HomeMy WebLinkAboutMin 02-07-62150 MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH FEBRUARY 7~ 1962 The City Council convened in regular session in the Council Chambers at8:OO P.M. with Mayor Smalley, Councilmen Runkel, Banker and Wagner present. Councilman Buxton was absent. APPROVAL OF WARRANTS.. On a motion by Councilman Runkel, seconded by Councilman Banker, it was unanimously carried Payroll Warrants for the period of January 15th to 31st be approved in the amount of $28,650.94. On a motion by Councilman Runkel, seconded by Councilman Wagner, it was unanimously carried Special Warrants #2622 to #2630 be approved in the amount of $1,248.40. APPROVAL OF MINUTES.. On a motion by Councilman Wagner, seconded by Councilman Banker, it was unanimously carried the minutes of January 24, 1962 be approved as corrected. PRESENTATION OF CERTIFICATE TO THOMAS JOHNDAHL, POLICE OFFICER: Police Officer Thomas Johndahl was commended by Mayor Smalley and presented with a Certificate of Completion of the basic training course at the Santa Rosa Junior College Law Enforcement Academy. The City Manager also commended Officer Johndahl on his accomplishments and advised the Council that he was awarded a certificate in recognition of successful completion of the Juvenile Law Enforcement Officers' Training Course held at Pacific Grove January 7-13, 1962. AGREEMENT FOR THE WIDENING OF WABASH AVENUE- HERMA SCHAMBER: On a motion by Councilman Banker, seconded by Councilman Wagner, it was unanimously carried the City enter into an agreement wi th Herma Schamber for the widening of Wabash Avenue and the Mayor and Clerk be authorized to sign same. RE(~UEST BY LEAGUE FOR CITY PARTICIPATION IN AMICUS CURIAE BRIEF: The Council was advised of a communication from the League of California Cities inviting the City to participate in an amicus curiae brief by contributing $1OO for attorney fees in the case of Supreme Court Decision in In Re Carol Lane invalidating the City of Los Angeles ordinance pro- hibiting and making criminal certain sexual conduct. No action was taken by the Council in this matter. MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH - FEBRUARY 7, 1962 - PAGE 2: COMPROMISE AGREEMENT - RALPH L. AND GRACE RAINS - HELEN AVENUE IMPROVEMENTS: STREET On a motion by Councilman Wagner, seconded by Councilman Banker, it was unanimously carried the City enter into a compromise agreement with Ralph L. and Grace Rains approving a $395.00 settlement for street improvements to property on Helen Avenue, and authorizing the Mayor and Clerk to si gn same. DATE OF PUBLIC HEARING SET RE CHARGES FOR WEED ABATEMENT: (FEBRUARY 24~ 1962): On a motion by Councilman Runkel, seconded by Councilman Banker, it was unanimously carried a public hearing be held on Wednesday, February 14, 1962 to receive a report from the Director of Public Works regarding weed abatement charges. WATER RIGHTS HEARINGS RE MILLVIEW AND WILLOW WATER DISTRICT APPLICATIONS: As a matter of information, the City Attorney reported attending Water Rights Hearings on February 6th regarding applications by Millview and Willow Water Districts for 3 cfs underflow from the Russian River. The City placed its position on record that it did not protest the Willow or Mi llview Water District applications as such provided the City was protected in its prior permits. The Board's decision will be reported to the Council upon receipt of same. ASSEMBLY INTERIM COMMITTEE HEARING RE S.B. 152- FEB. 15th and 16th: The City Attorney offered for Council consideration the presentation he will make at the Assembly Interim Committee Hearings to be held in San Francisco February 15th and 16th. In the event that A.B. 152 is still being considered for adoption in its present form, we feel that some items of the bill should be clarified. The City Manager and City Engineer were authorized to proceed with further investigation of this matter. REPORT ON LEAGUE MEETING I N SEBASTOPOL: The City Manager reported that 11 representatives from Ukiah attended the League Meeting in Sebastopol wi th Ukiah winning third place honors for attendance. He further noted that the April meeting will be held in Ca 1 i stoga. SENATE RE-APPORTIONMENT BILL: The Council was advised that one of the items discussed in the Executive Session of the League meeting was pro- posed legislation to increase the membership of the State Senate, adding three new Senators from Los Angeles County. Members of the executive committee expressed opposition to the Senate Re-apportionment Bill. On a motion by Councilman Banker, seconded by Councilman Wagner, it Was unanimously carried the CityManager direct a letter to Councilman Ryersen of Santa Rosa and the League to the effect that the Council adopted the position of being in opposition to the proposed State Senate re- apportionment program. STATE DIVISION OF HIGHWAYS REQUEST TO ENTER UPON ACCESS ROAD TO SEWAGE TREATMENT PLANT FOR FREEWAY WORK: On a motion by Councilman Wagner, seconded by Councilman Runkel, it was unanimously carried the City Manager be authorized to sign document permitting the State Division of Highways to enter upon the Sewage Treatment Plant road for freeway work supplemental to receipt of formal in- struments from the State. ACCEPTANCE OF GOLF COURSE SHOP AND GARAGE BUILDING: On a motion by Councilman Runkel, seconded by Councilman Banker, it was unanimously carried shop and garage build- ing at the Golf Course be accepted as completed and the City Clerk be authorized file Notice of Completion on same. 153 MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH FEBRUARY 7, 1962 - PAGE 4 REPORT ON SURVEY OF BUILDINGS SUITABLE FOR FALLOUT SHELTERS: The Council was advised that 14 buildings in Ukiah have been found to be suitable for fallout shelters and the consul ting engineers will be in the city February 19th to further investigate these buildings. COUNCILMAN WAGNER: Mr. Wagner questioned the current status of taking over P. G. & E. facilities within the City and the City Manager reported that P. G. & E. is in the process of preparing an agreement of sale which will be submitted to the Council upon completion.
