HomeMy WebLinkAboutMin 02-01-61MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH FEBRUARY 1~ 1961 The City Council convened in regular session in the Council Chambers at 8:00 P.M. with Mayor Buxton, Councilmen Runkel, Smalley, Banker and Wagner present. APPROVAL OF WARRANTS: ,, On a motion by Councilman Banker, seconded by Councilman Wagner, it was unanimously carried Payroll Warrants in the amount of $25,949.4? be approved. APP~ROVAL OF MINUTES: On a motion by Councilman Wagner, seconded by Councilman Runkel, it was unanimously carried the minutes of Janua~y 25, 1961 be approved as submitted by the Clerk. On a motion by Councilman ~agner, seconded by Councilman Smalley, it was unanimously carried the minutes of the special meeting of January 31, 1961 be approved as submitted by the Clerk. APPROVAL OF C. P. S. WARRANT $421.86: On a motion by Councilman Smalley, seconded by Councilman Wagner, it was unanimously carried general warrant #964 payable to Calif. Physician's Service in the amount of ~421.~6 be approved. VARIANCE APPLICATI0~' #~-61 CLOICE H. BIGGINS, M. D. 702 SO. DORA STREET: Variance Application No. 5-61 be Cloice H. Biggins, M. D. to permit the use of a residence at 702 So. Dora as a medical office and attached drawings were reviewed by the City Council. The City Manager read for the benefit of the Audience and Council the minutes of the Planning Comm~ission meeting held on January 19, lq61 in which, by formal action of the Commission, it was recommended the variance be granted subject to the following conditions: 1. That a circular driveway be constructed around the existing building. 2. That this particular use be put into effect within one year from the date the Variance is granted, and 3. That the use of the building be limited to a single medical or dental occupancy. Present on behalf of the application were Dr. Biggins and his attorney Timothy 0'Brien and Mr. Chas. Anderson Realtor. Mr. Earl Fullerton and his attorney, Mr. James Busch were present in protest of the granting .of the variance. Dr. Paul Marsh was also heard pointing out the desirability of small office build- ings in residential areas. Mr. Ful±erton's protest was based on the fact that a circular driveway around the existing building would be an infringement on his privacy as ~is patio is located immediately adjacent to the proposed driveway and parking area. It was the suggestion of the protestants that the residence be moved to the rear of the property and provision for parking be made available in front of the building. Mr. 0'Brien representing the applicant, protested the additional expense moving the build, lng would incur as well as the fact that it would create an irregularity in setback already established in the area. Mr. 0'Brien further pointed out that the proposed use is in harmony with the neighborhood in that the trend has been toward professional offices, many of whica use street parking. Correction of sidewalk and driveway approach. 2. Specifications and type of material used in construction of the driveway meet the City Engineer's standards. The hearing on this application was continued to the next regular meeting pending further investigation by a member of the Council. PUBLIC H~ARING RE LAND USE ELEMENT OF THE GENERAL PLAN: Mayor Buxton declared final public hearing open at 9:05 P.M. on the Land Use Element of the General Plan. Mr. Fred Barber, Planning Consultant, was present. There were no persons protesting it~adoption. Dr. Paul Marsh was recognized suggesting the City do everything possible to attract people to Ukiah from the pro- posed freeway. He suggested a method of doing this would be the construction of parallel streets along the freeway to allow the convenience of turn offs for shopping and secondly, prevent persons traveling on the highway from viewing un- sightly backyards. Dr. Marsh was informed that this was a matter for the County to consider inasmuch as the freeway will be constructed outside the limits of the City. RESOLUTION 61-52(A) ADOPTING LA~D USE ELEMENT OF THE GENERAL PLAN: On a motion by Councilman Wagner, seconded by Councilman Smalley it was unanimously carried Resolution No. 61-52 (A) be adopted and the Mayor and Clerk be authorized to sign same "Resolution Adopting Land Use Element of the General Plan". RESOLUTION 61-52 COM~MENDING C~HAR.LES ~ELL