HomeMy WebLinkAboutMin 02-28-62MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH FEBRUARY 28~ 1962 159 The City Council convened in regular session in the Council Chambers at 8:00 P.M. with Mayor Smalley, Councilmen Runkel, Buxton, Banker and Wagner present. APPROVAL OF MINUTES: On a motion by Wagner, it was 21, 1962 be ap Councilman Buxton, seconded by Councilman unanimously carried the minutes of February proved as corrected. RESOLUTION NO. 62-24 ESTABLISHING CONSOLIDATED VOTING PRECINCTS FOR GENERAL MUNICIPAL ELECTION, & FIXING POLLING PLACES THEREFOR AND HOURS POLLS WILL BE OPEN: On a motion by Councilman Buxton, seconded by Councilman Wagner, it was unanimously carried Resolution No. 62-24 be adopted and the Mayor and Clerk be authorized to sign same "Resolution Establishing Consolidated Voting Precincts for General Municipal Election, and Fixing Polling Places Therefor and Hours Polls Will be Open". DISCUSSION OF CURB & GUTTER LOCATION ON SECTION OF WASHINGTON ST.: The Council was advised that several property ownersare anxious to install curb and gutter in a section of Washington Street west of Dora. There has been no street alignment since this area was annexed to the City and Washington has remained a 50' street. It is recommended that a 40' street curb to curb would be standard. This would requi re the removal of privately owned obstructions which encroach on to the right of way. The Council was in agreement that each property be considered as an individual problem. ZONE VARIANCE APPLICATION #62-8 WM. VEST., M. D. S.E. CORNER OF MILL & DORA STREETS: The City Manager reviewed zone variance application No. 62-8 by Dr. Wm. Vest to permit construction of a medical building on the S. E. corner of Mill & Dora Streets along wi th the minutes of the Planning Commission meeting of February 15, 1962 recommending the variance be granted. On a motion by Councilman Runkel, seconded by Councilman Wagner, it was unanimously carried the City Attorney prepare a resOlution granting Variance No. 62-8 wi th the requirements that parking area be in conformance to plot plan presented and a one year time limit be established in which work may be completed. ZONE VARIANCE (FIRST AMENDED) #62-7 MRS. TORLEIF OLSBORG~ 1116 W. 'Perkins Street. The City Manager reviewed zone variance application No. 62-7 by ,Mrs.. Torleif Olsborg, 1061 W. Standley St., to permit construction of single family units on each of two 48' x"lO0' lots at 1116 W. Perkins Street, along with the minutes of the Planning Commission meeting of February 15, 1962 re- commending the va riance be granted. On a motion by Councilman Buxton, seconded by Councilman Runkel, it was unanimously carried the City Attorney prepare a resolution granting Variance No. 62-8 with the requirement that variance be put into effect wi thin one year. MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH FEBRUARY 28~ 1962 - PAGE 2 COUNCIL INSTRUCTION RE LEGISLATION PRESENTED BY THE LEAGUE OF CALIF. CITIES: Legislation presented by the League of California Cities was reviewed by the City Manager and action taken by the Council was as follows: Liquor License Payments to Cities Threatened by Counties: The Counci 1 authorized the City Manager draft letters legislators opposing this measure. tO , Telephone Company Gross Receipts in Lieu Tax: The Council was generally in favor of this legislation, however, Councilman Runkel voted against the measure and Councilman Banker abstained from voting. 3. Civil Defense Shelters: No action was taken on this mea su re. 4. Commercialized Draw Poker: No action was taken on this mea su re. 5. Local Control of Sexual Activities and Gamblinq: No action was taken on this measure. o Senate Reapportionment: The Council authorized letters be directed to legislators advising them the Council opposes the Senate Reapportionment Bill and a resolution be adopted to that effect. 7. Maintenance of Railroad Crossinq Letter to P. U. C. in opposi ti on authorized by the Council. Protective Devices: to this measure was EMPLOYEES' RETIREMENT PROGRAM: The City Manager presented a very brief procedure report on the balance of the program to consider adoption of a retirement system. As additional information is required from the State Retirement Office in Sacramento this matter wi ll again be presented for Council review at a future meeting. AGREEMENT WI TH DIVISION OF HIGHWAYS- TREATMENT PLANT ROAD: The Council was advised that the State Division of Highways has presented a revised proposal to purchase from the City the treatment plant roadway from Highway lO1 to the Railroad track for the purpose of construction of the freeway over- pass. The proposed purchase price is $10.OO and upon comp!etlon of the freeway construction the portion of the roadway that lies outside of the freeway right-of-way wi ll be reverted back to the County as a County roadway. On a motion by Councilman Wagner, seconded by Councilman Banker, it was unanimously carried the City Attorney be authorized to prepare a resolution for presentation at the next regular meeting authorizing the execution of agreement wi th the Division of Highways as outlined above. REQUEST FOR EASEMENT-MENDO. CO. RUSSIAN RIVER FLOOD CONTROL & WATER CONSERVATION IMPROVEMENT D I STRI CT: It was the recommendation of the City Manager that no action be taken by the Council regarding the easement requested by the Mendocino County Russian River Flood Control & Water Conservation Improvement District until more details con- cerning maintenance and the hold harmless clause specified in the document presented to the City are acquired. MINUTES OF THE MEETING OF THE COUNCIL OF FEBRUARY 28, 1962 - PAGE 3 THE CITY OF UKIAH 161 APPROVAL OF WARRANTS On a motion by Councilman Wagner, seconded by Councilman Banker, it was unanimously carried General Warrants #2765 to and including #2773 be approved for payment in the amount of $412.74. COUNCILMAN RUNKEL: Mr. Runkel commented on the Airport Commission Meeting minutes of February 20, 1962 regarding the expi red business license of Andy Anderson and was informed that Mr. Anderson has agreed to pay the license fee. Mr. Runkel also suggested the City Manager encourage de- partment heads to carefully scrutinize expenditures based on the fact that revenues have not been as large as anti- cipated for the 1961-62 fiscal year. Mr. Cash informed the Council that he has so advised the department heads. ADJOURNMENT As there was no further regular business, Mayor Smalley declared the meeting adjourned at 10:20 P.M. after which the Council reconvened in closed personnel session.
