The City Council convened in regular session ~n the Council Chambers at 8:00 P.M. with Mayor Smalley, Councilmen Runkel and Wagner present. Councilmen Buxton and Banker were absent. APPROV~L OF WARRANTS: On a motion by Councilman Wagner, seconded by Councilman lunkel, it was unanimously carried Payroll '~arrants in the amount of i[127,042.94 be approved for the pay period April 1~ to April 30, 1961. ~0n a.. motion by Councilman Runkel, seconded by Councilman ~Jsgner, it was unanimously carriedGeneral War, rant payable to C. P. S. in the amount of $431.34, be approved. APPROVAL OF MINUTES: On a motion by Councilman ~agner, seconded by Councilman Runkel, it was unanimously carried the minutes of April 26, 1961 be approved as corrected. RESOLUTION NO. 61-66 SUPPORTING S. ~. 1031 (Restoration of doctrine _of governmental immunity.): On a motion by Councilman Wagner, seconded by Councilman Runkel, it was unanimously carried Resolution No. 61-65 be adopted "Resolution Supporting S. B. 1031" (Restoration of doctrine of governmental immunity) and the Mayor and Clerk be authorized to sign same. ABANDON~NT OF ALLEY BETWEEN LIVE OAK AND HAZEL STREETS: It was reported by the City Attorney that the law regarding ~ vacation of streets provides that a resolution of intent to vacate be adopted and a public hearing be held by the Council. According to the City Engineer there is presently a power line into the alley and it was his suggestion a public utility easement be reserved by the City should the Council see fit tp vacate the street. Members of the Council con- curred with this suggestion and authorized the City Attorney to proceed with the preparation of a resolution of intent to vacate the alley between Live Oak and Hazel Streets for presentation at the next regular meeting. RELEASE OF BONDS - SPANISH MTN. TELE VI SI ON : It was the recommendation of the City Attorney that the City Council comply with a request from Fidelity & Cssualty Co. of New York that a .p~,000 Fidelity Bond and a $10,000 Surety Bond provided by Spanish Mountain Television be cancelled inasmuch as new bonds have been issued by Hart- ford Accident & Indemn_~.ty Co. covering the operation under Transcontinent Communications Systems, Inc. On a motion by Councilman Wagner, seconded by Councilman Runkel, it was unanimously carried Fidelity and Casualty Company bonds No. S-10819~4 and a-10819~ be cancelled as reco~,~ended by the City Attorney, covering the op- eration of ~ipanish Mountain Television by Gerrold Elect- ronics Corporation. Also reviewed was the Planning Commission Minutes of april 20, lO61 in which the Commission unanimously recommended the var~.ance Be granted subject to the con- dition that a minimum of ~' clearance to the rear property line be maintained. Dr. Collins was present on behalf of his application. There were no written or verbal protests submitted. One written declaration of non-protest was received from George Ward adjacent orooerty owner. /~fter. cons~derabie.~ discussion Councilman ~ ~agner made a motion Variance Application No. 8-60/61 be granted as requested by ~r. Collins subject to the following cond- itions: 1. Wall within 2' of property line must be constructed of 4 hour fire resistant material. 2. Area between proposed building and existing neighboring garage be cemented~to prevent weed growth. 3. No openings be allowed in the east wall. Any esves within 30" of adjacent structure be fully fire resistant. Councilman Wagner's motion died for lack of a second. There was further discussion during which the City Attorney recom~mended that, should a variance be grantsd to Dr. Collins, it include a variance from the 40% building site area and from the reqUirement that the proposed building, as an accessory building, be at least 10' from the main building. Due to the fact that consideration by both the Planning Comm- ission and the Council was by less than the full membership of each body, it was formally agreed that this variance be referred back to the Planning Commission for further study and recomm~endation. SEWAGE TREATMENT PLANT ROADWAY: The Council was advised that in the plans for the freeway it is proposed to construct an overpass as access to the sewase treatment plant. The State Division of Highways has requested the treatment plant road be dedicated to public use and re-named. It was the City Manager's re- commendation this road be offered to the County for ded- ication as a County road. On a motion by Councilman Banker, seconded by Councilman ~agner, it was unanimously carried the sewage treatment plant road be offered to the County for dedication as a County road. CALVERAS COU~TY I~TER~ATIONAL FROG .JUMP MAY 18th: ~ , A letter was reading inviting the Mayor to part- icipate in the Mayor's frog jump at the Calveras County Fair to be held May l~th. WATER SERVICE TO ZIMMERMAN PROPERTY - BRUSH & N. STATE: On a motion by Councilman Runkel, seconded by Council- man Banker, it was unanimously carried the City Eng- ineer be authorized to install a 6 inch para~el water main and necessary fire hydrant to provide service to the Zi~erm~n property on ~. State and Brush Streets in lieu of crossing State Street with an indtvddual service. COUNCILMAN RONKEL: 1. Mr. Runkel commented on the hazard created in case of fire by traffic being held up by the Northwestern Pacific hailroad re- portedly for ~ minutes at the Gobbi Street crossing. Mr. Cash reported that this matter is being investigated. 2. Upon inquiry concerning who was acting as Recreation Director, Mr. Runkel was informed that Don Yates has charge of maintenance and Win Howe, Golf Pro is supervising activities at the clubhouse. MAYOR SMALLEY: Mayor Smalley commented on the League Meeting held at Hamilton Field and reported attendance by 21 represent- atives from Ukiah. Ii~VITATIOI~ TO NATIONAL ASS'N. OF HOUSING RE- DEVELOPMENT LUNCHEON: An invitation was extended to t he Mayor and members of the Council to attend a luncheon with Governor Prown on May 23rd to be presented by the National Association of Mousing Redevelopment.
