letter to Mr. Nipper concerning the Oak Manor
Subdivision extension of ti~e and Mr. Cash reported he had not
received a reply.

CITY MANAGER MISC. REPORTS:

Mr. Cash informed the Council that work has begun at the old
sewage treatment plant of leveling dikes in preparing the ground
for tree planting.

It was also reported by Mr. Cash that the City Attorney is
preparing final papers in connection with the Humphrey pro-
perty, Gobbi Street widening project.
ADJOURNMENT:
As there was no further regular business, Mayor Buxton declared
the meeting adjourned at 9:30 P.M. after which the Council re-
convened in closed personnel session.
