HomeMy WebLinkAboutMin 08-09-61MINUTES OF THE MEETING OF THE COUNCIL OF THE CiTY OF UKIAH - 9, 1~)61 AUGUST The City Council convened in regular session in the Council Chambers at 8:00 P.M. wi th Mayor Smalley, Councilmen Runkel, and Banker present. Councilmen Buxton and Wagner were absent. Mr. A. S. Kruth was Acting City Manager in the absence of Mr. Cash. APPROVAL OF MINUTES On a motion by Councilman Runkel, seconded by Councilman B~nker, it was unanimously carried the minutes of August 2, 1961 be approved as submitted by the Clerk. CLAIM FOR DAMAGES - MRS. EVERETT NElL ~62.46: On a motion by Councilman Runkel, seconded by Councilman Banker, it was unanimously carried claim for damages alleged to have occurred on August 1, 1961 to a vehicle owned by Mrs. Everett Nell ~ a City of Ukiah truck be denied in the amount of 2./+6. MENDOClNO COUNTY DAY - AUGUST 12 - LAKEPORT: The Mayor and members of the City Council were extended an invitation to participate in Mendocino County Day at Lakeport on August 12, 1961. RESOLUTION NO. 62-10 EXTENDING VARIANCE NO. 10-59/60 - C. F. TRIMBLE NURSING HOME: On a motion by Councilman Banker, seconded by Councilman Runkel, it was unanimously carried Resolution No. 62-10 be adopted and the Mayor and Clerk be authorized to sign same "Resolution Extending Variance No. 10-59/60 - C. F. Trimble Nursing Home.~' VARIANCE NO. 10-60/61 - ERVIN BURKE - 10~11 MAPLE AVENUE: Variance Application No. 10-60/61 by Ervin Burke to permit a reduction in sideyard to a minimum of three feet at 1031 Maple Avenue, was reviewed by the Acting City Manager along with the Planning Commission Minutes of July 20, 1961. It was the recommendation of the Planning Commission that the variance be rejected for the following reasons: 1. There is a way this problem can be settled between the property owners which would not involve a variance, and it is felt this should be attempted before any action is taken on the part of the City, and 2. That as a matter of precedent the granting of this variance might very well encourage future 'mi stakes' where it would be beneficial to the property owner. Present on the behalf of the variance application was Mrs. Les Ryan and Mr. Bennington of the Ryan Development Com- pany. A letter from Ernie Hawn, adjacent property owner, was read to the effect that he has no objections to the property lines remaining as they are at present and he does not wish to sell any of his property at this time. During the discussion it was conceded that an error was unintentionally made in establishing the property lines for this particular piece of property; that an honest effort was made to comply wi th the Planning Commission's suggestion that the matter be settled between property MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH AUGUST ~, l~61 - PAGE 2: owners involved in that rejection of ship and expense. the variance, to no avail; and further, the application would cause undue hard- On a motion by Councilman Banker, seconded by Councilman Runkel, it was unanimously carried the City Attorney be instructed to prepare a Resolution granting Variance No. 10-61/62 to Ervin Burke at 1031 Maple Avenue. ORDINANCE NO. 54~+ CODIFYING BALANCE OF DIV. 2 - BUSINESS: COUNCILMAN WAGNER ARRIVED AT THIS POINT IN THE MEETING - 8:3~; P.M. Ordinance No. 544 was read in full by the City Attorney and introduced by Councilman Banker "An Ordinance Codifying and Adopting by Reference the Following Ordinances and Portions of Ordinances, together with such amendments thereto as are hereinafter Specified, in Code Form to be Included in Division 2 of the Ukiah City Code; OCdinance No. /~81 Relating to Pawn Brokers as Amended by S~ction 2 of this ordinance; Ordinance No. 483 Relating to Auctions as Amended by Section 3 of this Ordinance; Ordinance No. 460 Relating to Fortune Telling; Ordinance No. 407 Re- lating to Carnivals; Ordinance No. 513 Relating to Pool and Billiard Parlors; Ordinance No. 446 Relating to Trailers and Trailer Camps; Ordinance No. 395 Relating to For Hire Motor Vehicles as Amended by Section /+ of this Ordinance; and Enacting Certain New Provisions in Division 2 of the Ukiah City Code Consisting of Chapter 6 Entitled I'Restaurants; and Providing Penalties for the Violation Thereof." Date and time for public hearing was set for September 6, 1961 at 8:15 P. M. ORDINANCE NO. 542 PROVIDING FOR THE INSPECTION, REGISTRATION, AND LICENSING OF BICYCLES, PRE- SCRIBING PENALTIES FOR THE VIOLATION THEREOF, AND REPEALING SECTIONS 1 THROUGH 9 INCLUSIVE OF ORDINANCE NO,. 352: On a motion by Councilman Wagner, seconded by Councilman Runkel, it was unanimously carried Ordinance No. 542 be adopted and the Mayor and Clerk be authorized to sign same "Ordinance Providing for the Ihspection, Registration, and Licensing of Bicycles, Prescribing Penalties for the Violation Thereof, and Repealing Sections 1 Through 9 inclusive of Ordinance No. 352". AYES: Councilman Banker, Runkel, Wagner and Smalley. NOES: None. ABSENT: Councilman Buxton. COUNCILMAN RUNKEL: 1. Councilman Runkel again commented on the need to correct the dip at Clay and Oak Street intersection. ADJOURNMENT: As there was no further regular business, Mayor Smalley declared the meeting adjourned at 9:05 P.M. ATTEST:
