JANUARY 9, 1963
The City Council convened in regular session in the Council
Chambers at 8..OO P.M. with Mayor Wagner, Councilmen Runkel,
Buxton and Banker present. Councilman Smalley and City
Manager Lyell Cash were absent. A. S. Kruth was Acting City
Manager.
APPROVAL OF MINUTES:
On a motion by Councilman Runkel, seconded by Councilman Buxton,
it was unanimously carried the minutes of January 2, 1963 be
approved as submitted by the Clerk.
APPROVAL OF WARRANTS:
On a motion by Councilman Runkel, seconded by Councilman Buxton,
it was unanimously carried Payroll Warrants for the period
December 15 to 31, 1962 be approved and ordered paid in the
amount of $27,674.35.
On a motion by Councilman Banker, seconded by. Councilman Runkel,
it was unanimously carried special warrants ~n the amount of
$9,608.O1 be approved and ordered paid.
RES. NO. 63-31 GRANTING VARIANCE
TO DONALD E. RONES,.. 875 GROVE AVE.:
On a motion by Councilman Buxton, seconded by Councilman Runkel,
it was carried by a 3 to 1 roll call vote Res.~ No. 63-31 be
adopted and the Mayor and Clerk be authorized to sign same
"Resolution Granting Variance to Donald E. Rones" to permit
construction of carport over existing driveway, and construct-
ion of 7 foot high fence along portion of Grove Avenue front-
age.
AYES: Councilmen Runkel, Buxton and Wagner.
NOES: Councilman Banker.
ABSENT: Councilman Smalley.
RES. NO. 63-32 GRANTING VARIANCE TO
ERNEST L. BARTOLOMEI~ 901 W. STANDLEY:
On a motion by Councilman Buxton, seconded by Councilman Runkel,
it was carried by a 3 to 1 roll call vote Res. No. 63-32 be
adopted and the Mayor and Clerk be authorized to sign same
"Resolution Granting Variance to Ernest L. Bartolome'i" to permit
conversion of garage at 901W. Standley St., into dance studio and
to conduct dance instruction.
AYES: Councilmen Runkel, Buxton and Wagner.
NOES. Councilman Banker.
ABSENT.. Councilman Smalley.
WILSON VS. PURITY STORES:'
The City Attorney reported on the case of Wilson vs. Purity
Stores in which the City was brought in as a party defendant.
By Order of the Court the location of the South line of Gobbi
Street is fixed as of a 1920 Survey Map and is 10 feet less
than the property line claimed by Mrs. Wilson and is 10 feet
less than the street line claimed by the City. The Court
determined there was no encroachment by Purity on Mrs. Wi lson's
east property line.
The Engineering Department is reviewing the decision to see
what its affect will be on the City street and traffic situation.
The City Attorney will reserve a recommendation as to Council
action until such time as the formal Findings of Fact are
reviewed by him.
REPORT ON PROGRESS OF PROCEEDINGS
BEFORE C.A.B. RE PACIFIC AIR LINES:
The Council was advised that the hearing before C.A.B.
regarding Pacific Air Lines will be held in the Council
Chambers on February 26th. Interest has been shown by
other parties and they have been notified of their right
to participate in the hearing and to intervene in the
proceedings if they wish to do so.

AGREEMENT WITH BAIRD ADVERTISING
AGENCY FOR STREET REFUSE CONTAINERS:
On a motion by Councilman Banker, seconded by Councilman
Runkel, it was unanimously carried agreement with Baird
Advertising Agency for maintenance of street refuse con-
tainers be approved and the Mayor and Clerk be authorized
sign same.

NOTICE OF OPT ION TO RENEW STANDARD
OIL CO. SERVICE STATION LEASE-AIRPORT:
The Council was advised of formal written notification from
Standard Oil Company that it has exercised its option to
renew the 5 year service station lease on airport property
under the same terms and conditions as the existing lease,
term to commence May 1, 1963 and ending April 30, 1968.
JOINT MEETING WITH PLANNING COMMISSION:
The date of February 7, 1963 was agreed upon for a joint
meeting with the Planning Commission.
INVITATION TO OPEN HOUSE-
ABSCO PAVING COMPANY:
Members of the Council were extended an invitation to inspect
the facilities of Absco Paving Company on Saturday afternoon
January 12th. The Director of Public Works further noted
that with the opening of their plant Absco will begin with'
the paving of Main Street the first of next week.
GOVERNOR'S SAFETY COUNCIL:
The Mayor noted an invitation to attend a meeting of the
Governor's Safety Council to be held February 7th and 8th
Los Angeles.

GISLATION TO INCREASE GAS TAX
TREET IMPROVEMENTS:
The Director of Public Works reported receipt of a communicat-
ion from the League of Calif. Cities regarding the City's
position concerning legislation which would increase gasoline
tax for street improvement purposes and the Council substantiat-
ed previous action taken in opposition of this legislation.
RELOCATION OF CITY FACILITIES IN
CONFLICT WITH FREEWAY CONSTRUCTION:
It was reported that the City has received notice to relocate
its facilities in conflict with freeway construction. Re-
location of utilities will be paid for by the State under the
provisions of State Law and will begin as soon as possible.
The City is proceeding with the engineering work.

FRESNO STATE COLLEGE COURSE
IN AIRPORT MANAGEMENT & DEVELOPMENT:
It was noted that the absence of the City Manager is due
to his attending a course in Airport Ma~nagement and
Development being held at Fresno State COllege.
COUNCILMAN RUNKEL:
Councilman Runkel reported needed fence repairs at Wells
#1 and #2. He suggested members of the Council visit the
Sewage Treatment Plan and commented on the well-kept
appearance of the grounds.
Mr. Runkel questioned the fact that conrad Cox was noted
in the newspaper as representing the City in the Trimeloni
case and was informed that this is in order as it is an
insurance case.
He noted there is no "yield" or "stop" sign at the inter-
section of Spring and Smith Streets and suggested correct-
ive measures be taken to eliminate this hazard.
DIRECTOR OF PUBLIC WORKS:
The Director of Public Works reported receiving word from
the County that it has permission to enter onto property
to clear the drainage channel on Waugh Lane and will begin
work in the very r~ar future.
ADJOURNMENT:
As there was no further regular business, Mayor Wagner
declared the meeting adjourned at 9:00~.M~,~
