HomeMy WebLinkAboutMin 05-10-61MINUTES OF THE MEETING OF THE COUNCIL 0F THE CITY OF UKIAH - MAY 10~. 1961: The City Council convened in regular session in the Council Chambers at 8:00 P.M. with Mayor Smalley, Councilmen Runkel, Banker and Wagner present. Councilman Buxton was absent. APPROVAL OF MINUTES: On a motion by Councilman Wsgmer, s~conded by Councilman ~anker, ~it was unanimously carried, the minutes of May 3, 1961 be approved as corrected. That this variance be acted upon within one year from this date; ?. That construction of this room be substantially the same as the accompanying plot plan submitted by the applicant. It was the City Manager's recommendation that Item 1 be changed to read "That the wall within two (2) feet of the property line be constructed of 2 hour fire resistant material" inasmuch as the ~ hour requirement as previously reco~ended was above code requirements and was recommended in error. On a motion by Councilman Wagner, seconded by Council~an ~anker, it was carried by a three to one vote the City Attorney be dir- ected to prepare a re~olution granting Variance No.~ ~-o0/61~ to Kenneth. C. Collins, M. D. subject to the contritions set forth by the Planning Com~.ission except Item l, in which a 2 hour fire resistant wall is required. AYES: Councilmen Banker, Wagner and Smalley. ~OES: Councilman Runkel. ABSENT: Councilman Buxton. RESOLUTION NO. 61-67 II~TENTION TO VACATE U~NAMED ALLEY NORTH OF WALNUT AND BETWEEN HAZEL A~D LIVE OAK AVENUE~, RESERVING ~N EASEMENT FOR PUBLIC UTILITIES: On a motion by Councilman 'fagner, · ~ seconded by Councilman Banker, it was unanimously carried Resolution No. 6t-6~ be adopted and the Mayor and Clerk be authorized to sign same "~.esolution of Intention to Vacate Unnamed Alley North of ~,~alnut and Between Hazel and Live Oa~ Avenues, Reserving an Easement for Public Utilities". B. 170[ - USE TAX EXE~TION: The City Attorney reported that telegrams were sent to Senator Slattery and Assemblyman Belotti urging their support of A. B. 170[ concerning Use Tax Exemption. This Bill has been set for hearing before the Assembly Com~ittee on Revenue and ~axation on May llth. PUBLIC HEARING RE WEED AND RUB;;,I~H ABATEMENT: Public Hearing was declared open by Mayor Smalley at ~J:30 P.M. regarding weed and rubbish abatement. Assessor's Certification of List of Names and Addresses of Owners of ~escribed propertie dated May l, l~ol was filed wit~ the Mayor along with a statement from the County ~ssessor stating the charge £or preparing the list to be in the sum of $2~.00. Affidavit of mailing of the City Clerk and Affidavit of posting of the Director of Public Works were filed with the Mayor along with a certified list of properties described in Resolution 61-63 whlcb have complied with the order of the Council. ~he Mayor declared that properties described in the list f~led by' the Director of Public Works to be stricken from the resolution as correct~d hy the Assessor's Certified List. Property owners desiring to make objections were, requested to rise and be recognized by the Chair. There were no persons present reGuesting to be heard. On a motion by Councilman Wagner, seconded by Councilman Runkel, it was unani~_.ousty carried that there being no objections the Council does by motion disallow al]_ objections. RESOLUTION NO. 61-68 ORDERING DIRECTOR OF PU.~°LIC WORKS T0 PROCEED ~ITH ~-HE ABATEMENT O'F WE~.DS A~D PU'BBLE: On a motion by Councilman Hanker, seconded by Councilman Wagner, it was unanimously carried Resolution No. 61-68 be adopted "Resolution Ordering Director of Public Works to Proceed With the Abatement of Weeds and Rubble" and the Mayor and Clerk be MI~YJTES OF THE COUNCIL OF THE CITY OF UKIAH - MAY 10~ 1961 - PAGE authorized to sign same. 0PDINANCE NO. 539 ESTABLISHING- CITY CODE~ AL0]~TING DIVISI0~i I ~=~i~,-~ERE0~.~, A~D INCORPORATING 7~,EREIN BY RE?~ENCE CERTAI~ EXISTI~,G 0BDISANCES: Members of the Council were presented with copies of Division I of the codified.ordinance. Ordinance ~o. 539 Establishing City Code, adopting DiviSion I thereof, and Incorporating therein by Reference Certain Existing Ordinances was read by the City Attorney and introduced by Councilman Wagner. On a motion by Councilman Banker, seconded by Councilman ~agner, it was unanimously carried a public hearing be held at 8:30 P.M., May 24, 1961 on Ordinance No. 539. A,~ARD OF ~ID FOR WATER MAIN IMPROVEMENTS - 1960-61: (M. B. STEVENSON): Bids received for water main improvements were reviewed by the City Manager as follows: M. B. Stevenson Baldwin Construction Edwards & Foulk Argonaut Construction Rosecran's Construction ~35,~30.00 37,15o.25 37,76~.75 41~295.75 On a motion by 'Jouncilman Wagner, seconded by Councilman [~unkel, it was unanimously carried the bid for water main improvements 1960-61 be awarded to M. B. Stevenson, Santa Rosa, in the amount of ~3~,830.00 and the Mayor and Clerk be authorized to execute the contract doc~unent. REQUEST TO BLOCK STANDLEY S T~E[~T FOR DA.i~ CE M~Y 20 th: Mr. Jim Tocher, Secretary-Manager of the 12th District Agricultural Association was recognized requesting Standley Street from State to School Streets be h~locked for the presentation of a street dance on May 20th. On a motion by Councilman kunke~l, seconded by Councilman Banker, it was unanimously carried authorization be given to block Standley Street between State and School Streets from 8:00 to 12:00 P.M. Saturday May 20th for the purpose of presenting a street dance, subject to the approval of the merchants in the area and the police and fire departments. MILLVIEW REQUEST FOR EMERGENCY SERVICE' The City Manager requested discussion concerning emergency water service to Millview District be deferred pending further in- vestigation into the matter.
