In observance of Boy Seout Week, Scouts acting as
counter-parts to City-officials conducted a short
meeting prior to the regular meeting of the City
Council.
T~oe City Council convened in regular session in the
Council 0hamhers at ~:30 P.F~. with ?!ayor l. uxton,
Councilmen [~unkel, Smalley, Banker and Wagz~er present.
APPROVAL OF ~':I[~UTES:
On a motion hy ~ouncilman Wagner, seconded by Councilman
Smalley, it was unanimously carried the minutes of
Febraary 1, lq61 be approved as submitted by the Clerk.
On a motion by Councilman Banker, seconded by Oouncilman
Wagner, it was unanimously carried Resolution No. 61-~
be adopte~ and the Yayor and Clerk be authorized to
sig:n same "Resolution Granting Variance to Cloice H.
='~:~ggins, ...~¢. D." to permit use of building at ~02 ~o.
Dora St., Ukiah for the purpose of conducting a pro-
fess!onal medical or dental office.
APPOINTF~ENT TO MAYOR'S
SAFETY STEE~tING COMMITTEE:
Mayor f, uxton announced the following appointments to
the Mayor's Safety Steering Committee: Arclh Reid,
Ed Seirens, RcS °acini, Bill ~illiams, i~ob ~er,~er
and Lyell Cash. The Mayor will act as an eX-officio
member. This com:~'~ittee will continue to meet on a
weekly basis until all subcommittees are established.

On a motion by Councilman Wagner, seconded by Councilman
Smalley, it was unanimously carried ~esolution ~o. 61-56
be adopted and the Mayor and Clerk be authorized to sign
same "Resolution Adopting ~udget and Approving First
Supplemental Memorand~am of Agreement for Expenditure
of Gas Tax Allocation for Major City Streets".

The City Attorney reported that Shelley Corporation,
Subdividers, have entered into an agreement with the
City to construct sidewalk along Marwen Drive in
Nokomis Subdivision parallel to and a distance of
s~x feet from the curb face now existing and have
executed a grant and dedication of an easement for the
public right to pass over said property.
DIG~]'TM~A GRAZING LEASE -
CITY DUMP PROPERTY:
On a motion by Councilman Wagner, seconded by Councilman
Banker, it was unanimously carried the City enter into
an agreement with Warren Dightman for use of City Dump
property for grazing ~urposes and the Mayor and Clerk
be authorized to sign same.

PURPOSES:
The Cit.y Attorney reported that Title of insurance
on the Ethel Humphrey property has been received
by the City which finalizes the acquisition of property
on Gobbi Street for widening purposes.

On a motion by Councilman Smalley, seconded by Council-
man Wagner, it was unanimously carried Amendment of
Airport Shop ~ilding No. 2 Lease to Permit Auto rental
and Sale of Aircraft Parts and Supplies be approved and
the Mayor and Clerk be authorized to execute same.
AGREPi~NT GRANTIi~G AUTO RENTAL
CONCESSIOI'i TO YERBERT B. PILBEN:
On a motion by Councilman Smalley, seconded b.y Council-
ma~ Wagner, it was unanimously carried the City enter
into an Agreement Granting Auto Rental Concession to
Herbert B. Filben and the Playor and Clerk be authorized
to sign same.
LETTER FROM C.A.~. RE DISCONTIi'~0ANCE
ON SERiVICE BY PACIFIC AIR LINES:
The City i~lanager reviewed a letter from the Civil Aero-
naut'~cs Board ~n which it was point, ed out that Pacific
Air Lines has not applied for suspension at Ukiah and
is o~lfgated to serve a point for the period of its
certificated authority unless t~.~e Board authorizes
a temporary suspension. Pacific air Lt. nes is certif-
icated to serve Ukiah until December 29, 1961. If
they file application for renewal they would continue
to hold operating authority pursuant to terms of the
Administrative Procedure Act, until the Board's final
decision on such an application in which public hear-
ings would be held.
The Council concurred with ~r. Cash's suggestion that
he correspond with Pacific Air Lines in an effort to
establish their position regarding continuance of
service to the Ukiah Municipal .Airport.
STATE DEPT. O? INDUSTRIAL RELATIONS
RE UNLAWFUL PRE-EHPLOYKENT PRACTICES:
The City Manager reviewed briefly literature from the
State ~epartment of Industrial Relations, Division of
F~ir E~nployment Practices, listing lawful and unlawful
pre-employment inquiries. It was noted that discriminat-
ion in employment because of race, color ancestry,
religious creed or national origin is prohibited by law.
REPORT ON PENALTIES
FOR PRICE FIXING:
As a matter of interest, the Council was advised by Mr.
Cash that fines and jail sentences were i~posed on high
officials involved in price-fixing of electrical supplies.

REPORT FE LEAGUE SURVEY
ON PPOPOSED TAX INCREASE
TO COR~{ECT POAD AND STREET
DEFICIENCIES:

The Council was advised that the Mendocino County Board
of Supervisors and the City Council of Point Arena have
opposed a tax increase to correct street and road def-
iciencies. The Board of Supervisors of Lake County
agreed to support the program. ~illits and Fort Bragg
took no action.
LETTER OF C0i~DOLEi~CE
TO MRS. zAUL ~ATHE~JS:
On a motion by Councilman ~'agner, seconded by Councilman
Banker, it was unanimously carried the Mayor send a
messsge of condolence to Mrs. Paul Mathews on behalf
of the City Council.
According to Mr. Cash, the City Hall will be kept open
Friday afternoon, however all City employees w~o wish
to attend funeral services for Paul Mathews may do so.
ELECTRIC LI~ SERITNG WISE
PROPERTY - ME[~.DOCI~O ~'~LACE:
The City Manager reported that proposed condemnation
proceedings for electric line to serve property at
Mendocino Drive and Mendocino Place will not be necessary
as other satisfactory arrangements have been made.

THE E'E0i'~N ACT - AB 127:
Mr. Cash informed the Council that AB 127, if enacted
will require all meetings of local legislative bodies
to be opera even ~.f held solely for the purpose of dis-
cussion and no action is to be taken or no decision
is to be m~de on the subject under consideration. It.
would also require open meetings to discuss pending,
proposed or anticipated litigation with the City Attorney
or special counsel. The League urged that all city
officials contact members of the Assembly Com~:,ittee on
Governmental EFficiency and ~conomy and express views
concerning this Bill, to be heard ~ebruary 14, 1961.
On a motion by Councilman Banker, seconSed by Councilman
',~[agner, it wa.s unami~sously carried the City Manager not-
ify legislators in Sacramento to contact members of this
Co~r~ittee informi, ng them that City Council opposes AB
127.
i~OTICE OF SPECIAL CONFERENCE
P~GA~DING ~IRRENT ECONOMIC
S~ATUS IN ~OCIEO COUNTY:
~ telegram from Clem Miller, Congressman, was read to the
effect that a special conference will be held at the
Mendocino County Court House on Saturday, February 10,
1961 for the purpose of discussing current economic
conditions in Mendocino County. Mr. Cash and Council-
man Lanker will attend.

Ii~ FRES~0:
Mr. Gash informed the Council that he planned to attend
the City Manager's meeting to be held in Fresno February
i[th through l?th. Also that the City Attorney would be
in Sacramento Wednesday, February 15th on City business.
