JUNE 6, 1962
The City Council convened in regular session in the Council
Chambers at 8:00 P.M. with Mayor Wagner, Councilmen Smalley,
Banker and Runkel present. Counci 1man Buxton was absent.
APPROVAL OF MINUTES:
On a motion by Councilman Runkel, seconded by Councilman
Smalley, it was unanimouSly carried the minutes of May 23,
1962 be approved as submitted by the Clerk.
APPROVAL OF WARRANTS:
On a motion by Councilman Runkel, seconded by Councilman
13anker, it was unanimously carried payroll warrants for
the period from May 15th to 31st be approved and ordered
paid in the amount of $28,250.70.
On a motion by Councilman Banker, seconded by Councilman
Smalley, it was unanimously carried General Warrants #3191
and # 3192 be approved and ordered paid in the total amount
of $7,096.~+9.
AMENDED APPL I CATI ON FOR VARIANCE
#62-10 - Jeffers Bros, 402 CYPRESS AVE.:
Evidence pertaining to amended application for variance #62-10
by Jeffers Bros. to construct a 32 unit apartment building
at 402 Cypress Avenue, was reviewed by the City Manager.
Contained in the evidence was the Plannin9 Commission minutes
of May 17, 1962 in which the Commission recommended denial
of the permit, and a petition containin9 the signatures of
65 persons protestin9 the 9rantin9 of said variance.
Approximately 30 persons were present at the Public
however~ no one requested permission to be heard.

On a motion by Councilman Runkel, seconded by councilman
Smalley, it was unanimously carried amended application for
variance #67-10 by Jeffers Bros. to construct an apartment
buildin9 at /+02 Cypress Avenue be denied in accordance with
the recommendation of the Plannin9 Commission.
VARIANCE APPLICATION # 67-11
STERLING NORGARD~ 415 JONES ST.:
Evidence pertaining to application for variance #62-11 by
Sterling Norgard to construct an 8' fence on property at
415 Jones Street for privacy and protection of swimmin9
pool was reviewed by the Council. Contained in the evidence
was the Planning Commission minutes of May 17, 1962 in which
the Commission recommended said variance be 9ranted.
COUNCILMAN BUXTON ARRIVED AT THIS POINT IN THE MEETING- 8:20 P.M.
Mr. and Mrs. Norgard were present in behalf of their application.
There were no other persons present requesting to be heard.
On a motion by Councilman Banker, seconded by
it was unanimously carried the City Attorney be instructed
prepare a resolution 9rantin9 Variance #62-11 to Mr. & Mrs.
Sterling Norgard for construction of an 8' fence enclosin9
swimmin9 pool in accordance with recommendations of the
Plannin9 Commission, suitable construction to be determined
by the Building Inspector.

VARIANCE APPLICATION #62-12
HOWARD HOOVER. 1123 MARWEN DRIVE:
The Council was informed that Mr. Hoover has indicated
verbally that he intends to withdraw Variance Application
#62-12 to permit reduction of required side yard to a minimum
of four feet, four inches on property located at ]123
Marwen Drive.

by Howard Hoover to permit encroachment of either 4 inches
into each si de yard or 8 inches into one si de yard be denied
in accordance wi th the recommendation of the Planning Commission.
The motion died for lack of a second.
On a motion by Councilman Banker, seconded by Councilman Runkel,
it was unanimously carried the City Manager contact Mr. Hoover
and inquire if he wishes to withdraw his application for
variance and if so, to present his request for withdrawal in
wri ti ng.
VARIANCE APPLICATION #62-13
D. W. CRESWELL~ D.C.~ 771 N. BUSH ST:
Evidence pertaining to Variance Application #62-13 by D. W.
.Creswell , D. C. to permit use of existing residence at 771 No.
Bush St. for the purpose of maintaining an office and residence
to practice chiropractic, was reviewed by the City Council.
There were no persons present concerning this variance. By
action of the Planning Commission at its meeting of May 17,1962,
it was recommended the variance be granted, subject to the
condition that off-street parking be provided for a minimum
of three ca rs.
On a motion by Councilman Smalley, seconded by Councilman
it was unanimously carried the City Attorney be instructed
prepare a resolution granting variance #62-13 to D. W.
Creswell, D. C. in accordance with the recommendations of
Planning Commission wi th the following conditions: curb,
and sidewall< be constructed, requi red off-street parkin9
area be surfaced and sign should conform to those used in
simi lar]y restricted areas.

REQUEST TO WAIVE BIDS FOR
LEGAL ADVERT! SI NG - 1962-63
The City Manager requested that advertisement for bids for
legal advertising for 1962-63 be waived on the basis there
is only one qualified bidder within the City. The Council
was advised that the Ukiah Daily Journal is agreeable to
continuing legal publications at the same rate as last year.
On a motion by Counci!man Banker, seconded by Counci 1man Smalley,
it was unanimously carried advertisement for bids for legal
advertising for 1962-63 be waived on the basis there is only
one qualified bidder in the city, subject to receipt of a
statement from the publi sher of the Ukiah Daily Journal to
the effect he agrees to the waiver and will guarantee to
continue legal ad publications at the rate of $1 .50 per
legal square for the first publication and $1 .00 for each sub-
sequent publication, said rates being in line wi th normal
established rates.
CONCESSION AGREEMENT - GIORNO PARK:
On a motion by Councilman Smalley, seconded by Councilman Buxton,
it was unanimously carried the City Clerk be authorized to
publish notice of intent setting date Council intends to
consider renewal of concession agreement with M. L. Boswell,
said date being June 20, ]962.
REQUEST TO CALL FOR BIDS
FOR PROPANE GAS - 1962-6.~
Upon request by the City Manager, action on request to call
for bids for propane gas for 1962-63 was deferred one week.

INVITATION TO MENDO. CO.
LIBRARY DEHONSTRATION PROJECT:
An invitation was extended to members of the Council to
attend the opening ceremony of the Mendocino County Library
Demonstration Project, to be held Sunday, June lOth at
2:30 P. M.
COUNCILMAN RUNKEL:
Mr. Runkel inqui red as to the current status of the City's
purchase of P.G. & E. facilities wi thin the City. The
City Manager wi ]l submit a written report on this matter.
COUNCILMAN SMALLEY:
Mr. Smalley inquired if damage to new sidewalk on Sou th
Dora is the problem of the contractor or the City and was
informed that it is the contractor's problem.
COUNCILMAN BANKER:
Mr. Banker inquired as to the type of work being done in
front of the Ukiah General Hospital and was informed that
a drainage problem is being corrected.