UPON HIS RETIREMENT: On a motion by Councilman Wagner, seconded by Councilman Banker, it was unanimously carried Resolution ~O. 61-53 be adopted and the Mayor and Clerk be authorized to sign same "Resolution Commending Charles R. Bell Upon His Retirement From the Planning Commission". Mr. Bell was presented with a framed copy of the resolution and a gift from members of the Planning Commission. PUBLIC USE & NECESSITY FOR PURPOSES OF PROPOSED EMINENT DOMAIN ACTION: The City Attorney requested this matter be deferred pending further study of the subject. RESOLUTION 61-54 AUTHORIZING CITY M~NAGER TO ACCEPT DEEDS AND GRANTS ON BEHALF OF CITY: On a motion by Councilman Smalley, seconded by Councilman Wagner"~' i~"Was unanimously carried Resolution No. 61-54 be adopted and the Mayor and Clerk be authorized to sign same "Resolution Authorizing City Manager to Accept Deeds and Grants on Behalf of City". LEAGUE PROPOSAL RE STREET AND ROAD DEFICIENCIES: _ On a motion by Councilman Banker, seconded by Councilman Wagner, it was unanimously carried the League of Calif. Cities be informed that the City Council is opposed to any increase in taxes to support street deficiencies at this time due to current conditions. NOTICE OF CHA~.~ER OF COMMERCE BOARD OF DIRECTORS MEETING: MINUTES OF THE ~ETIEG OF THE COUNCIL OF THE CITY OF UKIAH FEBRUARY 1~ 1961 page 3. The Council was advised that a meeting of the Board of Dir- ectors of the Chamber of Commerce will be held Friday, Feb- ruary 10th at 12:00 Noon at the 101 Motel. Councilman Banker volunteered to represent the Council at this meeting. DIVISION OF HIGHWAYS CONFEREI~CE IN. EURE.KA; M~tRCH 7, ~,.. and 9;.. 1761: A letter from the Division of Highways was reviewed to the effect that the District Office proposes to conduct a con- ference for City and County officials of District I tent- atively on March 7, 8 and 9, 1961 for the purpose of pro- moting a greater understanding of the Division's policies and procedures and an exchange of ideas and information. PACIFIC AISLINES APPLICATION TO P.U.C. FOR INCREASE IN FREIGHT RATES: The Council was advised of an application by Pacific Airlines to the Public Utilities Com_mission for an increase of freight rates within the State of California. Upon request of the Council, this matter will be investlgated further by the City Manager. PUBLIC UTILITIES COMMISSION HEARING RE RATE TARIFF-APRIL 5, 1961: The City Attorney reviewed briefly an exhibit prepared by the P. U. C. Transportation Division Rate Branch in which it is reco~ended the Co~nission find and conclude that it is necessary and desirable in the public interest that a single minimum rate tariff be developed and established by the Com~ission for transportation of general commodities within an area c.ompromising what may be termed the San Francisco Bay industrial-commerCial comp]ex, the boundaries of the area to be determined by the Commission after the receipt of further evidence. Mr. Irish noted that the Staff makes no recommendation re chaz~es in outlying areas, including Mendocino County. APPROVAL OF PLANS A~,iD SPECIFICATIONS FOR GOBBI STREET WIDEiiING - OAK TO DORA: On a motion by Councilman hunkel, seconded by Councilman S~all'ey",~ it Was unanimously carried plans and specifications for Gobbi Street widening be approved for transmittal to the Division of Highways. REPORT ON SALES TAX RECEIPTS 3RD Q. UA[~.TER OF 1960: A report fro~ the State Board of Equa].ization was reviewed by the City Manager in which it was noted that Ukiah received Sales Tax on taxable sales amounting to a total of $~,831,000. for the Third Quarter of 1960. COUNCILM~N RUNKEL: Mr. nunkel questioned if any further progress has been made toward annexing the Cooper Lane area into the City and was informed by the City Engineer that his department is doing preliminary work on the project. MAYOR BUXTON: The Mayor reported that Ukiah won Third Place for attendance and distance traveled to the recent League Meeting in Santa Rosa. The next meeting is to be held April 22nd at Hamilton Field. SCOUT WEEK ~ FEBRUARY 6-13: MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH FEBRUARY 1~ 1961: Page 4. The Council was advised that a portion of the next regular meeting time will be set aside for aprticipation by the Boy Scouts as part of the activity during observance of Boy Scout Week.
