HomeMy WebLinkAboutMin 01-03-62MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH - JANUARY 3, 1962 The City Council convened in regular session in the Council Chambers at 8:00 P.M. wi th Mayor Smalley, Councilmen Runkel, Buxton, Banker and Wagner present. APPROVAL OF WARRANTS.- On a motion by Councilman Runkel, seconded by Councilman Buxton, it was unanimously carried Payroll Warrants for the period from December 15th to 31st, 1961 be approved in the amount of $28,287.16. APPROVAL OF MINUTES'. On a motion by Councilman Wagner, seconded by Councilman Buxton, it was unanimously carried the minutes of December 27, 1961 be approved as submitted by the Clerk. COUNTER-ACTION TO BE TAKEN RE C. A. B.'s DECISION RE PACIFIC AIR LINES: The City Attorney suggested the Council consider the following possibilities concerning C.A.B.'s order denying temporary exemption of Pacific's certificate.to serve Ukiah after December 29, 1961. 1 . Take no further action in the matter. · File a petition to C.A.B. requesting that the remainder of the City's original petition be placed in a higher position on the docket. (A pre-trial conference could be held as early as a month according to a C.A.B. official in Washington.) 3. Request C.A.B. to re-consider its position concerning the denial of temporary certificate. The City Attorney was instructed to proceed wi th a request that C.A.B. re-consider its position concerning denial of temporary certificate authority and if this is denied request expeditious handling of the balance of the petition. REFUND AUTHORIZED TO SHELLEY CORPORA TI ON FOR IMPROVEMENTS TO NOKOMIS SUBDV - ~2,000: The City Attorney reported an opinion from the League to the effect that it would be permissible to deposit subdivider's improvement funds with a savings and loan association if it was done on a trust arrangement basis. On a motion by Councilman Buxton, seconded by Councilman Runkel, it was unanimously carried the Director of Finance be directed to accept a trust account in the Mendocino-Lake Savings & Loan Ass'n. in the amount of $2,000 and the Shelley Corporation be refunded $2,000 the City is now holding for im- provements completed in Nokomis Subdivision. IMPROVEMENTS TO RAINS PROPERTY - HELEN AVE: The City Manager reviewed a revised proposal submitted by Ralph Rains for improvements to his property on Helen Avenue which the City Engineer estimated would cost slightly in excess of $800.00.(The approximate cost of the original proposal submitted by Mr. Rains was $248.00, which was accepted by the City but later rejected by Mr. Rains.) The Council discussed this matter at great length. Councilman Runkel made a motion the City construct improvements as outlined in revised proposal submitted by Ralph Rains at a cost of approximately $800.00. The motion died for lack of a second. MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH - JANUARY 3, 1962 - PAGE 2: On a motion by Councilman Wagner, seconded by Councilman Banker, it was carried by a 4 to 1 roll call vote the Council reject the verbal request of Ralph Rains that certain improve- ments be made to his property as per sketch submitted and Mr. Rains be. allowed 30 days to accept original offer by the Ci ty~ AYES: Councilmen Buxton, Banker, NOES: Councilman Runkel . ABSENT: None. Wagner and Smalley. ZONE VARIANCE NO. 62-6 JAMES B. MASSENGILL, 40~) LUCE: The Council reviewed accompanying plot plan together with application for variance by James B. Massengill, M. D., to permit construction of a fence exceeding three feet in height wi thin the required front setback on property located at 409 Luce Avenue. Planning Commission minutes of December 14, !961 were also reviewed in which the Commission recommended the va riance be granted. On a motion by Councilman Buxton, seconded by Councilman Wagner, it was unanimously carried the City Attorney be instructed to prepare a resolution granting Variance No. 62-6 as outlined above. APPROVAl OF WARRANTS: On a motion by Councilman Buxton, seconded by Councilman Banker, it was unanimously carried General Warrants be approved in the amount of $980.69. (Warrants No. 2465-2468) SURVEY TO BE CONDUCTED OF BUILDINGS SUITABLE FOR FALL-OUT SHELTERS: The Council was advised of a letter from the U. S. Army Engineers stating that a survey of Mendocino County will be made to deter- mine buildings which may be suitable for use as fall-out shelters in cases of emergency. NORTH BAY DIV. LEAGUE OF CALIF. CITIES MEETING- JANUARY 27: COUNC The City Manager reported that North Bay Div. League of Calif. Cities Meeting will be held January 27th in Sebastopol and that Mayor Smalley will act as Chairman of the program committee.
