NOVEMBER 28, 1962
The City Council convened in regular session in the Council Chambers
at 8:00 P.M. with Mayor Wagner, Councilmen Runkel, Buxton and Banker
present. Councilman Smalley was absent.
APPROVAL OF MINUTES:
On a motion by Counc|lman Runkel, seconded by Councilman Banker,
it was unanimously carried the minutes of November 21, 1962 be approved
as submitted by the Clerk.
WESTERN UNION TARIFF REGULATIONS:
The City Attorney reported receiving a list of Western Union tarrif regu-
lations proposed to reduce some rates and to increase others on a state-
wide basis. A summary report will be made to the Council on this subject
at a future meeting.
FIRE DEPT. RULES & REGULATIONS:
The City Manager requested action on Fi re Department Rules and
Regulations be deferred to a future meeting.
CITY V. C.A.B. (PACIFIC AIR LINES INC,_)_
The Council was advised that the Mendocino County Board of Supervisors
agrees to share 50% of the cost for personal representation at the
pre-hearing conference in Washington, D. C. in the case of City v. C.A.B.
Based on the action of the Board of Supervisors, the City Attorney
requested a continuance of the Federal Court Hearing scheduled to be held
in San Francisco on December 3, 1962.
COUNCILMAN SMALLEY ARRIVED AT THIS POINT IN THE MEETING - 8:07 P.M.
On a motion by Councilman Smalley, seconded by Councilman Buxton, it
was carried by a 4-1 roll call vote the City Attorney be instructed to
attend pre-hearing conference scheduled December 14, 1962 in Washington,
D. C.
AYES: Councilmen Buxton, Banker, Smalley and Wagner.
NOES: Councilman Runkel.
ABSENT: None
VARIANCE APPLICATION #63-10
TED BURNETTE, 789 LIVE OAK:
Variance Application #63-10 by Ted Burnette, 789 Live Oak, to permit a
six foot paling fence on property line on Cypress Avenue and attached
plot plan were reviewed along with the minutes of the Planning Commission
meeting held November 15, 1962 in which the application was denied.
Slides were shown by Mr. Burnette. Also read, as pertinent to the applica-
tion, were letters from several adjacent property owners expressing no
oppos|tion to the fence.
On a motion by Councilman Buxton, seconded by Councilman Smalley, it
was carried by a 4-1 roll call vote the City Attorney be instructed to
prepare a resolution granting Variance #63-10 to Ted Burnette as set forth
in his application.
AYES: Councilman Runkel, Buxton, Smalley and Wagner.
NOES: Councilman Banker.
ABSENT: None
REQUEST TO CALL FOR BIDS FOR
PETROLEUM PRODUCTS - 1963:
On a motion by Counc|lman Runkel, seconded by Councilman Banker, it
was unanimously carried the Clerk be authorized to call for bids for
petroleum products, bids to be opened at 2:00 P.M. December 18, 1962.
REQUEST FOR ABANDONMENT OF A
PORTION OF HORTENSE STREET'
A request by John Nelson that the City abandon all portions of Hortense
Street lying north of the north line of Smith Street was reviewed along
with a sketch showing the area in question.
Mr. Albert R. Ganter was present protesting abandonment of the street
on the basis it would prohibit the development of two building lots
at the rear of his property. Mr. Nelson's request was based on the
fact that he wishes to utilize a portion of the street for a swimming
pool and to fence the area.
On a motion by Councilman Banker, seconded by Councilman Buxton, it was
unanimously carried the request of Mr. John Nelson to abandon all
portions of Hortense Street lying north of the north line of Smith Street
be denied and a letter be directed to Mr. Nelson advising him of this
action.
The City Manager will inspect the property regarding removal of debris.
STATE PROPOSAL FOR SIGNS ON FREEWAY-
The City Manager reported receiving a proposal from the State regarding
signs for the freeway. Some discussion will be required with the County
and Chamber of Commerce to clarify several points in question.
WAUGH LANE DRAINAGE PROJECT:
The Council was advised the installation of culvert in the Waugh Lane
drainage project is progressing and the County will participate by
cleaning the portion of the ditch outside the City Limits.
ALEX THOMAS DRAINAGE PROBLEM'
The City Manager will submit a memo to the Council regarding the Alex
Thomas drainage problem.
CITY MANAGER PRO TEMPORE:
A memorandum from the City Manager was read recommending Council approval
of the following appointments as City Manager Pro Tempore in the order
listed'
1. Director of Public Works
2. City Attorney
3. Director of Finance
A. S. Kruth
H. A. Irish
R. S. Davis
On a motion by Councilman Smalley, seconded by Councilman Buxton,
it was unanimously carried appointments made by the City Manager in
his memorandum of November 27, 1962 be approved.
UNIVERSITY OF CALIF. COURSE
ON AIRPORT PROPERTY DEVELOPMENT
AND USER TAXATION FINANCING:
The Council approved the City Manager's request to attend the University
of California course on Airport Property Development-Non-Aviation
Activities and User Taxation Financing to be held at Fresno State
College January 9 to 11, 1963.
COUNCILMAN RUNKEL:
Mr. Runkel reported a complaint that warning lights were not placed
on street work on Standley and Pine Street.
Mr. Runkel also suggested the City Hall roof be checked to prevent
further leaking.
