HomeMy WebLinkAboutMin 05-02-62MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH MAY 2, 1962 The City Council convened in regular session in the Council Chambers at 8:00 P.M. with Mayor Wagner, Councilmen Runkel, Buxton and Smalley present. Councilman Banker was absent. APPROVAL OF WARRANTS: On a motion by Councilman Smalley, seconded by 'Councilman Buxton, it was unanimously carried Payroll Warrants for the period of April 15 to 30, 1962 be approved in the amount of $27,578.49 and ordered paid. On a motion by Councilman Runkel, seconded by Councilman Buxton, it was unanimously carried General Warrants in the amount of :$489.59 be approved and ordered paid. APPROVAL OF MINUTES: On a motion by Councilman Runkel, seconded by Councilman Smalley, it was unanimously carried the minutes of April 25, 1962 be approved as submitted by the Clerk. RES. NO. 62-39 DECLARING WEEDS & RUBBLE UPON PRIVATE PROPERTY TO BE PUBLIC NUISANCE AND ORDERING ABATEMENT OF SAME: COUNCILMAN BANKER ARRIVED AT THIS POINT IN THE MEETING - 8:05 P.M. On a motion by Councilman Banker, seconded by Councilman Smalley, it was unanimously carried Res. No. 62-39 be adopted and the Mayor and Clerk'be authorized to sign same "Resolution Declaring Weeds and Rubble Upon Private Property to be Public Nuisance and Ordering Abatement of Same", public hearing to be held Wednes- day, May 16, ]962 at 8:00 P.M. or soon thereafter. STUDY SESSION ON PROPOSED TRAFFIC ORDINANCE: Based upon a recommendation by the City Attorney, the Council agreed to meet in a special study session on Thursday, May 10, 1962 at 7:30 P.M. in the City Manager's Office to review a proposed traffic ordinance. REQUEST FOR 'LEGAL OPINION RE POSITION OF GOLF PRO AND CONTRACT WITH CITY: Rev. Ralph Fellerson was recognized representing the group pro- testing the issuance of a beer license at the Municipal Clubhouse, requesting a legal opinion from the City Attorney clarifying the position of the golf pro and his contract with the City. Accord- ing to Rev. Fellerson, he is seeking this information for submission to the Alcoholic Beverage Control Board. On a motion by Councilman Banker, seconded by Councilman Smalley, it was unanimously carried the City Attorney be instructed to submit a legal opinion to the Council for the next regular meet- lng as to the position of the golf pro and his contract with the City. GEO. VON KAGLER COMPLAINT RE ROCK CONDITION ON FORD STREET: Mr. George Von Kagler was recognized protesting that the City, in the course of installing a water main on Ford Street, created a problem whereby he cannotabate the weeds in front of his property. This matter will be investigated by the City Engineer. MINUTES OF THE MEETIN6 OF THE COUNCIL OF THE CITY OF UKIAH MAY 2, 1962 - PAGE 2. REVISED PERMIT TO SUPPLY DOMESTIC WATER - DEPT. OF PUBLIC HEALTH: The City Manager reviewed a l'etter from the State Dept. of Public Health, with attached revised permit, allowing the City of Ukiah to supply domestic water with provisions as outlined. This revised permit supersedes all domestic water supply permits previously granted by either the State Board or State Department of Public Health for this water system. On a motion by Councilman Smalley, seconded by Councilman Banker, it was unanimously carried revised permit dated April 26, 1962 submitted by the State Department of Public Health and the conditions as set forth in the permit, be accepted covering the City of Ukiah domestic water supply. PERMISSION GRANTED RODEO COMMITTEE TO HOLD STREET PARADE - MAY 19~ 1962: On a motion by Councilman Runkel, seconded by Councilman Smal]ey', it was unanimously carried the rodeo committee be granted permission to hold a street parade May 19, 1962 at 10:00 A,M, subject to required clearance by the Police and Fi re Bepartments, DISCUSSION OF REVISED RATES FOR MUNICIPAL I~OLF COURSE: Discussion of revised rates for the Municipal Golf Course was deferred by request of the City Manager. RES. NO. 62-38 61RANTING VARIANCE TO MARIE CAPE~ 1498 LOCKWOOD DRIVE: The Planning Commission minutes of April 19, 1962 were reviewed by the City Manager setting forth the recommendation that Variance No. 62-9 be granted Marie Cape, 1498 Lockwood Drive to permit operation of a telephone answering service subject to the following conditions: 1. That in consideration of Sec. 31.11 (c)~of Ordinance No. 429 the opinion of the City Attorney be obtained as to the legality of the use of this property for a home occupation. 