HomeMy WebLinkAboutMin 01-10-62MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH JANUARY lO~ 1962 The City Council convened in regular session in the Council Chambers at 8:00 P.M. with Mayor Smalley, Councilmen Runkel, Banker and Wagner present. Councilman Buxton was absent. APPROVAL OF MINUTES: On a motion by Councilman Runkel, seconded by Councilman Wagner, it was unanimously carried the minutes of January 3, 1962 be approved as submitted by the Clerk. RESOLUTION No. 62-21 GRANTING VARIANCE TO JAMES B. MASSENGILL, M. D. 40~ LUCE AVE.: On a motion by Councilman Wagner, seconded by Councilman Banker, it was unanimously carried Resolution No. 62-21 be adopted and the Mayor and Clerk be authorized to sign same "Resolution Granting Variance to James B. Massengill, M. D. to permit construction of a fence for protective screening in front set-back area on property located at 409 Luce Ave. PETITION FOR RECONSIDERATION & OTHER DOCUMENTS SUBMITTED TO C.A.B. RE PACIFIC AIR LINE: The City Attorney distributed for Council review documents submitted to C.A.B. regarding Pacific Airlines which included Petition for Reconsideration of Portion of Order No. E-17863 Denying Temporary Relief, Motion for Expeditious Handling of Petition, Memorandum in Support of Motion for Expeditious Handling of Petition. COUNCILMAN BUXTON ARRIVED AT THIS POINT IN THE MEETING - 8:05 P.M. The City Attorney reported receiving a telephone call from Mr. T. R. Mitchell, Vice President of Pacific Air Lines suggesting a meeting within the next two weeks. ACCEPTANCE OF IMPROVEMENTS IN OAK MANOR SUBDIVISION UNIT #1 The Council was advised that all liens filed against Oak Manor Subdivision Unit #1 have been satisfied and it is the recommendation of the Director of Public Works that the improvements in this portion of the subdivision be accepted and the bond held by the City in the amount of $90,000 be reduced to $60,000. On a motion by Councilman Wagner, seconded by Councilman BuJ[ton, it was unanimously carried the Council accept the improvements in Oak Manor Subdivision Unit #1 as recommended by the Director of Public Works in his memorandum dated Jan. 3, 1962, and authorized the amount of the bond held by the City may be reduced from $90,000 to $60,000. APPROVAL OF WARRANTS: On a motion by Councilman Buxton, seconded by Councilman Runkel, it was u~animously carried General Warrants be approved as follows: #2470 to Shelley Corporation in the amount of $2,000 and #2469 to Metropolitan Life Ins. Co. in the amount of $14.30 making a total of $2,014.30. REQUEST TO LIVE IN HOUSE TRAILER IN R-1 ZONE - MRS. JOHN DRIVELL: Mrs. John Drivel l and Mr. Art Dahlin were present requesting the Council waive restrictions set forth in Sec. 2460, Ukiah City Code to permit the Drivell's to live in a house trailer on their property in Mill Court on a temporary basis during the reconstruction of their residence which was destroyed by fire. MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH - JANUARY 10, 1962 PAGE 2: Councilman Runkel made a motion, seconded by Councilman Buxton, that the Drivells be granted permission to reside in a trailer house located on their property at 38 Mill Court during reconstruction of their residence. The motion and second were withdrawn upon advice by the City Attorney that it is not within the power of the Council to waive restrictions set forth by ordinance and that the ordinance must be amended by legal p rocedu re. On a motion by Councilman Wagner, seconded by Councilman Runkel, it was unanimously carried it is the feeling of the City Council that Article 2 of Chapter 4, Division 2 of the Ukiah City Code (Sec. 2460 et seq.) relating to trailers and trailer camps was not intended to prohibit certain situations such as use of a house trailer in cases of emergency housing requirements or where a house trailer is to be used for accommoda- ting overnightguests and the City Attorney is instructed to draft an amendment to the code correcting this situation. IMPROVEMENTS TO PROPERTY ON HELEN AVENUE OWNED BY RALPH RAINS: Mr. Ralph Rains was present and expressed dissatisfaction with the action taken by the Council at the last regular meeting whereby his request that certain improvements be made to his property was rejected and the Council allowed Mr. Rains 30 days in which to accept the original offer by the City. Mr. Rains refused to sign the release submitted by the City Attorney and stated that by correcting one problem the City created another problem. Mr. Rains stated that he had solicited estimates of the cost of improvements proposed by him and will submit such estimates from three contractors at the next regular meeting. The matter was continued until the next meeting for receipt of Mr. Rain's estimates. DRAINAGE PROBLEM - 12th DIST. AGR. ASSOC I AT I ON The City Manager reviewed a letter from the 12th District Agricultural Association requesting the Council consider authorizing City personnel to do engineering work toward correcting a drainage problem at the 12th District Fairgrounds. It was pointed out that the cost of the project would be distributed with the 12th District Fair, the State, City and County participating. On a motion by Councilman Buxton, seconded by Councilman Runkel, it was unanimously carried the City Engineer be authorized to estimate the cost of correcting drainage problems on the 12th District Fairgrounds as a portion of the City's contribution to this project. MEETING RE SURVEY OF BUILDINGS SUITABLE FOR USE AS FALLOUT SHELTERS: The Council was advised of a meeting to be held January 19th in the Council Chambers regarding a survey by the U.S. Army Engineers to determine buildings most suitable for use as fallout shelters. NORTH BAY DIV. LEAGUE MEETING SEBASTOPOL - JAN. 27, 1~62: Members of the Council were reminded of the League Meeting to be held in Sebastopol on January 27th. The Chamber of Commerce has suggested Ukiah host the April meeting. On a motion by Councilman Runkel, seconded by Councilman Banker, it was unanimously carried the North Bay Division, League of California Cities be invited to hold its April meeting in Ukiah.
