Councilman '~fagner was absent· APPROV=L OF MINUTES: On a motion by Councilman Banker, seconded by Councilmen Runkel, it was unanimously carried the minutes of May 17, 1961 be approved as corrected· RESOLUTION N0. 61-70 EXTENDING VARIANCE N0. 10-59/60 C. F. TNIMBLE NURSING N0.~ 101 S HORT~SE: On a motion by Councilman Banker, seconded by CouncilP~an Buxton, it was unanimously carried ResOlution No. 61-70 be adopted "Extend- ins Variance No. 10-~9/60, C. F. Trimble" to permit remodeling of building at 101 S. Hortense Street for use as a nursing home, date to be extended from Niay 11, 1961 to and including A~ust 11, 1061 The ~a ' ~ · ~.~. yor and Clerk was authorized to sign same. THELMA WILSON SUIT FOR QUIET TITLE ANE DECLAPATORY RELIEF: The ~o~ncil was advised by the City Attorney that Thelma Wilson has filed suit for quiet title and declaratory relief against Purity Stores and. several Doe defendants. The City N{anaser was served a sum~ons in this action. ~ _PY'O~POSED LEGI~L~Tu.~E - 1961: In discussini~ proposed legislation, the City Attorney particularly noted that A. B. 2848 and S. B. 1~2~ will be heard on May 2~th and 26th. These bills would permit withdrawal of territory from a recrea~+ion and park dis?rict upon inclusion in a city by annexation and, since cities provide recreation services, usually out of general funds, the effect has been that annexed territories have been paying twice, to the district and to the city. On a motion by Councilman B~xton, seconded by Councilman Banker, it was unanimously carried the City Attorney be directed to write legislators requesting their support of A ~ 2848 and S B ~coo - · Hemhers of the Council were also advised that the Poard of Super- visors has adopted Resolution 36~ supporting S. B. lgql~.. This bill will allow a local option vehicle license fee to be added to other vehicle license fees, the revenue to go to roads through- out the county and cities throughout the county· The Council declined to take any formal action either for or against this measure. PUSLIC HEARING RE ADOPTION 0P 0RDINA['~CE NO ~3o EeTAP{LIe~ CITY CODE, ADOPTING DIV. 1 THEREOF AN-il INCORPORATING BY REFERENCE CERTAIN EXISTING Public Hearing on Ordinance No. 539 was declared open by Mayor Smalley at ~:30 P.M. There were no persons present in protest or in favor of the adoption of this ordipance. On a motion by Councilman Wagner, seconded by Councilman Banker, it was unanimously carried Ordinance No. ~39 be adopted and the Mayor and Clerk be authorized to sign same. ME}~0RIAL DAY SERVICES: A letter from Governor Brown was read h.y ~','iayor Smalley request- ing appropriate services be held co~'~emorsting Memorial Day, .May 30, 19(~_1. APP0!~.!~.z.~-z- 0P DAVID A. STRONG AS T~:ECREATION & PARKS DiNECTOR: The City Manager announced that Nr. David 2. Strong will take over the duties of ~ecreat'ion and Parks Director on June 1, lq61. LEGAL AD~5'TISING 1961-62: The Council was advised that un~er State Law the City is re- quired to call for bids for legal advert~sin.~, however:~ since there is only one newsDa~er of general circulation in Ukiah, it is the op].nion of the City Attorney that a call for bids is not required. The U'kish Daily Journal is a~dreea~;le to continuing the publication of legal notices at l~st year's rate of ~1..~0 for first insertion ~nd ~1.00 per sauare for each succeeding insertion. This arrar~gement met with the apDroval of the~Council. NEP0.~T ON £_,~L~S ~AX: The City-Manager reported a comparison of Sales %'ax receipts for the months June through May, which indicated a I~,.~ decrease 10~9-60 fiscal year receipts: received 1q~9-60 Received 1960-61 Difference :~:198,229.06 ~}9~, 2~3 79 It was brought to the attention of the Council that during the months of March and. April, in the absence of a Recreation and Parks Director, adult recreation at Pomolita and the High School was handled by three individuals who put in a total of 94 hours. ~hey have requested they he reimbursed for these ser- vices .at the rate of ii2.0O ~er hour. ' 0n a motion by Councilman ~'agner, seconded by Councilman Buxton, it was unanimously carried the bid for the paving of ~ ~' ~ob ,..~ Street, from Oak to Dora, be awarded to A. ~.. Siri, Inc. in the amount of ~2,752.00, and the Mayor and Clerk be authorized to execute the required contract. PURITY STORE I~!PROVEP{ENTS (PORZI0 LANE): The following items of information were presented to the Council in connection with water and sewSr improvements to the Purity Store: To install public water and sewer lines in Porzio Lane (requiring 8" cement asbestos plne_ · ....... ........ e_.:~'~ 190. install private water and sewer lines on Purity property, requiring 6" ceraent asbestos pipe 'Difference in cost .. . ~1,120. }~Ii',!UTES 0P ~.TiE ~/iw'~;'TTRG 0F }-;iAY al}~ 1961 - PAGE · ~'~ ~- ~- ~-~, , il Porzio Lane is a private roadway consisting of two twenty foot strips with a right to pass o~er, one owned hy Mrs. Porzio snd the other b~ Ralph Hogan. Mr. Hogan has recently dedicated a 20 foot utility easement to the City. Purity ha°~ ~'xn~essed~ ~ a willingnes~~ ~ to ded~.cate 5 feet for street purposes, install curb, gutter and sidewalk on Porzio Lane and pay half the cost for pa~ing the street as well thei~~ cos~ of installing 6" water and sewer lines· In order to provide a ~0 foot street would require an additional ~.~ foot dedication on the east side of the street by approximately six property owners· ~hese owners would also be required to construct curb an~ gutter. M'embers cf the Council expressed the feeling that the property owners on the east side of Porzio Lane be contacted concerning their willingness to install curb and gutter and the dedicat~..on of ~.~ feet of property to r, ublic use and when this information has been compiled the matter again be presented for consideratios. PUMP Ai,;D WATEi{ TANK APPROVED ~' ~ SUi~DIV!SION FOR E.~R~E: ~e : ,, The ~ouncil was advised of the continuins problem of serving water to the Barnette Subdivision during the su~.~er months with sufficient pressure due to high elevation. It was the City Engineer's recormr~endation that a redwood tank be installed on the hill above the McCue property with a booster pump at an estimated cost of f~_~ A 20,000 gallon tank would cost'200' for 10,000 gallon tank. an ad~-~ti, onal ~00 This pro.iect met with Council approval however it was agreed a 20,000 6allon tank should be provided for future growth in this area.
