HomeMy WebLinkAboutMin 08-16-61MINUTES OF THE MEETING OF AUGUST 16 1961 OF THE COUNCIL OF THE CITY OF UKIAH ' The City Council convened in regular session in the Council Chambers at 8:00 P.M. with Mayor Smalley, Councilmen Runkel, Buxton and Banker present. Councilman Wagner was absent. APPROVAL OF WARRANTS: On a motion by Councilman Buxton, seconded by Councilman Banker, it-was unanimously carried General ~arrants in the amount of $67,247.28, be approved. APPROVAL OF MINUTES: On a motion by Councilman Runkel, seconded by Councilman ~-~nker[--i~t~-was unanimously carried the minutes of August 9 1961 be approved as corrected. ' RESOLUTION NO. 62-11 GRANTING VARIANCE .TO ERVIN BURKE - 1031 MAPLE AVENUE: On a motion by Councilman Banker, seconded by Councilman R--u-nkel,' it-~was unanimously carried Resolution 62-11 be adopted and the Mayor and Clerk be authorized to sign same "Resolution Granting Variance to Ervin Burke," to permit garage as now existing at 1031 Maple Avenue to extend to within 3 feet 8 inches from easterly property line. RESOLUTION NO. 62-12 GIVING NOTICE OF PROPOSED ANNEXATION TO CITY OF UKIAH OF UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED "ANNEXATION No. 62-~!' AND GIVING NOTICE OF TIME AND PLACE FOR HEARING OF PROTESTS THERETO: Petition for annexation was reviewed by the City Attorney along with the map delineating the boundaries of the territory to be annexed. The petition and map were referred to the Boundary Commission and approved on August 1, 1961. COUNCILMAN WAGNER ARRIVED AT THIS POINT IN THE MEETING - 8:20 P.M. On a motion by Councilman Buxton, seconded by Councilman Runkel, it was unanimously carried Resolution 62-12 be adopted and the Mayor and Clerk be authorized to sign same "Resolution Giving Notice of Proposed Annexation to City of Ukiah of Uninhabited Territory Described Herein and Designated "Annexation No. 62-1" and Giving Notice of Time and Place for Hearing of Protests Thereto" (Hear i ng to be he 1 d Wednesday, September 27, 19~1 ). ACTION DEFERRED ON BIDS FOR STREET SWEEPER: Upon request by the City Manager, action on bids for street sweeper was deferred to the next regular meeting. EVERSOLE MORTUARY GRANTED ONE YEAR LEASE FOR USE OF NORTH SCHOOL ST. PARKING LOT.. On a motion by Councilman Runkel, seconded by Councilman ~t was unanimously carried the Eversole Mortuary be granted a one year lease for use of the City-owned parking lot on North School Street and the City Attorney be authorized to prepare the necessary lease document. NO. 5~-1 REGULATI'NG.'THE KEEPING OF LIVESTOCK WITHIN THE CITY LIMITS OF THE CITY OF UKIAH: Mayor Smalley declared Public Hearing on Ordinance No. 541 open at 8:30 P.M. The Council was advised that notice of the hearing was mailed to interested parties along with the publication of a Legal Notice in the local newspaper. A letter from the Mendocino County Health Department was read by the City Manager urging the adoption of this ordinance. Mr. Bob Swan was present representing the Health Department. Also present on behalf of its adoption was Mr. and Mrs. Merle Morgan, 148 Clare and Mrs. Augustine, 744 Jackson Avenue. A petition containing l ll names was presented in protest of the ordinance. Persons p~esent in protest were as follows; Ralph Oakley 740 Maple Avenue Charlotte Oakley 740 Maple Avenue Norman Boone 596 N. School Kurt Schmitz Janice Johnson Russ Oakley N. Pine 1094 W. Standley 740 Maple Ave. Mary Jane Middleton Sandy Frisbie 417 W. Mill St. l l/~9 Maple Ave. Public Hearing was declared closed at 9:15 P.M. On a motion by Councilman Wagner, seconded by Councilman Bank-~r, ..... i-t was carried by a 3 to 2 vote Ordinance No. 541 be adopted and the Mayor and Clerk be authorized to sign same "Resolution Regulating the Keeping of Livestock Wi thin the City Limits of the City of Ukiah'l. AYES: Councilman Wagner, Banker and Smalley. NOES: Councilman Buxton and Runkel. ABSENT: None. COUNCILMAN BANKER: Mr. Banker questioned if there were any f-urther~-deTe-Fopments in the annexation of the Cooper Lane area and theCity Manager reported there were none, that Joe Foutz was not in a position to proceed with any improve- ments in that area and it was felt it should not be included in Annexation No. 62-1. ADJOURNMENT: ATTEST: As there was no further regular business, Mayor Smalley declared the meeting adjourned at 9:20 P.M. after.-which the Council reconvened in :~,losed personnel session.