2. That there be no signs posted on the property in connection with the proposed use, and 3. That there be no additional parking required for the conduct of this operation. On a motion by Councilman Runkel, seconded by 'Councilman Buxton, it was unanimously carried Res. 62-38 be adopted and the Mayor and Clerk be authorized to sign same "Resolution Granting Variance to Marie Cape" to permit operation of a telephone answering service at 1498 Lockwood Drive. COMPLAINT BY HERBERT WARD RE CONDITION OF CHERRY STREET: Mr. Herbert Ward 205 Cherry Street was recognized requesting that the City correct the condition of Cherry Street to the railroad (across from Apple Ave.) This matter will be investi- gated by the City Engineer. COMPLAINT BY GEO. STRICKLAND RE DUST PROBLEM - CHERRY STREET: Mr. George Strickland, 203 Cherr.y Street, was recognized complaining that a dust problem ~s created by logging trucks operating from private property located on Cherry Street. This matter will also be investigated by the City Engineer. MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH MAY 2, 1962 - PAGE INQUIRY BY GEORGE VON KAGLER REGARDING ZONING: Mr. Geo. Von Kagler inquired if a plan was being worked on for re-zoning within the City and was informed that the Planning Commission is presently working on a zoning plan and map. DISCUSSION RE DEFECTIVE CURB, GUTTER AND SIDEWALK REPLACEMENT: A memorandum from the City Attorney was read setting forth procedures for financing the repair of defective sidewalks. After considerable discussion it was agreed property owners on Church Street be contacted regarding their willingness to replace the sidewalk in the area under construction. ORD. #$51 AUTHORIZING A CONTRACT BETWEEN THE CITY COUNCIL AND THE BOARD OF ADMINISTRATION OF THE CALIF. STATE EMPLOYEES" RETIREMENT SYSTEM: On a motion by Councilman Buxton, seconded by Counci]man S'malley, it was unanimously carried Ord, #551 be adopted and the Mayor and Clerk be authorized to sign same "Ordinance of the City Council of the City of Ukiah Authorizing a Contract Between the City Council and the Board of Administration of the California State Employees' Retirement System", AUTO 'SAFETY CHECK: The City Manager displayed a sample bumper strip which wi 11 be distributed during the auto safety check to be held toward the end of May. HOLY TRINITY CHURCH STRAWBERRY FESTIVAL: On a motion by Councilman Smalley, seconded by Councilman 8uxton, it was unanimously carried the request of the Holy Tronity Church be granted to permit closing off Henry Street between Pine and Bush on June 2nd in connection with its annual Strawberry Festival, sub~ect to Fire and Police approval. SANITATION DISTRICT MEETING: It was noted that the date of the Ukiah Valley Sanitation District meeting has been changed to Monday, May 7th at 9:30 P,M, LETTER FROM CAL-NEVA AIR~ INC.: The Council was advised of a reply from Cal Neva Air, Inc. accepting the City Manager's invitation to meet with City officials regarding scheduled air service to the Ukiah area. The Airport Commission will be contacted in an effort to establish a meeting date. COUNCILMAN RUNKEL: Mr. Runkel inquired as to the cost of maintaining the Bookmobile and County Library project and was informed there is no expense to either the County or City as the project is financed by the State. COUNCILMAN SMALLEY: Councilman Smalley gave a brief report on the North B_ay League of Calif, Cities meeting held in Calls,toga on April 28th and complimented the City Manager on the panel discussion re municipal budge t ing, MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH MAY 2, 1962 - PAGE 4.
